Administrator ATTACHMENTS: None APPROVED BY: RECOMMENDED ACTION: Motion to Approve the Labor Agreement for the LELS Local #2 Collective Bargaining Unit for the Years 2010 through 2011 and to Authorize the Necessary Signatures. ISSUE The City of Rosemount and LELS Local #2 (Police Officers) have negotiated in good -faith and have come to a tentative agreement. BACKGROUND Negotiations with the Law Enforcement Labor Services, Local #2, have been completed for a 2010 through 2011 contract. The Collective Bargaining Unit and City have reached a tentative agreement on the following items: 1. Article 21, VEBA /HSA Contribution (Clarifying Language) Clarify: ARTICLE 21 — VEBA /HSA CONTRIBUTION The Employer shall contribute $530 into the employee's VEBA or 1 LSA account in January of the Plan year. Employees hired after January 31 will receive a prorated amount. This contribution shall cease at the time that the City no longer participates in the VEBA #830 Plan or E {S/1 Plans. 2. Article 24.2, Holidays (Clarifying Language) Clarify 24.2 First Paragraph: With the exception of the Floating Holiday, all shift patrol shall be paid one (1) times the employee's regular daily rate on date holiday fell on for eleven (11) holidays per year provided the employee was is employed during the holiday oeetirr he {ore and alter each laid holiday. Employees hired during the year shall be compensated as above for holidays that occurred during the employee's employment. Holiday pay will be by separate entry on the last pay day in November. 3. Article 26, Training (New Language) Add: 26.2 In the event that the actual training time was less than the scheduled time, the officer shall have the option of working for the remaining scheduled time or be paid only for the time spent on training. 4. Article 30, Health Care Savings Plan (New Article) Add: ARTICLE 30 — HEALTH CARE SAVINGS PLAN Law Enforcement Labor Services, Inc., Local No. 2 employees are eligible to participate in the Minnesota Post Employment Health Care Savings Plan established under Minnesota Chapter 352.98 (2001) and as outlined in the Minnesota State Retirement System's Trust and Plan Documents. All funds collected by the employer on behalf of the employee will be deposited into the employee's post health care savings plan account as defined below. Upon severance, all employees eligible for the severance pay as outlined in Article 28 and retirement pay in Article 29 of the Labor Agreement will have funds deposited in their Post Retirement Health Care Savings Plan as outlined in the table below. In addition, eligible employees will contribute on a bi- weekly basis as defined in the following table: Years of Service Time with 0 to 8 Beginning 9`h Year to 16 Beginning of 17`h Year Plus the City of Rosemount years Years Severance Contribution 0 50% of eligible sick leave, 100% of eligible sick leave, vacation, comp, and vacation, comp, and retirement pay. retirement pay. Appendix A - Wages 2010: 1.5% effective January 1, 2010 2011: 1.5% effective January 1, 2011 SUMMARY This month, LELS Local #2 voted and approved these contract changes. It is requested that Council approve the labor agreement for the LELS Local #2 Collective Bargaining Unit for the years 2010 through 2011 and to authorize the necessary signatures. 2
