ISSUE
The Hockey Rocks the Pond event is being co- sponsored by The Pond and Fireside Pizza. The
temporary liquor license was approved on July 20, 2010 and limited the hours of the band and service
of alcohol to no later than 10 p.m. and the outside tent area is to be cleared of patrons by 10:30 p.m.
Just prior to the start of that City Council meeting, the Fireside manager informed staff that the
organizers wanted to appeal to the Council to extend the hours toll and 11:30 p.m. The organizers
have submitted a formal appeal.
Staff's previous recommendation to end the event at 10 p.m. was based upon several factors:
• 10 p.m. is a commonly used time for noise related ordinances in City Codes. While
Rosemount does not have a specific Code covering music or similar amplified sound,
construction activities are limited to no later than 10 p.m. M -F and 7 p.m. on Saturday and
Sunday.
• Each year the Police Department responds to a few complaints of music in neighborhoods
when a band or DJ is providing music at an event at a residence. Typically this occurs for a
graduation, wedding reception or other special event. These complaints generally are
received when the music continues past 10 p.m. and sometimes complaints are received
earlier in the evening. Bands or DJs in a backyard setting have a much smaller sound
system than GB Leighton will be using at the Hockey Rocks The Pond event.
• Music on patios at liquor establishments is permitted by City Code as background music
only. A live band will be much louder than background music; therefore, staff believes
limits should be more restrictive.
• Noise complaints are also received occasionally about the loud speaker at the RHS football
stadium. This most often occurs when a game or event goes later than the norm.
RECOMMENDATION
Staff does not support the extension of hours based upon the information provided within the staff
report.

To the members of the Rosemount City Council,
In response to your approval of our Hockey Rocks the Pond event on August 14th, 2010 we feel it
important to appeal our ending time of 10:00pm. We propose that the revised end time will be
11:00pm with everyone cleared out by 11:30pm. It is our hope that this additional time will assist in
raising money for Team 25 while re- cooping our substantial investment in what we hope will become an
annual event here in Rosemount. We ask you to reconsider this to ensure a successful event for all.
