RECOMMENDED ACTION: Motion to adopt a Resolution Electing to Continue
Participating in the Local Housing Incentives Account Program under the Metropolitan
Livable Communities Act Calendar Year 2011 -2020.
ISSUE
The Metropolitan Council has requested a resolution from the City if the City chooses to remain a
participant in the Livable Communities Act and its accompanying programs. The City of Rosemount has
participated from 1996 through 2010. A City Council Resolution has been prepared to participate in the
years 2011 through 2020 with an affordable housing goal of 700 to 1,000 units and a life -cycle housing
goals of 1,000 to 3,465 units.
SUMMARY
The Metropolitan Livable Communities Act (LCA) is a voluntary program that cities may choose to
participate in. The Metropolitan (Met) Council has established a Local Housing Incentives Program for
participating communities including the Livable Communities Demonstration Account (LCDA). The City
has participated in the LCA for the years 1996 through 2010 and has received grant funding through the
LCDA including a $1,587,500 grant for the Waterford Commons project in 2007. If the City chooses not
to participate in the program from 2011 through 2020, the City would not be eligible for any further
LCDA grant nor for any Minnesota Department of Employment and Economic Development (DEED)
clean -up or redevelopment grants. Currently and historically, there is no punishment for not meeting the
adopted goals. Guy Peterson, the Met Council's former LCA manager and current Community
Development Division Director, has stated that very few communities met the 1996 -2010 goals.
The goals that the Met Council has requested that the City adopt are between 700 and 1,000 affordable
housing units and 1,000 to 3,465 life -cycle units. The Met Council calculated affordable units in
community's Comprehensive Plans as all units built above six (6) units per acre and life -cycle units as all
multiple family units including townhomes. The City's adopted 2030 Comprehensive Plan has 2,280 units
over six (6) units an acre and 3,465 multiple family units planned between 2010 which would easily achieve
the Met Council's requested goals.
RECOMMENDATION
Staff recommends the continued participation in the LCA and to adopt the proposed Resolution.

RESOLUTION NO. 2010 -
RESOLUTION ELECTING TO CONTINUE PARTICIPATING IN
THE LOCAL HOUSING INCENTIVES ACCOUNT PROGRAM
UNDER THE METROPOLITAN LIVABLE COMMUNITIES ACT
CALENDAR YEARS 2011 THROUGH 2020
WHEREAS, the Metropolitan Livable Communities Act (Minnesota Statutes sections 473.25
to 473.255) establishes a Metropolitan Livable Communities Fund which is intended to
address housing and other development issues facing the metropolitan area defined by
Minnesota Statutes section 473.121; and
WHEREAS, the Metropolitan Livable Communities Fund, comprising the Tax Base
Revitalization Account, the Livable Communities Demonstration Account, the Local Housing
Incentive Account and the Inclusionary Housing Account, is intended to provide certain
funding and other assistance to metropolitan -area municipalities; and
WHEREAS, a metropolitan -area municipality is not eligible to receive grants or loans under
the Metropolitan Livable Communities Fund or eligible to receive certain polluted sites
cleanup funding from the Minnesota Department of Employment and Economic
Development unless the municipality is participating in the Local Housing Incentives Account
Program under Minnesota Statutes section 473.254; and
WHEREAS, the Metropolitan Livable Communities Act requires the Metropolitan Council to
negotiate with each municipality to establish affordable and life -cycle housing goals for that
municipality that are consistent with and promote the policies of the Metropolitan Council as
provided in the adopted Metropolitan Development Guide; and
WHEREAS, previously negotiated affordable and life -cycle housing goals for municipalities
participating in the Local Housing Incentives Account Program expire in 2010; and
WHEREAS, a metropolitan -area municipality can participate in the Local Housing Incentives
Account Program under Minnesota Statutes section 473.254 if (a) the municipality elects to
participate in the Local Housing Incentives Program; (b) the Metropolitan Council and the
municipality successfully negotiate new affordable and life -cycle housing goals for the
municipality; (c) the Metropolitan Council adopts by resolution the new negotiated affordable
and life -cycle housing goals for the municipality; and (d) the municipality establishes it has
spent or will spend or distribute to the Local Housing Incentives Account the required
Affordable and Life -Cycle Housing Opportunities Amount (ALHOA) for each year the
municipality participates in the Local Housing Incentives Account Program.
NOW, THEREFORE, BE IT RESOLVED THAT the City of Rosemount:
1. Elects to participate in the Local Housing Incentives Program under the Metropolitan
Livable Communities Act for calendar years 2011 through 2020.
2. Agrees to the following affordable and life -cycle housing goals for calendar years 2011
through 2020:
Affordable Housing Goals Range
I Life-Cycle Housing Goals Range
700 to 1,000 Affordable Housing Units
1 1,000 to 3,465 Life-Cycle Housing Units
3. Will prepare and submit to the Metropolitan Council a plan identifying the actions it
plans to take to meet its established housing goals.

Last Friday, Guy Peterson, Director of the Metropolitan Council's Community Development
Division, sent a letter to the City Manager, Administrator or Clerk of each community participating
in the Livable Communities Act (LCA) Local Housing Incentives Account (LHIA), communicating
that it is time to update your community's affordable and lifecycle housing goals for the coming
decade (2011 - 2020). The City's previously adopted LCA LHIA affordable and life cycle housing
goals were negotiated with the Metropolitan Council for the periods 1996 -2010. In order to remain
eligible for grants and loans made through the Livable Communities Act, your city must renegotiate
these goals with the Metropolitan Council and by September 1, 2010 approve and provide us with a
copy of a City Council resolution that incorporates the new goals.
This email is a follow up to that letter, and is being sent to the person on our Livable Communities
email contact list. If you are the same person to have received the letter, my apologies for the
redundancy, but we wanted to make sure all key parties in each community were aware of the need
to establish new goals and remain eligible for Livable Communities Act funding.
Last Friday's letter explained the requirement for renegotiating the goals and included a sample
resolution along with background information about LCA programs as well as a list of funded and
funded LCA applications your city has made from 1996 through 2009. I have attached an electronic
copy of the sample resolution to this email; however, the City may craft the resolution in the manner
that best meets its needs as long as the affordable and life -cycle goals are part of the resolution.
Also, by December 1, 2010, the City must develop a Housing Action Plan outlining the steps the
City will take to help meet its LCA goals. A checklist to assist with the development of the Plan
was attached to last Friday's letter. Much, if not all of that Plan will be able to be taken from the
housing implementation section of the City's Comprehensive Plan Update.
Because we need to receive the approved resolution by September 1, 2010, we are requesting your
assistance to help keep your city eligible for future LCA awards. The letters included proposed
affordable and lifecycle housing goals that were based upon your community's approved
comprehensive plan. We would appreciate it if you would make certain that your City Administrator
has received the letter, and that preparation is underway to approve or negotiate those goals. If you
or other city staff have questions about this process, please contact your Met Council Sector Rep.
