Planner ATTACHMENTS: Resolution, Site Map, Glendalough 2nd APPROVED BY: Addition Final Plat, Glendalough 3rd Addition Final Plat RECOMMENDED ACTION: Motion to adopt a resolution approving vacation of the drainage and utility easements over Outlots A and B, Evermoor Glendalough 2nd Addition plat, subject to conditions. Guide Plan Desig: Current Zoning: U.S. Home Corporation Outlots A and B, Evermoor Glendalough 2nd Addition Located North of Carrach Avenue and West of Carhngford Lane 2 Oudots Totaling 27.7 Acres TR, Transitional Residential R -1, Low Density Residential and Evermoor Planned Unit Development (PUD) The applicant, U.S. Homes, requests vacation of the drainage and utility easements over Oudots A and B, Evermoor Glendalough 2nd Addition. Vacation of these easements is necessary to subdivide portions of Oudots A and B of the Glendalough 2nd Addition plat into twenty nine (29) new single family lots on three blocks located along an extension of the Coachford Avenue semi - circle and the intersection of Coachford Avenue and 13e Street West to be known as Glendalough 3`d Addition. Staff recommends approval of this request. PREVIOUS ACTION The Planning Commission reviewed the Glendalough 3`d Addition final plat during their regular meeting on May 25, 2010. By Ordinance, no public hearing is required for final plats and staff and the Planning Commission found the proposed final plat in compliance with the original preliminary plat. As a result, the Commission recommended the City Council approve this item. ISSUE ANALYSIS By Statute, easement vacations require a public hearing and approval by the City Council. As a matter of course, the City places drainage and utility easements over all oudots. When these oudots are subdivided for future development, the easement must be vacated to allow creation of the new final plat. In this case, the drainage and utility easements over Outlots A and B, Evermoor Glendalough 2nd Addition plat must be vacated to allow creation of the Glendalough 3`d Addition Final plat. RECOMMENDATION Staff recommends conducting a public hearing and then adopting a resolution approving vacation of the drainage and utility easements over Oudots A and B, Evermoor Glendalough 2nd Addition to permit approval of the Glendalough 3`d Addition final plat. 2 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2010 - A RESOLUTION APPROVING THE VACATION OF THE DRAINAGE AND UTILITY EASEMENTS OVER OUTLOTS A AND B, EVERMOOR GLENDALOUGH 2ND ADDITION WHEREAS, the Community Development Department of the City of Rosemount received an application from U.S. Home Corporation requesting Final Plat concerning Oudots A and B, Evermoor Glendalough 2nd Addition creating 29 new single family lots and an Oudot for future development known as Glendalough 3rd Addition, legally described as: Lots 1 -10, Block 1; Lots 1 -12, Block 2; Lots 1 -7, Block 3, and Oudot A, Glendalough Addition, Dakota County, Minnesota. WHEREAS, on May 25, 2010, the Planning Commission of the City of Rosemount reviewed the Final Plat for Glendalough 3rd Addition; and WHEREAS, the Planning Commission adopted a motion to recommend that the City Council approve the Final Plat subject to conditions; and WHEREAS, the vacation of the existing drainage and utility easements over Outlots A and B, Evermoor Glendalough 2nd Addition is required before the Final Plat can be recorded for Glendalough 3rd Addition; and WHEREAS, the City Council reviewed this request and conducted a public hearing on June 15, 2010. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Vacation of the Drainage and Utility Easements over Outlots A and B, Evermoor Glendalough 2nd Addition, legally described as: A drainage and utility easement vacation over, under, and across all that part of Outlots A and B, Evermoor Glendalough 2nd Addition, according to the recorded plat thereof, Dakota County, Minnesota; subject to: 1. The Vacation of the Drainage and Utility Easements over Outlots A and B, Evermoor Glendalough 2nd Addition is effective only upon the recording of the Final Plat of Glendalough 3rd Addition. ADOPTED this 15th day of June, 2010, by the City Council of the City of Rosemount. William H.
