RECOMMENDED ACTION: Motion to Adopt a Resolution Approving the Land
Surveyor's Certificate of Plat Correction for Harmony 5th Addition.
Motion to Authorize the Mayor and City Clerk to sign the Land Surveyor's Certificate
of Plat Correction for Harmony 5th Addition.
SUMMARY
Westwood Professional Services, Inc., the firm who provided the survey services for Rottlund
Homes for the Harmony 5s' Addition plat, has discovered an error in the Harmony Vh Addition plat.
State Statute allows surveyors to file a Surveyor's Certificate of Plat Correction to fix errors and the
Dakota County rules governing plat recording requires that the City approve any plat correction
before it is recorded. Westwood requests that the City approved the plat correction for Harmony 5d'
Addition and that the Mayor and City Clerk sign the Surveyor's Certificate of Plat Correction so that
it can be recorded at the County.
ISSUE
Westwood had provided survey service to Rottlund Homes for the Harmony 5t' Addition plat which
created lots for multiple building types including single family homes, single level townhomes, row
house style townhomes and back -to -back style townhomes. Rottlund is currently constructing a four
unit single level style townhome building on the northeast corner of Bronze Parkway (a public street)
and 13e Street West (a private street). During the creation of the condominium documents for this
townhouse, it was discovered that there is an error in the legal description for the boundary Lot 4
Block 3 (the lot of the four unit townhouse) and Oudot A (the oudot that contains the private street
134`'' Street West). The error is in the length of the line separating the off street parking stalls on the
north side of 134th Street from Bronze Parkway which was platted 0.19 feet too short and the curve on
the curb line of the parking stalls was platted 0.20 feet too long.
To fix this error, Westwood has prepared a Surveyor's Certificate of Plat Correction per the provisions
within State Statute. Dakota County's rules regarding plat recording requires that the City approve the
plat correction and authorize the mayor and City Clerk to sign the Surveyor's Certificate of Plat
Correction. Due to minor nature of the error and that the error and correction only effects private
property under common ownership, staff recommends that the City Council approve the Surveyor's
Certificate of Plat Correction.
RECOMMENDATION
Staff recommends that the City Council adopt the resolution approving the plat correction and
authorize the Mayor and City Clerk to sign the Surveyor's Certificate of Plat Correction.

A RESOLUTION APPROVING THE LAND SURVEYOR'S CERTIFICATE OF PLAT
CORRECTION FOR HARMONY eH ADDITION
WHEREAS, the Community Development Department of the City of Rosemount received an
application from Westwood Professional Services, Inc. (Westwood)requesting a plat correction
concerning boundary of the properties legally described as Lot 4, Block 3 and Outlot A, Harmony
5'h Addition, Dakota County, Minnesota; and
WHEREAS, Westwood prepared Harmony 5th Addition dated July 3rd, 2008 and filed on October 6th,
2008; and
WHEREAS, Craig Morse, surveyor for Westwood, has discovered an error in the boundary between Lot
4, Block 4 and Outlot A, Harmony 5d` Addition and has prepared a Land Surveyor's Certificate of Plat
Correction to resolve the error; and
WHEREAS, staff finds the proposed plat correction is minor in nature and does not affect any public
property nor the function or code compliance of the Harmony neighborhood, and
WHEREAS, on April 6, 2010, the City Council of the City of Rosemount reviewed the application
and staff's recommendation.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the Land Surveyor's Certificate of Plat Correction for Harmony 5rs Addition.
ADOPTED this 6th day of April, 2010, by the City Council of the City of Rosemount.

Remarks: Westwood has prepared the attached Certificate of Correction for the plat of
Harmony 5th Addition. There were two dimensions that were incorrect, one
was off by 0.20 feet and one was off by 0.19 feet. See attached. Please sign
and send back to Westwood and Westwood will take care of getting the
County surveyor signature and taking care of the recording. If you would like,
you can also call us and we can pick it up from the city, also. Any questions,
feel free to call.

Pursuant to the provisions of Minnesota Statutes, Section 505.174, I, Craig W. Morse, a duly Licensed Land Surveyor in and for
the State of Minnesota declares as follows:
That I prepared the plat of HARMONY 5T" ADDITION dated July 3rd, 2008 and filed on October 6`h 2008 in the Office
of the County Recorder, Dakota County, Minnesota, as Document No. 2616357.

On sheet 2 of 2 sheets, the length of a southerly line of Lot 4, Block 3 also being the northerly line of Outlot A, is
dimensioned incorrectly and the length in the curve data for one of the curves on the south side of Lot 4, Block 3 and
the north side of Outlot A is dimensioned incorrectly. They are dimensioned N 86 degrees 01 minutes 25 seconds
West, a distance of 54.94 feet and the curve is dimensioned with a delta angle of 90 degrees 00 minutes 00 seconds a
radius of 4.00 feet and a length of 6.48 feet.
That said plat is hereby corrected in particular as follows:
The length of the line dimensioned N 86 degrees 01 minutes 25 seconds West should be 55.13 feet and the length of
the curve should be 6.28 feet.
I hereby certify that this Surveyor's Certificate of Plat Correction was prepared by me or under my direct supervision and that I
am a duly Licensed Land Surveyor under the laws of the State of Minnesota.
