RECOMMENDED ACTION: Motion to Approve an Off -Sale Liquor License for Rosemount
Liquor & Wine Cellar, Inc. DBA Rosemount Liquor & Wine Cellar for the premise located at
3440 150th Street West.
ISSUE
An off -sale liquor license application was received for Rosemount Liquor & Wine Cellar, Inc. DBA
Rosemount Liquor & Wine Cellar for the premise located at 3440 150th Street West.
SUMMARY
David Landgrebe, President of Rosemount Liquor & Wine Cellar, Inc. submitted the required liquor
license application materials and liquor liability insurance information. Mr. Landgrebe will be purchasing
the current Rosemount Liquor & Wine Cellar with an anticipated closing date of March 4, 2010. A
background investigation was completed by the Police Department.
Mr. Landgrebe is also a co -owner of Carbone's Pizza & Pub and has been active in the management and
operation of that business, which also has a liquor license. Two alcohol related violations have occurred at
Carbone's. One was the failure of a compliance check conducted by the Police Department on December
15, 2009. The employee involved was immediately terminated and the owners of Carbone's appear to
have taken this violation very seriously. A second violation occurred in May 2009 as part of a random
check conducted by agents from the MN Department of Public Safety - Alcohol and Gambling
Enforcement Division (AGED). Carbone's staff was found to have served an obviously intoxicated
person. Enforcement action was taken against Carbone's by AGED. These violations have been dealt
with through administrative penalties. Calls for police service at the business have been relatively few and
there have not been on -going issues at the business.
While the violations are cause to monitor Carbone's more closely, the violations may not reflect directly
upon how Mr. Landgrebe will operate the off -sale liquor store. Although both businesses hold liquor
licenses, operations and controls at an off -sale store are different than at an on -sale restaurant /bar.
Mr. Landgrebe is also aware of the recurring sales to under age persons that have occurred at the current
Rosemount Liquor and Wine Cellar. Staff has discussed this with him and he is aware of the need to be
extremely vigilant in requiring proper identification to insure illegal sales do not occur. Based upon
information learned in the background investigation, staff does not believe the license should be denied.
Staff recommends approval of the Off -Sale Liquor License for Rosemount Liquor & Wine Cellar, Inc.
DBA Rosemount Liquor & Wine Cellar for the premise located at 3440 150`h Street West.
