RECOMMENDED ACTION: Motion to Adopt a Resolution Approving Changes to the Exterior Materials of Specific Multi- family Buildings in Harmony. Motion to Adopt a Resolution Approving a Minor Amendment to the Harmony Area Planned Unit Development (PUD) Agreement Approving Additional Brick on the Easton and Villa Townhomes and the Revisions to the Vantage Townhomes. Motion to Authorize the Mayor and City Clerk to execute an amendment to the Harmony Area Planned Unit Development Agreement. SUMMARY Rottlund Company, Inc. has requested a minor planned unit Development (PUD) agreement amendment to address two issues. First, Rottlund acknowledges that the proper amount of brick was not installed on ten (10) existing Vista style townhome buildings and has requested a PUD amendment to replace this brick by adding additional brick to eleven (11) yet to be built multi - family buildings. Second, Rottlund has requested to modify their previously approved Vantage style back - to -back style townhomes by adding a deck off of the second story and the incorporate the necessary architectural changes to accommodate the deck. ISSUE Exterior Material Changes to Certain Multi family Buildings Minor PUD Amendment Rottlund has constructed ten (10) Vista style condominium buildings in the block bounded by Brockway Avenue, 135`h Street West, and Brass Parkway. The Vista style condominium buildings are back -to -back; three story condominium units in buildings totaling six (6), eight (8), or ten (10) units per building. Many of the ends of the Vista buildings face the public street while the individual units face each other in a network of private streets and drives that provide access to all the units. The Vista buildings were approved as a design in the PUD called "The Gables" which required brick or stone wainscoting on the ends of the buildings wrapping onto the front of the first unit and a brick base on the columns in front of the garages. The ten (10) Vista units were constructed without the brick or stone on the end units. It is unclear why the first Vista building plan was approved without the brick or stone. The error was perpetuated due to the building permit review process in effect for multiple units. When a developer has one building design that is built repeatedly throughout a subdivision, State building code allows a developer to submit one "master" set of building plans. Once the master building plan is reviewed and approved, the developer can get additional building permits for the same building style without submitting another set of building plans. Staff has been working with Rottlund to determine an appropriate way to remedy the lack of brick or stone on the ten existing Vista buildings. All of the units in the ten buildings are sold to individual homeowners. Rottlund met with the homeowner's association (HOA) for the existing Vista buildings and the HOA does not wish to have the disruption that would be necessary to remove the existing siding on the Vista buildings and replace it with brick or stone. To resolve the issue with the HOA, Rottlund has agreed to contribute some funds to the HOA's maintenance fund. The City is not party to this agreement and the agreement does not satisfy the PUD agreement that Rottlund has with the City. Rottlund has requested to reconcile the missing brick and stone by adding additional brick or stone to buildings that Rottlund will build in Harmony in the future. The basis for the Rottlund proposal is to add additional brick and stone on elevations of buildings that face the public streets. This solution is consistent with the intent of the architectural condition for quality materials; ensuring that the project presents a quality project to the public and homeowners traveling in the Project. Rottlund determined the amount of brick or stone that is missing on elevations that face public streets on the ten existing buildings. Rotdund has proposed to add brick to the nine (9) street elevations of eight (8) Easton buildings that face 135d' Street West, Bronze Parkway, Brockway Avenue, and Connemara Trail. In addition, Rottlund is proposing to add additional brick to three (3) Villa building on elevations that will face Bronze Parkway and Connemara Trail. The amount of brick missing from the public elevations of the ten Vista building is approximately 2,100 square feet. The total amount of additional brick placed on the eight Easton and three Villa buildings is approximately 2,610 square feet. To complete this agreement, two resolutions must be approved. First, a resolution must be approved to allow the architectural design deviation to remove the brick requirement from the ten existing Vista buildings. The Harmony East Homeowners Association has already approved removing the brick requirement. Second, a resolution approving a minor PUD amendment to require the additional brick be added to the eight Easton buildings and the three Villa buildings must be acted on by the Council. Vantage Design Minor PUD Amendment On February 19, 2008, the City Council approved a minor PUD amendment to allow the construction of the Vantage style back -to -back townhomes in place of the originally approved Vista style of back- 2 to -back townhomes. The Vantage style is characterized by cantilevered gables over the second and third floors in the middle of the street facades and on every other unit on the garage facades. The original Vantage has an entry door and garage door on the first floor of the units with the living spaces on the second and third floors. There are no other doorways to the exterior of the unit. The proposed amendment to the Vantage design would add a deck on the second floor of the unit that would be installed over the driveway leading to the individual unit garages. This amendment would allow more outdoor space for the residents in which there is precious little private outdoors space provided in any back -to -back style townhome. The decks would extend about 4.5 feet out from the units and run over the entire garage door which is approximately three quarters of the width of the unit. Two sides of the deck would be installed with railing similar to the railing on the stair to the entry door of the unit. The third side of the deck would construct a six foot wall siding with the same lap siding as the building to provide some privacy from the other unit's decks. The other architectural changes needed to allow for the deck include the replacement of one of the second story window with a door to access the deck and the installation of columns to support the deck. The new door will include a transom window over the door to match the line formed by the tops of the windows. The columns supporting the deck will have a brick wainscoting similar to the deck columns on the Vista style back -to -back townhomes. Staff believes that these proposed changes to the Vantage style townhomes necessary to install the decks are consistent with the architectural design approved within the original and staff recommends approval of this minor PUD amendment. RECOMMENDATION Staff recommends the City Council approve a minor amendment to the Harmony Area Planned Unit Development (PUD) to exchange the brick requires between the various multi - family buildings and to approve the revised Vantage plans. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2010 - A RESOLUTION APPROVING THE CHANGES TO THE EXTERIOR MATERIALS OF SPECIFIC MULTI - FAMILY BUILDINGS IN HARMONY WHEREAS, the Community Development Department of the City of Rosemount received an application from Rotdund Homes requesting a deviation to architectural design of certain buildings within the Harmony (formerly Brockway) Area Planned Unit Development (PUD); and WHEREAS, City Code Section 11- 10- 6.B.8. allows for deviations to the architectural designs within the PUD provided both the established homeowner's association (HOA) and the City Council approve the deviations; and WHEREAS, On February 4, 2010, the Harmony East Condominium Association approved the deviations to the architectural design, and WHEREAS, staff finds the architectural design changes provide an equivalent level of architectural design as that approved in the original PUD, and WHEREAS, on March 2, 2010, the City Council of the City of Rosemount reviewed the application and staff s recommendations. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the exterior material for and architectural changes to the following multi- family buildings within the Harmony Area PUD: 1. The brick wainscoting is removed from the Vista style townhomes built on Lots 3, 4, and 5 of Block 1; Lots 1, 2, 3, and 4 of Block 2; and Lots 1, 2, and 3 of Block 3, Harmony Addition, Dakota County. 2. Additional brick shall be added to public nine street elevations of eight Easton style townhomes and three public street elevations of three Villa style townhomes in the locations shown on the site plan provided as Exhibit A. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves a minor amendment to the Harmony (formerly Brockway) Area Planned Unit Development Approving Additional Brick on the Easton and Villa Townhomes and Approving the Revisions to the Vantage Townhomes, subject to conditions: 1. Except as modified by paragraph 1 of this Amendment, the Planned Unit Development Agreement shall remain in full force and effect. 3. The obligations and restrictions of this Amendment run with the land of the Subject Property and shall be enforceable against the Declarant, its successors and assigns, by the City of Rosemount acting through its City Council. This Amendment may be amended from time to time by a written amendment executed by the City and the owner or owners of the lot or lots to be affected by said amendment. The Vantage exteriors were revised to include a deck off the main level living room. Rottlund feels it is important to offer this amenity which increases the marketability of these unit styles. As a result of the current Vista units being viewed as non compliant with the PUD Agreement, Rottlund has agreed to increase the hard surface on both the Easton and future Villa buildings. These alternate elevations of brick will be located in key areas of Harmony that are most visible from the public streets. The attached plan shows these proposed locations. Following discussions with staff, Rottlund agrees to provide additional hard surface to make up the square footage of that which is missing in the existing Vista elevations facing the public streets. There are 8 sides that face the public streets, which is equal to approximately 2,100 square feet of missing hard surface (260 SF x 8 sides). The additional hard surface on the proposed Eastons and Villas equals approximately 2,610 square feet. Below is a table that shows this analysis.
