ATTACHMENTS: Request from McNamara Contracting APPROVED BY: RECOMMENDED ACTION: Motion to authorize extended work hours as noted conditioned upon the immediate installation of advance notice signs. BACKGROUND Council previously approved extended work hours for McNamara Contracting for their work on TH 3 under contract with MnDOT. For the section of TH 3 north of 145th Street, the approved extended work hours allow work between the hours of 7:00 a.m. and 11:00 p.m., 7 days per week. Since the approval of this extension, a second request as attached has been received from McNamara Contracting for an expansion of these extended work hours. As noted in the attached e-mail, the expansion of work hours is being requested to allow for the completion of work in accordance with MnDOT's contract schedule requirements while eliminating the need for the contractor to work during the Rosemount High School graduation ceremony on Saturday, June 5. The expansion of work hours requested is as follows: • Wednesday, June 2 — 5:00 a.m. to 7:00 a.m. (Bonaire Path to 130th Street) • Thursday, June 3 — 5:00 a.m. to 7:00 a.m. (Bonaire Path to 130th Street) and 11:00 p.m. to 11:59 p.m. (142nd Street to McAndrews Road) • Friday, June 4 —12:00 a.m. to 7:00 a.m. (142nd Street to McAndrews Road) • Saturday, June 5 — 5:00 a.m. to 7:00 a.m. (142nd Street to McAndrews Road) The contractor has indicated that the request for full night time operations Thursday night/Friday morning is the key item of the request. Staff has inquired and the contractor responded that if the request is approved by Council, advance notice signing for the full nighttime operation on Thursday, June 3 /Friday, June 4 will be posted immediately by the contractor on TH 3, Connemara Trail, Bonaire Path and McAndrews Road to advise adjacent property owners of the schedule. SUMMARY Should Council support this request, staff recommends Council adoption of the above motion. While the mill removes most of the bituminous there remains a significant amount of "fines" (material under the 200 sieve). We use a mechanical broom to remove as much fines as practical prior to tacking and paving, however it is impossible to eliminate all the fine material. This fine material generates a "dust cloud" behind traffic. On top of the material not able to be swept up heavy traffic levels on the rough surface will cause enough friction to continue to generate more fine material being removed from the existing pavement thus causing more dust behind traffic. For example, last year we milled 140th St., full surface (as we are on TH 3), from Flagstaff Ave. to Diamond Path and left the milled surface to the following day. The most common complaint from community members traveling and living adjacent to the street was the dust generated from traffic during the 24 hour period it was left as a milled surface. B) Allowing 24 hour work north of Bonair will not help with the overall problem as the schedule should the extended hours be allowed would be milling from 142nd to Connemera from 8 pm on Thursday to 8 am on Friday. Otherwise we would mill this area Saturday from 8 am until 8 pm. The reason we would be forced to mill it on Saturday is because we are not held to MN/DOT's temporary lane restriction requirements on Saturdays. On this piece of the road (142nd to Connemera) we are restricted from interfering with traffic from 6 am to 9 am and 3 pm to 6 pm. These limited hours leave us no choice but to mill it on a Saturday or overnight. We were originally scheduled to mill it on Saturday the 5th, but are attempting to accommodate the graduation. C) The time of the graduation is as follows: 6:30 pm — grads line up, 6:50 pm processional, 7 pm graduation. Mike Manning told us we can expect approximately 500 graduates, 100 staff members, and 1500 to 2000 spectators for a total of 2100 to 2600 attendants. Heavy traffic would be from 5 pm to 6:30 pm and again from 7 pm to 8:30 pm. D) MnDot allowing a change in contract timelines: This would be the easiest for everyone, however they will not even consider changing the contract timelines for this event. The project engineer, Charles Graf, goes by the contract documents and only the contract documents and has stated that they will not be changed and must be adhered to. If I had time in my schedule to push the construction in this area off a week, believe me I would. The contract has $2,500 per day liquidated damages and if I am not milled in this area by the night of the 5th (as I would have to wait until the 12th) it will push my possible completion back a week and put me into at least $17,500 liquidated damages. Again, if MnDot were flexible this could be alleviated, but they are sticking to the requirements in the contract. I hope this answers all your questions. That's new to me. Have you heard of that issue? I was always willing to allow 24 hour work north of Bonaire if it's really necessary. is there any way that could help with the overall problem? I would also want to know what time the graduation is on the 5th and how many they expect to come. How can we assess the relative issues without knowing that? And, I still don't think we have an answer as to whether or not MnDot would adjust their contract requirements, which seems to be the driving force of this whole issue. In any case, it seems that you need to prepare an agenda item on this subject. If we don't have any more information than we have now, we may not have a recommendation until the meeting on Tuesday night. Yes, the objective is to eliminate having to work in the area between 1.42nd and Connemera during the graduation. In order for said objective to be realized we would need all 4 requests for extensions of working hours to be granted to allow for the sequentially necessary work to be completed to reach this goal. Unfortunately, all the proposed requested extensions are necessary regardless of TH 3 having a milled surface or not. It just so happens that we could get a lift of bituminous on the area between 142nd and Connemera by Friday night with these extensions. At the last weekly meeting Mike Manning stated that the dust generated from driving on a milled surface would be a concern to the school and we also can eliminate this concern by installing a the first lift of bituminous in said area with our proposed schedule. Essentially, allowing requests 1, 2, and 4 would not allow us to proceed with no work between 142nd and Connemera during the ceremony, we would also need request 3. It appears we will have to go before council for this request. Are you able to put this item on the agenda? Please let me know if you have any questions or need any additional information. If request 3 is absolutely necessary, that would need to be presented to Council next Tuesday. With regard to the project timelines, would MnDOT consider an appropriate extension of the working days for this segment to address the concerns raised by the High School related to graduation? If I am understanding your request below, your objective is to not have to work on June 5 during graduation, not necessarily that having a milled surface on TH 3 is an issue for traffic to /from the High School? A work hour extension has already been granted in Rosemount, and for that we are appreciative. It has recently come to our attention that Rosemount High School is going to have their commencement ceremony in their stadium on Saturday June 5. We did not become aware of this until last Thursday, May 20th when Mike Manning with Rosemount High School attended our weekly meeting, therefore this was not addressed in our previous request for extended hours or our scheduling of the project. Unfortunately, we have a significant amount of work (both milling and paving) scheduled to be done in the area immediately adjacent to the stadium on June 56h. Due to the tight timelines that must be adhered to in the contract there is little we can do, with the current work hour restrictions in place, to avoid working in this area during the commencement. Since we have become aware of the graduation we have been trying to work out a schedule that would allow for us to avoid working in the area of the high school during the ceremony and allow for TH 3 to not have a milled surface in the vicinity of the high school (which I assume will have heavy traffic) during the ceremony. We have now generated a schedule that would allow for this to happen. However, the schedule that we have formulated would require an extension in work hours. The further extended hours and locations, beyond what we have already been granted, would be as follows: 1) Wednesday June 2nd — 5 am to 7 am (Bonair to 130th) 2) Thursday June 3`d —5 am to 7 am (Bonair to 130th) and 11 pm to 11:59 pm (142nd to McAndrews) 3) Friday June 4`h —12 am to 7 am (142nd to McAndrews) 4) Saturday June 5th — 5 am to 7 am (142nd to McAndrews) I would greatly appreciate your consideration of allowing these extended hours as I feel they would be a benefit to both the Rosemount High School community and the project as a whole. I apologize for the late notice, but we are having our weekly meeting tomorrow ( Thurs. 5/27) for this project at 10 am. It would be much appreciated if I could get your initial thoughts on this request prior to the meeting to allow the proposed schedule to be discussed with MN/DOT.
