BACKGROUND: Attached for Council consideration is Change Order #3 for the Akron Avenue Trunk Utility & Railroad Improvements, City Project #417. This change order represents the addition of work previously deleted from the contract in Change Order No. 2, approved by City Council on May 15, 2009. At that time, permanent and temporary easements necessary to construct trunk watermain and sewer improvements on Akron Avenue north of Bonaire path had not been granted by the adjacent landowner west of Akron Avenue, and sewer and watermain improvements were ended at the Akron Avenue / Bonaire Path intersection for extension north in the future. Late in 2009, the aforementioned easements were dedicated to the City at no cost, and Change Order No. 3 reflects the addition back into City Project #417 the work north of Bonaire Path included in the original contract. Extension of trunk sewer and watermain improvements north of Bonaire Path will serve future development on the McMenomy property and others to the north and west of the project area, as well as the City -owned property previously considered for the future Outdoor Athletic Complex. Cost savings will be realized in the long term by completing the trunk utility improvements ahead of the CR 73 roadway improvements, City Project #399, since connection to the trunk utilities with future development will not require removal and replacement of the fully improved (bituminous pavement, concrete curb and gutter, and concrete median) roadway at Bonaire Path. This change results in a net increase of $684,641.55 to the contract for a revised contract amount of $3,170,380.03. All items affected by Change Order No. 3 are funded by the Core Sewer and Core Watermain funds. Unit bid prices will remain the same in Change Order No. 3 with no increases. Additionally, the project completion date has also been changed to June 5, 2010, to reflect the addition of work to the contract and coordination with the CR 73 roadway improvements schedule. The change order reflects a net increase to the contract in the amount of $684,641.55 for a revised contract total of $3,170,380.03. This revised contract amount reflects the addition of work north of Bonaire Path previously deleted due to lack of adequate easement area to construct the improvements. At this time, all necessary easements have been obtained to move forward with the installation of sewer and water north of Bonaire Path.
