Brotzler, PE, Director of P AGENDA NO. 6 Works / City Engineer ATTACHMENTS: Map, Bid Summary, Letter of Recommendation, Cost Calculations, Funding Calculations, Assessment APPROVED BY: Calculations, Assessment Roll, Resolutions, Assessment Objections RECOMMENDED ACTION: 1) Motion to Adopt a Resolution Ordering the Project and Authorizing the Preparation of Plans and Specifications for the 2010 Street Improvements Project, City Project #428 -AND- 2) Motion to Adopt a Resolution Adopting the Assessment Roll for the 2010 Street Improvements Project, City Project #428 -AND- 3) Motion to Adopt a Resolution Receiving Bids and Awarding Contract for the 2010 Street Improvements Project, City Project #428 BACKGROUND: On Friday, April 23, 2010, four bids were received for the 2010 Street Improvement Project and read aloud publicly. On April 26, 2010, bid results and alternates were presented to the Council at a Special Council Work Session for discussion and direction of preferred alternates. Based on the discussion from that meeting, direction was given to award the project with the Base Bid plus Alternate 2, Alternate 3, Alternate 4, and Alternate 10. The low bidder with this bid combination is McNamara Contracting, Inc. who submitted a bid in the amount of $2,047,914.03. RECEIVED BIDS: Based on the low bid amount of $2,047,914.03, the updated estimated project cost is $2,487,216.01. This amount is appro amately 16 percent less than the previously estimated project cost of $2,958,000 included in the feasibility report, however, scope changes during final design may account for some of this difference. The above estimated project cost includes 20% indirect costs for roadway improvements and 25% indirect costs for pedestrian improvements. Costs associated with these improvements will be funded by special assessments and a combination of funds from the street CIP, Municipal State Aid, trail and sidewalk funds, and storm utility funds. GA1:NG1'R0J \438 \05183010 CC PgAssPH- RecAwardBid.doc PROJECT IMPROVEMENTS: The proposed roadway improvements in the project area include the following: • A pavement mill and overlay on roadways within the Country Hills neighborhood • A pavement mill and overlay on the urban section of Shannon Parkway north of Connemara Trail • A pavement mill and overlay on Connemara Trail from Shannon Parkway to just east of Copper Court • Roadway widening on Shannon Parkway at 13' Yd Court to accommodate a turn lane to Shannon Park Elementary School • A pavement overlay on roadways within the Le Foret neighborhood • Roadway reclamation on the rural section of Shannon Parkway from 1,200 feet north of Evermoor Parkway to McAndrews Road • Solar Powered Driver feedback signs on Shannon Parkway Proposed pedestrian improvements in the project area include the following: • Removal of an existing trail and installation of a new 5 foot concrete walk on Dearborn Path, 137th Street West, and Danube Lane • Removal of an existing dead -end trail segment Dane Avenue • Installation of a new 5 foot concrete walk on the east side of Delta Avenue • Installation of a new 5 foot concrete walk on the east side of Shannon Parkway from 137h Street to Evermoor Parkway • Installation of a new 5 foot concrete walk on the north side of Connemara Trail between Diamond Path and Shannon Parkway PUBLIC INFORMATIONAL MEETINGS: Prior to the public hearing, staff hosted several public informational meetings for property owners to address questions and comments regarding the project and proposed assessments. Below is a listing of the public informational meetings: • Informational Open House: October 27, 2009 & October 28, 2009 • Rural- Residential Street Assessment Informational Meeting. January 12, 2010 • New Pedestrian Improvements Informational Meeting: April 27, 2010 • Rural - Residential Street Assessment Informational Meeting: April 28, 2010 In addition to the above informational meetings, notices were mailed to all property owners for Council review of the proposed improvements on at the December 15, 2009 and January 19, 2010 regular City Council meetings. ASSESSMENTS: In accordance with the City's Schedule of Rates and Fees for 2010, the assessable rate for both overlay and rehabilitation projects on existing streets is 35% of the surface improvement cost. The final proposed assessment rates listed on the following page are 10% - 22% louver than the original estimated assessment rates proposed in the feasibility report. 2 A benefit appraisal was prepared for the proposed Shannon Parkway rural - residential feasibility assessment rate of $8,900 per unit based on property owner comments and council discussion. The intent of the benefit appraisal was the review of the proposed assessment of $8,900 per unit based on the City's Schedule of Rates and Fees for 2010 and the assessment practice. The benefit appraisal, which is on file in the Engineering Department, concluded that there is $7,500 to $8,000 of benefit to the rural- residential properties on Shannon Parkway associated with the proposed improvements. Based on the favorable bids received for the project, the final proposed assessment rate of $6,944 per unit is significantly lower than both the feasibility assessment rate of $8,900 per unit and the benefit appraisal rate of $7,500 - $8,000 per unit. SCHEDULE: It is anticipated that construction will begin July 12, 2010 and be completed, including all restoration items, by November 1, 2010. SUMMARY: Staff will provide an overview of the project and respond to questions that Council or the public may have regarding the proposed project and assessments. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Rosemount, Minnesota, as follows: (1) Such proposed assessment, in the amount of $422,761.08, a copy of which is in Clerk's File dated May 18, 2010 is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein is hereby found to be benefited by the proposed improvement. (2) Such assessments shall be as follows: a. The assessments shall be payable in equal annual installments extending over a period of ten (10) years, the first of said installments to be payable with general taxes for the year 2010, collectible with such taxes during the year 2011. b. To the first installment shall be added interest on the entire principal amount of the assessment from July 31, 2010 until December 31 of the year in which such installment is payable. The interest rate shall be set at either 4.90% per annum or 2 points above the City's bond rate at the time the assessments are certified to the County Auditor, whichever is less. To each subsequent installment, when due there shall be added interest for one year at said rate on the unpaid principal amount of the assessment. c. The owner of any property so assessed may at any time prior to the certification of the assessment or the first installment thereof to the County Auditor, pay the whole of the principal amount of the assessment on such property with interest accrued to the date of payment to the City Treasurer, except that no interest shall be charged if the entire assessment is paid by July 31, 2010; and such property owner may at any time prior to November 15 of any year pay to the County Auditor the entire principal amount of the assessment remaining due with interest accrued to December 31 of the year in which said payment is made. It is common knowledge that increased traffic flow on roads abutting residential property actually decreases the market value of residential property. I further object that, in the event my property receives any benefit from the proposed assessment, the amount of the proposed assessment exceeds any benefit to my property. The proposed assessment to the property is equal to approximately $9,000 - $10,000. It would be patently unreasonable to expect that the value of my property will increase by $10,000 as a result of the improvements being implemented in connection with Project 428. I further object to the methodology used to calculate the assessments along Shannon Parkway. According to the City's information, there are 14 "units" in the "Shannon Parkway Rural Section " that are being assessed in an amount equal to $9,000 - $10,000, and 540 "units" that are being assessed in an amount equal to approximately $800 -$900 per "unit." Therefore, the City intends to make 2% of the units bear approximately 21% of the estimated total assessment amount. Firstly, 1 do agree with parts of the project, as several of the roadways and and pedestrian walkways are in need of repair. However, I have several reservations. Firstly, I am curious about why the city feels the need to make large expansions to current roads and pathways, for example widening Shannon Parkway, and the proposed addition of a new pedestrian sidewalk from Connemara to Evermoor Parkway, along Shannon Parkway. When discussing this project as a family, my ten year old asked me why the city would even consider it, since there is a sidewalk on the other side! When I explained there were concerns about pedestrian safety, she said most people cross over anyway, so what was the point? In economic times like these I would hope the council and city planners are taking into consideration any expansion project. I'd also like more clarification on exactly what "improvements" (as in Pedestrian Facility) means. What also is the difference between "rehabilitation" and "overlay'? How does the decision to do one versus the other affect cost, length of time until the next repair, etc.? 1 have no knowledge of road building and repair, but I would like to know why one year the repair patches stayed intact quite nicely, and the next year they peeled right off of the road. It seems to me that finding a better way to repair the existing street would buy the city more time to finance an entire maintenance project instead of adding an extra assessment to those already contributing to city finances. This letter, along with those letters already submitted under separate cover by individual property owners, constitute their formal objection to the proposed special assessments. Minnesota law provides that the cost of road improvements may only be assessed upon individual property owners "based upon the benefits received." Minn. Stat. § 429.051. A special assessment that does not meet this standard violates the constitutional prohibition against takings without compensation. Carlson -Lang Realty Co. v. City of Windom, 240 N.W.2d 517 (Minn. 1976). The City's plan to assess each of my clients' properties approximately $7,000 for improvements to Shannon Parkway fails to satisfy the statutory standard because my clients do not stand to realize anywhere near that amount in increased property values. In fact, the improved road will likely increase traffic on Shannon Parkway, which stands to diminish, not raise, my clients' property values. Further, the proposed assessment roll fails to account for the heavy usage of —and notable benefits received from — Shannon Parkway by residents of the surrounding neighborhoods. The City's own Feasibility Report for this project notes at page 10 that the deterioration of the current road surface has been accelerated due to "the current traffic volumes." And conversely, it will be largely my clients —not the other residents primarily responsible for the current traffic volumes —whose properties will endure the lion's share of the dust, noise, and other disruption caused by the project. Finally, the "Special Benefit Consultation" on which the City is basing the proposed special assessment against my clients relies on insufficient comparables and unfounded assumptions. May 14, 2010 Paae 2 My clients do not believe this appraisal or its unrealistic conclusion would stand up to careful scrutiny. Dosedel v. City of Ham Lake, 414 N.W.2d 751, 756 -57 (Minn. App. 1987). For these and other reasons, it is our hope that the City will substantially modify its plans to levy these special assessments against my clients' properties. Specifically, the City should (1) reevaluate the actual "benefits received" by each of my clients as a result of the improvements to Shannon Parkway, and (2) identify and levy appropriate assessments against all other properties not directly abutting Shannon Parkway that will benefit from the improvements and reduce the proposed assessments against my clients' properties accordingly.
