Amendment to the Waterford Commons Planned Unit Development (PUD) Agreement
Approving Projecting Signs for the Commercial Tenant Spaces.
Motion to Authorize the Mayor and City Clerk to execute an amendment to the
Waterford Commons Planned Unit Development Agreement.
SUMMARY
146`h Street Partners, LLC (i.e. Stonebridge) has requested a minor amendment to the planned unit
development (PUD) agreement to construct and install projecting signs for the building's
commercial spaces. Projecting signs are allowed in the downtown zoning district but the current
standards would require the signs to be mounted partially on the second floor facade and would not
allow signs mounted to the underside of the corner awning. The minor PUD amendment would
develop projecting sign standards that would work for the Waterford Commons building and the
commercial tenant spaces.
ISSUE
Waterford Commons has commercial tenant spaces along the South Robert Trail frontage and on the
west side figade of the interior parking lot courtyard. There are currently three tenants in Waterford
Commons and the developer, Stonebridge, would like to install projecting signs of a common design
for all their commercial tenant spaces. Waterford Commons is zoned C -2 PUD: Downtown
Commercial Planned Unit Development. Projecting signs are permitted in the C -2 zoning district but
the standards would not allow the projecting signs to be installed on the building in locations visually
associated with the corresponding business space. The standard causing the greatest consternation is
the requirement for a ten (10) foot vertical separation between the bottom of the sign and the
adjoining sidewalk.
C -2 Projecting Sign Ordinance Standards
11 -8 -6 C. 1. a. (5) In the C -2 downtown commercial district only, properties may have a sign that projects from the
side of the building in addition to the maximum fifteen percent (15 %) wall sign standard. This sign may not exceed
twelve (12) square feet in side or three feet (3 ) in width. The maximum distance between sign and building face is one
foot (1); however, at no time shall any pmjecting sign encroach the public right of way. No portion of a pmjecting sign
may extend beyond the second floor of the building. No less than ten feet (10) of clearance shall be provided between
the sidewalk elevation and the lowest point of the pmjecting sign. Signs cannot block or diminish design details,
windows or cornices of the building upon which they are placed.
Waterford Commons is a three story building that has a twelve (12) foot tall first floor and ten 00)
foot tall second and third floors. The South Robert Trail facade of Waterford Commons has five
distinct sub - facades. The northern most sub - facade has an awning that projects over the sidewalk
between the eleven (11) and twelve (12) foot elevation on the facade, while the second, third and fifth
most northern sub - facades have horizontal architectural features to separate the first and second
facades between the eleven (11) and twelve (12) foot elevation. The fourth most northern sub- fagade
has a horizontal band at about the ten (10) foot elevation.
Stonebridge is looking to install signs that are roughly square in shape being approximately three feet
wide by three and one half feet tall. If Stonebridge was required to install the signs per the C -2
projecting sign standards, the half of the sign would be mounted onto the second floor on the second
through fifth most northern sub - facades. The ordinance also requires that the signs would be
mounted above the awning on the northern most sub - facade. These locations would not provide a
visual correlation to the business associated with the sign. Stonebridge has worked with staff to
determine projecting sign standards that would visually work with the Waterford Commons
commercial tenant spaces and sub - facades designs. The minor PUD amendment would codify these
standards and allow Stonebridge to install projecting signs for all their commercial tenant spaces.
Minor PUD Amendment Projecting Sign Standards
Signs shall be constructed with a design comparable to that shown on the Waterford Commons Commercial
Sign Templates. The sign templates are illustrative of the sign components and pmportions only. Individual
signs may modi
ft the final dimensions or embellish the design to complement the tenant's logos, incorporate
fafade architectural components, or unique mounting surfaces.
Stonebridge has provided two sign templates to illustrate what are the components and proportions of
the commercial tenant projecting signs. Stonebridge has proposed larger signs (approximately three
by three and one half feet) for the South Robert Trail facades and smaller signs (roughly two by two
and one half feet) for the western facade of the parking lot courtyard. Staff is supportive of the two
different proportions because the South Robert Trail signs will need to be seen at a greater distance
and in a car traveling at greater speed than the western courtyard signs that only need to be seen from
the parking lot. Additionally, staff wishes to allow Stonebridge to construct similar but not necessarily
identical signs to allow design flexibility for the signs that would be mounted under the awning instead
of projecting from the building. Staff intends to permit flexibility to also incorporate architectural
design features unique to each of the five sub - facades or to the design of individual tenant's logos. In
general, the approximate template should be similar but does not have to be the same.
2. Signs shall be mounted in a location to provide a minimum of seven and one half (7.5) feet of clearance between
the bottom of the sign and the sidewalk elevation.

The ten (10') foot separation sign code requirement would not allow the projecting signs to be
installed in a location that would be visually associated with the businesses. Staff worked with
Stonebridge to determine an appropriate clearance dimension that allows Stonebridge to install the
signs on the first floor facade or under the awning while still providing enough clearance as to not
interfere with pedestrian traffic. One factor used in determining the appropriate clearance is the
building code requirement of a minimum of seven (T) feet of clearance for stairwells. Looking at the
sign templates provided by Stonebridge, it was determined that a minimum of seven and one half
(7.5� feet of clearance can be maintained and allow the signs to be mounted in locations that can be
visually associated with the businesses. The proportions of signs under the awnings may need to be
adjusted to be longer horizontally and shorter vertically to maintain the separation but PUD sign
standard #1 would allow for that adjustment.
3. A maximum of one projecting sign is permitted per exterior public access to a commercial tenant space.
The standard allows Stonebridge flexibility in the way they divide or combine commercial space to
accommodate individual tenants while limiting the number of signs allowed per business. This
standards allows one sign for each tenant no matter how small the tenant space (provided that they
have a public access leading the exterior of the building) while limiting businesses to only one sign if
they have a long fagade and only one exterior public access.
4. Projecting signs shall be mounted to the outer most portion of the fafade in a location that does not block or
diminish the windows, cornices, or other architectural design details of the building.
The Waterford Commons facades, particularly the South Robert Trail sub - facades have a variety of
coves, setbacks, or other undulations, as well as many distinctive architectural design features. This
standard is constructed to limit the placement of the projecting signs to locations that would neither
hinder the visibility of the sign not diminish the architectural details of the building. The sign
locations shown on the photos provided by Stonebridge would be appropriate locations to meet this
standard.
RECOMR ENDATION
Staff recommends the City Council approve a resolution to approve the minor amendment to the
Waterford Common PUD agreement to allow projecting signs for the commercial tenant space at
Waterford Commons and allowing staff to enter into the PUD agreement.

� RESOLUTION APPROVING A MINOR AMENDMENT TO THE WATERFORD
COMMONS PLANNED UNIT DEVELOPMENT (PUD) AGREEMENT APPROVING
PROJECTING SIGNS FOR THE COMMERCIAL TENANT SPACES
WHEREAS, the Community Development Department of the City of Rosemount received an
application from 146th Street Partners, LLC requesting projecting signs standards for the commercial
tenant spaces within the Waterford Commons Planned Unit Development (PUD); and
WHEREAS, the existing projecting sign standards would require the signs to be installed in locations that
would not be visually associated with Waterford Commons commercial tenant spaces, and
WHEREAS, staff has prepared and recommends projecting sign standards to complement the unique
architectural design of Waterford Commons, and
WHEREAS, on April 20, 2010, the City Council of the City of Rosemount reviewed the
application and staff's recommendations.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the projecting sign standards for the commercial tenant spaces of Waterford Commons as
follows:
1. Signs shall be constructed with a design comparable to that shown on the Waterford
Commons Commercial Sign Templates (Attachment One). The sign templates are
illustrative of the sign components and proportions only. Individual signs may modify
the final dimensions or embellish the design to complement the tenant's logos,
incorporate fagade architectural components, or unique mounting surfaces.
2. Signs shall be mounted in a location to provide a minimum of seven and one half (7.5')
feet of clearance between the bottom of the sign and the sidewalk elevation.
3. A maximum of one projecting sign is permitted per exterior public access to a
commercial tenant space.
4. Projecting signs shall be mounted to the outer most portion of the facade in a location
that does not block or diminish the windows, cornices, or other architectural design
details of the building.

AMENDMENT TO THE WATERFORD COMMONS PLANNED UNIT
DEVELOPMENT APPROVING PROJECTING SIGNS FOR THE COMMERCIAL
TENANT SPACES
THIS DECLARATION made this day of , 2010, by and
between the 146th STREET PARTNERS, LLC (hereinafter referred to as the "Declarant "), and
the CITY OF ROSEMOUNT, a Minnesota municipal corporation (hereinafter referred to as
the "City ");
WHEREAS, Declarant is the owner of the real property described as Lot 1, Block 1,
Waterford Commons, Dakota County, Minnesota, (hereinafter referred to as the "Subject
Property "); and
WHEREAS, the Subject Property is subject to a Planned Unit Development Agreement,
"Waterford Commons Planned Unit Development Agreement" signed May 21s, 2008,
(hereinafter referred to as the "Planned Unit Development Agreement "); and
WHEREAS, Declarant wishes to amend the Planned Unit Development Agreement as
hereinafter provided, which amendment has been approved and consented to by the City of
Rosemount, acting through its City Council, as evidenced by the duly authorized signatures of its
officers affixed hereto.
NOW, THEREFORE, the Declarant declares that the Subject Property is, and shall be,
held, transferred, sold, conveyed and occupied subject to the covenants, conditions, and
restrictions, hereinafter set forth.
1. The use and development of the Subject Property shall conform to the Planned Unit
Development Agreement except as modified herein.
A. The standards for the projecting signs serving the commercial tenant spaces shall
be as follows:
1) Signs shall be constructed with a design comparable to that shown on the
Waterford Commons Commercial Sign Templates (Attachment One). The sign
templates are illustrative of the sign components and proportions only.
Individual signs may modify the final dimensions or embellish the design to
complement the tenant's logos, incorporate facade architectural components, or
unique mounting surfaces.
2) Signs shall be mounted in a location to provide a minimum of seven and one
half (7.5') feet of clearance between the bottom of the sign and the sidewalk
elevation.
3) A maximum of one projecting sign is permitted per exterior public access to a
commercial tenant space.
4) Projecting signs shall be mounted to the outer most portion of the facade in a
location that does not block or diminish the windows, cornices, or other
architectural design details of the building.
2. Except as modified by paragraph 1 of this Amendment, the Planned Unit Development
Agreement shall remain in full force and effect.
3. The obligations and restrictions of this Amendment run with the land of the Subject
Property and shall be enforceable against the Declarant, its successors and assigns, by the
City of Rosemount acting through its City Council. This Amendment may be amended
from time to time by a written amendment executed by the City and the owner or owners
of the lot or lots to be affected by said amendment.
