RECOMMENDED ACTION: Motion to waive the building material requirement for the Flint Hills controls building as allowed under City Code Section 11- 4 -16 -1 G, subject to the following conditions: 1. The controls building be painted the "peach brick" color as provided on the building elevations. 2. Landscaping be installed per the landscape plan. ISSUE Flint Hills is requesting to construct a new controls building in their refinery that is designed to withstand a 5 PSI blast. The HI: Heavy Industrial zoning district requires that buildings be constructed partially of masonry. Masonry does not withstand a 5 PSI blast. Flint Hills is requesting the City Council waive the building material standards for the masonry as allowed within the HI: Heavy Industrial performance standards. SUMMARY Flint Hills is requesting to construct a new controls building in their refinery that is designed to withstand a 5 PSI blast. The HI: Heavy Industrial zoning district requires that buildings be constructed of 100% masonry on the facades facing the public right -of -way and 40% masonry on the other facades. Flint Hills has stated that masonry will not withstand a 5 PSI blast and the masonry block would become projectiles within such a blast. The building location is about 3/a of a mile south of 117fl` Street just southwest of the old administration building along Clark Road. There is an electrical substation between the proposed building and Clark Road but the site can be seen in certain locations along Clark Road and southbound US Highway 52. The site is not visible from northbound US Highway 52. The City Council has not granted a waiver in the past for exterior building materials when the building can be seen from a public road. The proposed building is made of steel modular sections that are specially reinforced to withstand the 5 PSI blast. To mitigate for the waiver, Flint Hills is offering three compromises. First, landscaping will be installed along the west side of Clark Road to help screen the site. Second, the building will be painted a "peach brick" color which is the same color as the brick of the old administration building. Third, since the 5 PSI zone is limited in area and Flint Hills is moving occupied buildings outside the 5 PSI zone over time, Don Kern (facilities manager for Flint Hills) has committed in his e-mail that all future buildings outside the overpressure zone and visible to the public would be constructed with building materials compliant with the HI zoning district. Staff is supportive of the Flint Hills waiver request recognizing these conditions offered. [mailto:Don.Kern @fhr.com] Sent: Monday, August 09, 2010 2:37 PM To: Zweber, Eric; Lindquist, Kim Cc: Murphy, Mark (Pine Bend) Subject: FW: Control Room Building 1) Regarding the number of buildings inside of the overpressure area, during the last several years we have made a significant effort to remove non - essential personnel from areas that could be subject to elevated pressures. For example, the new maintenance warehouse building was constructed to relocate personnel from shop 1, shop 3/6, the inspection building as well as a few other satellite areas. There are a number of buildings still in the overpressure area, but many of these structures will eventually be torn down or permanently closed to personnel. The only new buildings we might consider in the future are additional blast -rated buildings or non- inhabited process - related structures and support equipment (e.g. compressor houses) but these structures will most likely be out of site. All of these structures are currently clear from public viewing with the exception of distant vantage points from Rich Valley Blvd, which cannot be seen without the use of binoculars. If we have a future building that is visible to the public and outside of the overpressure -rated areas, we will, of course, follow all applicable building codes. 2) We would prefer landscaping and vegetation to help block areas from outside surveillance while leaving sufficient space immediately adjacent to fence lines for security purposes. With the recent addition of cameras we have much better internal surveillance than in the past, so the vegetation at various points along the frontage road is appropriate. While we had to remove several trees last year due to power line encroachment, we have since replaced this vegetation with lower growing species. As for narrative, FHR is asking for an exception to the brick face for this one control building for the following reasons: This new building will be on the edge of one of the potential over pressure areas of the refinery. Overpressure areas generally exist in close proximity to all the towers and process equipment. This building would be very hard to see from public right of way because of the electrical substation that sits in front of it combined with the roughly 800 feet distance back from the frontage road. This building is only 12' -6" feet high. Most important, this building is made of metal to a design rating of 5 PSI. This type of engineered construction typically does not include concrete products as they can crack and loose strength and create additional safety risks such as falling bricks and mortar. FHR is willing to add additional screening per the attached plan along Clark road to better screen this building. FHR is proposing we paint the building a brick color to give the appearance of a brick exterior building at a distance. FHR will continue to work with the staff on future structures but sees this one building as more of an exception. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2010 — A RESOLUTION RECEIVING BIDS AND AWARDING CONTRACT FOR THE ROSEWOOD VILLAGE 3RD STREET AND UTILITY IMPROVEMENTS CITY PROJECT #429 WHEREAS, the City Council authorized the City Engineer to advertise for bids. BE IT FURTHER RESOLVED, by the City Council of the City of Rosemount, Minnesota, as follows: All bids on construction of Rosewood Village 3rd Street and Utility Improvements have been received and tabulated. The bid of Ryan Contracting Company from Elko, Minnesota, in the amount of $83,453.30 for the construction of said improvements is in accordance with the plans and specifications and advertisement for bids, and is the lowest responsible bid and shall be and hereby is accepted. Acceptance of the bid and award of the contract is contingent on receipt by the City of an original letter of credit meeting the requirements of the Development Agreement for the subdivision and plat of Rosewood Village 3rd and in a form acceptable to the City Administrator and City Attorney. 2. Upon satisfaction of the contingency stated in paragraph 1, the Mayor and Clerk are hereby authorized and directed to enter into a contract with said bidder for the construction of said improvements for and on behalf of the City of Rosemount. Upon satisfaction of the contingency stated in paragraph 1, the City Clerk is hereby authorized and directed to return forthwith to all bidders the deposits made with their bids, except that the deposit of the successful bidder and the next two lowest bidders shall be retained until a contract has been executed. Droste, Mayor ATTEST: Amy Domeier, City Clerk CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2010 - 62 A RESOLUTION REQUESTING ENGINEERING FUNDS FOR A PARK AND RIDE FACILITY IN DOWNTOWN ROSEMOUNT WHEREAS, MVTA working with the City of Rosemount has secured a CMAQ grant for a park and ride facility, buses and operating expenses in Rosemount; WHEREAS, engineering funds are not included in the CMAQ grant; and WHEREAS, the construction of the park and ride facility may be able to be advanced to 2011 if engineering and design are completed immediately. THEREFORE, BE IT RESOLVED, that the City Council of the City of Rosemount hereby requests engineering funds in the amount of $105,000 from MVTA to design a park and ride facility in Downtown Rosemount.
