ATTACHMENTS: None APPROVED BY: RECOMMENDED ACTION: Motion to Approve an Off -Sale Liquor License for FPW, LLC DBA Irish Liquors for the premise located at 14495 South Robert Trail subject to submitting a copy of the lease agreement that is consistent with the formal application and deemed acceptable by the Chief of Police and /or City Attorney for the proposed premise and receiving a certificate of occupancy from the Building Official. BACKGROUND An off -sale liquor license has been applied for by FPW, LLC DBA Irish Liquors for the premise located at 14495 South Robert Trail. FPW, LLC formerly held a liquor license to operate MGM Liquors. The license FPW, I.LC currently holds for MGM Liquors will be relinquished upon the issuance of the new license. The MGM located in Rosemount Crossing will be closed. Should MGM be purchased by another entity the required application, fees, background investigation and insurance would be required to re -open the site. The new site for Irish Liquors will be at the spaces previously occupied by Irish Loon and Big Daddy's restaurant. SUMMARY William Kuether, President of FPW, LLC has been in the process of submitting the required liquor license application materials. Mr. Kuether has not submitted a copy of the lease agreement for the proposed premise. The issuance of the liquor license will be conditioned upon receipt of the lease agreement between the landlord and Mr. Kuether. The lease agreement was required as part of the formal application. Mr. Kuether has indicated that he will provide staff a copy of the lease agreement in the next few days. Because staff has not formally reviewed the lease to ensure that it matches the information provided in the application, staff will review the lease and decided whether or not additional City Council action is required to process the liquor license. Staff has also received the background investigation and liquor license fees. A background investigation was completed by the Police Department. Based upon the results of the investigation, police staff found no reason to deny the liquor license. Mr. Kuether plans to begin renovations on site but will not receive a liquor license until the construction is complete and a Certificate of Occupancy is issued. Staff recommends approval of the Off -Sale Liquor License for FPW, LLC DBA Irish Liquors Rosemount for the premise located at 14495 South Robert Trail subject to submitting a copy of the lease agreement that is consistent with the formal application and deemed acceptable by the Chief of Police and /or City Attorney for the proposed premise and receiving a Certificate of Occupancy from the Building Official.
