Motion to Table the Vacation of the Drainage and Utility Easements on Block 7 of Harmony 5 Addition. 4 ROSEMOUNT CITY COUNCIL City Council Regular Meeting: December 15, 2009 EXECUTIVE SUMMARY SUMMARY Rottlund has submitted a final plat for Harmony 6 Addition which would re -plat the townhomes within Block 7 of Harmony 5 Addition. Rottlund Homes is requesting the vacation of the drainage and utility easements on Block 7 of Harmony 5 Addition before they record Harmony 6 Addition. The Planning Commission had reviewed and recommended approval of Harmony 6 Addition at their November 24 meeting. On December 9, Rottlund Homes notified the City that Rottlund wishes to change the way that they would serve the townhouses within Harmony 6t'' Addition with sewer and water. As a result of Rottlund's notification, City staff has removed the approval of the final plat from tonight's agenda. City staff is working with Rottlund to develop a plan for the infrastructure changes in Harmony. Staff does not recommend vacating the drainage and utility easements of Block 7, Harmony 5t Addition until Harmony 6 Addition receives a staff recommendation for approval but the public hearing for the vacation has been published for December 15. Staff is requesting that City Council conduct the public hearing for the vacation to garner any public comment that residents attending tonight's meeting may have, but then close the public hearing and take no formal action on the request. The formal action on the vacation will be requested concurrently with the recommended approval of the Harmony 6`'' Addition final plat at a future City Council meeting, likely in January. CONCLUSION Staff recommends conducting the public hearing for the easement vacation and closing the hearing but deferring formal action until the Harmony 6 Addition final plat is recommended for approval.
