Minutes of the July 7, 2009 Regular City Council ProceedingsROSEMOUNT CITY COUNCIL REGULARD MEETING PROCEEDINGS JULY 7, 2009 CALL TO ORDER Pursuant to due call and notice thereof a regular meeting of the Rosemount City Council was held on Tuesday, July 7, 2009, at 7:30 p.m. in the Council Chambers at City Hall, 2875 145 Street West, Rosemount. Mayor Droste called the meeting to order with Council Members DeBettignies, Weisensel and Bills attending. Council Member Shoe Corrigan was absent. Staff members present included Police Chief Kalstabakken, City Attorney LeFevere, Community Development Director Lindquist, Director of Parks and Recreation Schultz, Assistant City Administrator Foster, City Administrator Johnson, Senior Planner Zweber and Recording Secretary Hanson. The Pledge of Allegiance was said. ADDITIONS OR CORRECTIONS TO THE AGENDA City Administrator Johnson stated there were no changes to the agenda. Motion by Droste. Second by DeBettignies. Motion to adopt the agenda as it stands. Ayes: 4 Nays: 0. Absent Shoe Corrigan. Motion carried. PRESENTATIONS, PROCLAMATIONS AND ACKNOWLEDGEMENTS 3.a. Special Event Update Leprechaun Days Parks and Recreation Director Schultz introduced Maureen Bouchard of the Leprechaun Days committee. Ms. Bouchard approached the Council and gave an update of the upcoming Leprechaun Days events. She stated this is Rosemount's 31' summer for Leprechaun Days with many new and returning events. Ms. Bouchard named several events throughout the ten days and invited volunteers to help with cleaning up after the events. Council member DeBettignies asked about the "A League of Our Own" special guest. Ms. Bouchard stated that Rosemount resident Kay McDaniels was an original member of the women's baseball league on which the movie "A League of Our Own" is based. The movie will be shown Monday night, July 20t at the Marcus Theatre and Kay McDaniels will be present to sign autographs and display memorabilia. Council member Bills asked how people can volunteer to help clean up. Ms. Bouchard replied that people can simply clean up as they go to events; pick up garbage as they see it. Mayor Droste thanked Ms. Bouchard and all volunteers for their work. He mentioned that a schedule of events was included in the recently mailed City newsletter. Ms. Bouchard stated that they have added to that schedule and an updated list of events can be found on the website at www.rosemountevents.com. b. Receive Donation Police Equipment Fund Police Chief Kalstabakken stated that the City is receiving a grant from CenterPoint Energy Fund to purchase first aid emergency supplies for first responders. It is a matching grant (f) ROSEMOUNT CITY COUNCIL REGULARD MEETING PROCEEDINGS JULY 7, 2009 program and funds to match the donation will be taken from the Police Equipment Fund. Mr. Kalstabakken introduced John Wiinamaki of CentrePoint Energy to make the presentation. Mr. Wiinamaki explained the grant program and presented the $2,200.00 grant to Mayor Droste. Mayor Droste thanked Mr. Wiinamaki and stated the City will use the donation for first responder equipment which will benefit all residents of the City of Rosemount. Motion by Bills. Second by Weisensel. Motion to accept a donation in the amount of $2,200 to the Police Equipment Fund from CentrePoint Energy Community Partnership Grant Program and to approve the expenditure of $4,400 from the Police Equipment Fund. Ayes: 4. Nays: 0. Absent: Shoe Corrigan. Motion carried. c. Receive Donation Parks Recreation Dept. Parks and Recreation Director Schultz stated a donation of $400 has been received from the Rosemount High School Girls Blue Line Hockey Boosters to be used for a reimbursement to the operating budget. The funds are to go toward a new sound system in the Community Center Ice Arena. Motion by DeBettignies. Second by Weisensel. Motion to approve the donation of $400.00 from the Rosemount High School Girls Blue Line Hockey Boosters to be used for a reimbursement to the operating budget. The funds are to go toward a new sound system in the Community Center Ice Arena. Ayes: 4. Nays: 0. Absent Shoe Corrigan. Motion carried. Mayor Droste thanked the Rosemount High School Girls Blue Line Hockey Boosters for their donation. CONSENT AGENDA Motion by Weisensel. Second by Bills. Motion to approve the Consent Agenda. a. PUBLIC HEARINGS OLD BUSINESS NEW BUSINESS ANNOUNCEMENTS Mayor Droste reviewed the provided schedule of upcoming meetings and events. The next regular meeting will be held on Tuesday, July 21, 2009, beginning at 7:30p.m. City Attorney LeFevere stated that one exception to the open meeting law is a closed session for attomey -client privilege. He stated the Council is able to go into closed session to discuss the possibility of litigation against the property owner of 14800 Dodd Boulevard for conducting a commercial business within a residential neighborhood. Motion by DeBettignies. Second by Bills. Motion to adjourn to Executive Closed Session. Ayes: 4 Nays: 0. Absent: Shoe Corrigan. Motion carried. CLOSED SESSION 12.a. Discussion of Possible Litigation The meeting was moved to closed session at 7:50p.m. The closed session was held in the Conference Room at City Hall regarding the possible litigation against the property owner of 14800 Dodd Boulevard for conducting a commercial business within a residential neighborhood. The City Council reconvened in regular session at 8:49 p.m. Motion by DeBettignies. Second by Weisensel. Motion to authorize Kennedy and Graven to initiate a civil action against the operators of a commercial business within a residential neighborhood located at 14800 Dodd Boulevard related to continued violations of the City Code. Ayes: 4 Nays: 0. Absent: Shoe Corrigan. Motion carried. ROSEMOUNT CITY COUNCIL REGULARD MEETING PROCEEDINGS JULY 7, 2009 ADJOURNMENT There being no further business to come before this Council, Mayor Droste made a motion to adjourn.
