Minutes of the May 5, 2009 Regular City Council ProceedingsROSEMOUNT CITY COUNCIL ■Q 'e' REGULAR MEETING PROCEEDINGS MAY 5, 2009 CALL TO ORDER Pursuant to due call and notice thereof a regular meeting of the City Council was held on Tuesday, May 5, 2009 at 7:30 p.m. in the Council Chambers at City Hall, 2875 145 Street West, Rosemount. Mayor Droste called the meeting to order with Council Members DeBettignies, Shoe Corrigan, Weisensel and Bills in attendance. Staff members present included Director of Parks and Recreation Schultz, Chief of Police Kalstabakken, City Administrator Johnson, City Engineer Brotzler, City Attorney LeFevere, Communications Coordinator Cox, City Clerk Domeier and Assistant City Administrator Foster. The Pledge of Allegiance was said. ADDITIONS OR CORRECTIONS TO AGENDA City Administrator Johnson stated that a proclamation would be added as item 3.e. Motion by .Droste. Second by Shoe Corrigan. Motion to adopt the Agenda. Ayes: 5 Nays: 0. Motion carried. PRESENTATIONS, PROCLAMATIONS AND ACKNOWLEDGEMENTS 3.a. Commendation of state championship for Rosemount High School swimmer Mayor Droste congratulated and awarded commendations to the Rosemount High School champion swimmers and their coaches for the high accomplishment. 3.b. Student Volunteer Recognition Parks and Recreation Commission Mayor Droste presented Jonathan Nutzman with a plaque of appreciation for serving as a student volunteer on the Parks and Recreation Commission since 2005. 3.c. Recognition of City Clerk certification Mayor Droste presented City Clerk Domeier with a plaque for obtaining her Minnesota Certified Municipal Clerk tide from the Municipal Clerks and Finance Officers Association of Minnesota. 3.d. 2009 Spring Clean Up Day Director of Parks and Recreation Schultz provided information about the clean up day scheduled for Saturday, May 16. 3.e. Proclamation for Poppy Day Mayor Droste provided information on the Proclamation for Poppy Day which will be designated as May 15, 2009 in Rosemount. Motion by Droste. Second by DeBettignies. CONSENT AGENDA Motion by DeBettignies. Second by Shoe Corrigan. Motion to adopt the Consent Agenda items a. h. as presented. a. Minutes of the April 7, 2009 Regular City Council Work Session Proceedings b. Bills Listing c. Set Special Meeting May 19, 2009 d. Fire Secretary Appointment e. Joint Powers Agreement Recovery Act Edward Byrne Memorial Justice Assistance Grant f. Receive Donations Parks Recreation Dept. g. Receive Bids /Award Contract 2009 Street Improvements Project, City Project #426 (Resolution 2009 -23) Ayes: DeBettignies, Shoe Corrigan, Droste, Weisensel, Bills Nays: None. Motion carried. NEW BUSINESS 9.a. Illicit Discharge Ordinance City Engineer Brotzler stated that as part of the City's Storm Water Pollution Prevention Plan (SWPPP) enforced by the Minnesota Pollution Control Agency under the National Pollutant Discharge Elimination System (NPDES), the City is required to establish a program to identify and eliminate illicit and non -storm water discharges entering the storm sewer system. Richard Hibbard with WSB Associates provided information about illicit discharges, effects of illicit discharges, federal requirements and a summary of the ordinance. Council Member Weisensel questioned what enforcement actions have been in place prior to adoption of this ordinance. Mr. Brotzler stated that the City's ability has not been as clearly defined without such an ordinance in place. He added that through development agreements, erosion control requirements and letters of credits staff has had the ability to enforce standards. Council Member Weisensel questioned who determines what is included as an illicit discharge. Mr. Brotzler stated that the determination would be considered by the City Engineer and City Administrator and possibly consultation from the City Attorney for legal consideration. Mayor Droste questioned if a permit was required to discharge items into the sewer system. Mr. Brotzler explained there was no specific permit required. City Attorney LeFevere provided additional information on controlling what is allowed in the storm sewer system. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS MAY 5, 2009 Council Member Bills questioned if the ordinance includes a penalty clause. Mr. LeFevere stated language regarding a penalty was included at the end of the ordinance Council Member Weisensel questioned if there was a permit needed to drain pools into the storm sewer system. He also questioned the amount of chlorine that is included. Mr. Brotzler stated that if there was an issue the City would have the ability to enforce the standards but noted the City would not want to limit residents on draining water from their pools. He would provide more information about the chlorine levels at the second reading. Council Member Bills inquired about receiving information on the practices of other cities that have adopted a similar ordinance Mr. LeFevere stated the ordinance was drafted similar to model ordinance used in other cities. It is a legal requirement to have the ordinance in place and gives the cities tools to enforce issues. He added that he was not aware of another city having issues with enforcing the ordinance. Council Member Weisensel requested additional information on monitoring the agricultural land and to ensure that the City was not assuming enforcement over agricultural land that now is a state responsibility. Discussion was held about the liability issues of the ordinance. ANNOUNCEMENTS Mayor Droste reviewed the upcoming calendar of meetings. The next City Council regular meeting will be held on May 19, 2009.
