The applicant, Paul DeMuth of Dakota County Technical College (DCTC), requests a Planned Unit
Development (PUD) Master Development Plan with Rezoning and PUD Final Site and Building Plan
applications for Dakota County Technical College for a campus sign plan including a dynamic sign.
These applications are necessary to allow construction of two new freestanding ground signs in
addition to permitting the existing signs in place throughout the campus. Staff recommends approval
of this item subject to the conditions outlined in the recommended action section above.
PLANNING COMMISSION ACTION
The Planning Commission held a public hearing to review this item on August 25, 2009. Draft
excerpt minutes from that meeting are attached for your reference. During staff's presentation it was
noted that while the dynamic sign is larger than would typically be allowed in the commercial districts,
staff finds the additional size acceptable under a PUD Sign Plan for the following four reasons. First,
given the approximate 200 acre campus and multiple activities and size of the building on the site, the
proposed size is proportional to the size and scope of the DCTC campus. Second, the sign is within
the 65% wayfinding to 35% dynamic ratio required by the Sign Ordinance. Third, DCTC has agreed
to a height of 15' 7" rather than the 20' typically permitted for dynamic signs in commercial districts
along County Road 42. Finally, the applicant has agreed to construct a higher quality sign base made of
rock-face block matching the sign and concession stand for the new soccer field. With the exceptions
noted in the PUD Sign Plan, the proposed dynamic sign shall conform to the standards contained in
Section 11- 8 -5.E: Dynamic Signs. Commissioner Messner asked if future expansion of County Road
42 could require relocation of the dynamic sign. According to the Dakota County Engineering
department the existing right -of -way should be sufficient for the planned expansion of County Road
42 in this location. After hearing no public comment, the Commission unanimously recommended
the City Council approve this request.
BACKGROUND
Historically, sign development on the DCTC site has been reviewed on a case by case basis.
Currently the zoning ordinance is silent as it relates to sign standards for the P/I Public and
Institutional zoning district. To implement the 2030 Comprehensive Plan and establish a more
consistent review process, staff plans to update the overall development standards for the P/I
district. That update will take a broad inventory of the sites within this district and establish
development standards appropriate on a district wide basis. Because the ordinance currently does
not address signage in the Public Institutional District, and because DCTC is a unique site, staff is
recommending use of a PUD to permit signage on the site.
Planned Unit Development (PUD) Master Development Plan
Final Site and Building Plan
The purpose of a planned unit development is to allow flexibility from the City's traditional
development standards in return for a higher quality project. In this case, a PUD is necessary to
allow development of a comprehensive sign plan for the overall DCTC campus.
Dakota County Technical College is a large and unique site with multiple parcels, activities,
buildings, and entrances. As such staff recommends developing a separate sign plan for the overall
campus as allowed under Section 11- 8- 5.C.15 of the Sign Ordinance (PUD Sign Plans). This plan
would create an overall sign plan for the college similar to those for large commercial shopping
centers with multiple buildings and uses.

Master Development Plan and Rezoning
All applications for a planned unit development (PUD) must include both a master development
plan with rezoning and final site and building plan. The Planning Commission and City Council
shall base their recommendations and actions regarding a PUD application on consideration of the
items listed below. The Planning Commission and City Council may attach such conditions to their
actions as they determine necessary or convenient to better accomplish the purposes of the PUD.
1. Compatibility of the proposed plan with PUD ordinance and the goals and policies of the
comprehensive plan.
Finding: Development of a campus sign plan through a PUD sign plan is consistent with
both the PUD ordinance and the goals and policies of the Comprehensive Plan. As
mentioned above, Section 11- 8- 5.0.15 of the Sign Ordinance (PUD Sign Plans) specifically
outlines the use of a PUD to establish an overall sign plan for larger and unique sites.
2. Effect of the proposed plan on the neighborhood in which it is to be located.
Finding: With the exception of the deviations noted in the PUD, the proposed campus sign
plan will be required to meet all other standards of the Sign Ordinance and should not have
a negative impact on the surrounding neighborhood.
3. Internal organization and adequacy of various uses or densities, circulation and parking
facilities, public facilities, recreation areas, open spaces, screening and landscaping.
Finding: One goal of the campus sign plan is to consolidate DCTC's signage into fewer
larger signs in location that will provide the greatest impact for the college and its patrons.
This should assist in campus organization, traffic circulation and parking and way finding to
the various activities and buildings throughout the campus.
4. Consistency with the standards of section 11 -10 -3 of this chapter pertaining to site and
building plan review.
Finding: The proposed campus sign plan meets or exceeds many of the standards of section
11 -10 -3 (Site and Building Design Review). A detailed review of each of the applicable items
can be found in the Final Site and Building Plan review below.
All PUD master development plan applications must include a rezoning to a specific PUD district.
Dakota County Technical College is located in the P/I Public and Institutional district. Based on
the existing P/I Public and Institutional zoning and the Public and Institutional land use
designation, the subject property should be rezoned to PI /PUD Public and Institutional district
PUD.
Final Site and Building Plan
According to Section 11 -10 -6, the purpose of the final site and building plan review is to insure
compliance with the applicable sections of the City Code. Based on the review of these criteria
provided below, staff finds the final site and building plan in compliance the applicable standards of
the Sign Ordinance, subject to conditions.

Existing Ground Signage. The applicant submitted a Signage Study providing an inventory of the
existing ground signs on the DCTC campus. The details of this study are summarized in the table
below. It should be noted that Permanent Sign 2 is an existing dynamic sign. The results of this
inventory demonstrate that the DCTC site exceeds even the maximum size and number standards
allowed in any zoning district in Rosemount.

Proposed Ground Signage. As part of this application, DCTC proposes to add two additional
permanent signs. The details for these signs are provided in the table below. The first is a traditional
ground sign located approximately 400' south of County Road 42 along Akron Avenue to mark the
access drive to the new Ames Soccer Complex. The second is a dynamic (or electronic) sign located
in the southeast quadrant of the County Road 42 and Akron Avenue intersection.

the additional size acceptable under a PUD Sign Plan for the following four reasons. First, given the
approximate 200 acre campus and multiple activities and size of the building on the site, the proposed
size is proportional to the size and scope of the DCTC campus. Second, the sign is within the 65%
wayfinding to 35% dynamic ratio required by the Sign Ordinance. Third, DCTC has agreed to a
height of 15' 7" rather than the 20' typically permitted in dynamic signs in commercial districts along
County Road 42. Finally, the applicant has agreed to construct a higher quality sign base made of rock-
face block matching the sign and concession stand for the new soccer field. With the exceptions
noted in the PUD Sign Plan, the proposed dynamic sign shall conform to the standards contained in
Section 11- 8 -5.E: Dynamic Signs (see attached).
As noted above, the DCTC site exceeds Rosemount's size and number of signs standards. Given this
fact and that the City's new dynamic sign standards allow each site only one dynamic sign, staff
recommends that a condition of approval require the applicant to remove Permanent Sign 2 (the
existing dynamic sign) prior to issuance of a sign permit for the new dynamic sign.
Campus Sign Plan. As noted above, Section 11-8-5.C15 of the Sign Ordinance (PUD Sign Plans)
allows for the creation of a master sign plan for large and/or unique sites with multiple buildings and

differing activities. The specific standards listed below shall apply to the DCTC Campus Sign Plan. In
all other respects, all signs on the DCTC campus shall comply with the applicable sections of the
Rosemount City Code.
The Council should note that condition 1 relating to permanent signs on the campus. There are long
term plans for access consolidation along Hwy 42 consistent with the Dakota County, County Road
42 Corridor Study. The intent of condition one is that if an access point is removed in the future, if
there is a permanent sign denoting the entrance the sign would be removed within 60 days of the
access closing. In fact staff supported a larger permanent sign at the Akron Avenue location in part
because that will ultimately serve as a signalized intersection into the DCTC property and will function
as the primary access point into the site.
Permanent Ground Signs
1. Signs shall be located adjacent to vehicular access points to facilitate wayfinding. Any
existing sign adjacent to a vehicular access drive in which the access is eliminated, shall
be removed by DCTC within 60 days of the closing of the access.
2. Signs shall be spaced at least 400 feet from any other ground sign.
3. Sign height shall not exceed 15' -7
4. The sign base shall extend at least the full width of the sign face, except for
architectural relief, and be constructed of high quality decorative materials consistent
with existing ground signs and the principal building.
Temporary Signs
1. Signs shall be located adjacent to vehicular access drives or attached to the facade of
the principal structure facing a public street.
2. Signs shall be placed at least 400 feet from any other temporary sign.
3. Sign height shall not exceed 15' -7
4. The number of temporary signs shall not exceed two at any given time.
5. Each sign size is limited to 100 square feet.
CONCLUSION RECOMMENDATION
Staff recommends approval of the Planned Unit Development (PUD) Master Development Plan
with Rezoning and the PUD Final Site and Building Plan applications for a campus sign plan for
Dakota County Technical College. This recommendation is based on the plans submitted by the
applicant, the findings made in this report and the conditions noted in the attached resolutions.

PLANNING COMMISSION REGULAR MEETING
AUGUST 25, 2009
5.c. Dakota County Technical College Planned Unit Development Master Development Plan with
Rezoning and PUD Final Site and Building Plan for a Campus Sign Plan including a Dynamic Sign
(09- 21 -FDP). Planner Lindahl reviewed the staff report. The applicant, Paul DeMuth of Dakota
County Technical College (DCTC), requests a Planned Unit Development (PUD) Master
Development Plan with Rezoning and PUD Final Site and Building Plan applications for Dakota
County Technical College for a campus sign plan including a dynamic sign. These applications are
necessary to allow construction of two new freestanding ground signs in addition to permitting the
existing signs in place throughout the campus. Mr. Lindahl explained the conditions of both
applications.
Commissioner Messner asked if the signs will interfere when the time comes to signalize those
intersections. Mr. Lindahl stated that there is a considerable amount of right of way and the sign will
sit 10 feet from the property line and 25 feet outside of the sight triangle. However, Mr. Lindahl
stated that between the Planning Commission approval and the City Council meeting on September
15, staff can look into what the County will require for a right of way for signaling.
The public hearing was opened at 7:03p.m.
There were no public comments.

Ayes: 4. Nays: None. Motion approved. The public hearing was closed at 7:04p.m.
Commissioner Irving asked if the motion for redesignating the zoning should be made before the
PUD approval. Mr. Lindahl replied that it can be changed if the Commission desires but usually the
master development plan approval is followed by the rezoning approval.

DECLARATION OF COVENANTS
AND RESTRICTIONS

THIS DECLARATION made this 15th day of September, 2009, by the State of Minnesota
(hereinafter referred to as the "Declarant");
WHEREAS, Declarant is the owner of the real property described on Attachment One,
attached hereto and hereby made a part hereof (hereinafter referred to as the "Subject Property
WHEREAS, the Subject Property is subject to certain zoning and land use restrictions imposed
by the City of Rosemount, Minnesota "City in connection with the approval of an application for a
planned unit development for a public /institutional development on the Subject Property; and
WHEREAS, the City has approved such development on the basis of the determination by the
City Council of the City that such development is acceptable only by reason of the details of the
development proposed and the unique land use characteristics of the proposed use of the Subject
Property; and that but for the details of the development proposed and the unique land use
characteristics of such proposed use, the planned unit development would not have been approved; and
WHEREAS, as a condition of approval of the planned unit development, the City has required
the execution and filing of this Declaration of Covenants, Conditions and Restrictions (hereinafter the
"Declaration and
WHEREAS, to secure the benefits and advantages of approval of such planned unit
development, Declarant desires to subject the Subject Property to the terms hereof.
NOW, THEREFORE, the Declarant declares that the Subject Property is, and shall be, held,
transferred, sold, conveyed and occupied subject to the covenants, conditions, and restrictions,
hereinafter set forth.
1. The use and development of the Subject Property shall conform to the following
documents, plans and drawings:

b. Dynamic Sign Elevation, Attachment Three
c. Signage Site Plan, Attachment Four
all of which attachments are copies of original documents on file with the City and are made a part
hereof.
2. Development and maintenance of structures and uses on the Subject Property shall
conform to the following standards and requirements:

amendment to the planned unit development plan or a rezoning to a zoning classification that permits
such other development and use.
4. In connection with the approval of developers of the Subject Property, the following
variances from City Zoning or Subdivision Code provisions were approved:
a. Section 11- 8- 5.C.1: General Regulations Setback.
b. Section 11- 8 -5.H: On- Premise Temporary Signs.
C. Section 11- 8- 7.B.2: District Regulations Sign Size for Public and Institutional
Uses
In all other respects the use and development of the Subject Property shall conform to the
requirements of the City Code of Ordinances.
5. The obligations and restrictions of this Declaration run with the land of the Subject
Property and shall be enforceable against the Declarant, its successors and assigns, by the City of
Rosemount acting through its City Council. This Declaration may be amended from time to time by a
written amendment executed by the City and the owner or owners of the lot or lots to be affected by
said amendment.

THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA, ORDAINS AS
FOLLOWS:
Section 1. Ordinance B, adopted September 19, 1989, entitled "City of Rosemount Zoning
Ordinance," is hereby amended to rezone the property at 1300 145 Street, Rosemount from PI,
Public /Institutional to PI -PUD, Public /Institutional Planned Unit Development, legally described
as follows:

in this Ordinance and all of the notation references and other information shown thereon are hereby
incorporated by reference and made part of this Ordinance.
Section 3. This ordinance shall be effective immediately upon its passage and publication
according to law.

DAKOTA COUNTY TECHNICAL COLLEGE SIGN PLAN PROJECT DESCRIPTION

Dakota County Technical College (DCTC) is a member of the Minnesota State Colleges and
Universities System, serving the southeast Twin Cities metropolitan area of the state. As a two -year
technical college located in Rosemount, Minnesota, the institution offers over 11,500 students (2,812
FYE) annually a wide range of education opportunities to enhance personal growth and community
vitality.
Dakota County Technical College, located at 1300 145th Street/CSAH 42, is seeking to develop a
new campus sign plan with the intent to facilitate way finding for the new soccer field facility and
enhance signage for the College by incorporating new proposed signage at the northwest corner of
their campus visible from CSAH 42. Two new monument signs are proposed a larger sign
(approximately 200 square feet) located at the corner of Highway 42 and Akron Avenue (158th
Street), and a second smaller sign (approximately 50 square feet) is proposed to be located at the
comer of Akron Avenue (158th Street) and a west entry drive to the new soccer field facility and
Dakota County Technical College. The larger sign includes an electronic message sign component
and both signs incorporate a masonry base consistent with the campus architecture.
Currently the College has four permanent signs and four temporary signs. The College has two
original monument signs (28'x 9' -6 located at two entrance access points on Highway 42. The
monument signs direct students and public to two main entrance drives leading to east and west
student parking and building entrances. There are also two existing, smaller signs one (13'- 4 "x6'-
6"), facing Highway 42 and centered between the entrance drives, is in front of the DCTC visitor
building entrance with a single line electronic message. The other sign (11'x7' -6 is located at the
east site boundary Audrey Avenue, and directs students and the public to the Driving Course.
Temporary banner signs are placed periodically along Highway 42 to invite the community to
Septemberfest and informational signs highlight a prairie restoration project. The proposed new
monument sign at Akron Avenue and Highway 42 is spaced approximately 1,500 feet from the next
monument sign and entrance drive.
Dakota County Technical College is large and unique, and is located on multiple parcels with an
approximate 200 -acre site and 3,760 lineal feet of frontage on CSAH 42. DCTC is the largest
technical college in the MnSCU system. Due to the extensive site and building, and the multiple
activities and programs located on their campus, DCTC has numerous access points and entries that
benefit from additional directional signage.
Currently, according to City Ordinance, the signs exceed the number and size allowed for similar
use, institutional use in a residential district. However, the DCTC Campus is not located in a
residential district. The DCTC property is zoned for institutional use and is surrounded on all sides
by agricultural zoned property including the University of Minnesota UMore Park. In addition, the
campus main frontage is to CSAH 42, a 55 mph highway. The proposed sign size and scale are not a
detriment to the area and are not inappropriate for the size of the spaces, the predominant vehicular
traffic, and the speed of travel. The number of signs located at primary access points is appropriate
for this large site. The proposed electronic message board will not negatively impact adjacent uses.

11 -8 -5.E Dynamic Signs. Dynamic signs are allowed subject to the following
standards.
1. District Limitations. Dynamic signs may be located on properties within the C -3,
Highway Commercial, C -4, General Commercial, and PI Public and Institutional
districts that also have frontage along Minor Arterial or Principal Arterial roads as
designated in the Comprehensive Plan.
2. Location. The sign must be located on the site of the use identified or advertised by
the sign.
3. Orientation. When located within 150 feet of a residential use or zone, dynamic
signs must be oriented so that no portion of the sign face is visible from the
residential use or district.
4. Type of sign. Dynamic signs are limited to ground signs only.
5. Text Size and Legibility: The following minimum text sizes shall apply to all dynamic
signs. If a sign is located on a corner with streets that have differing speed limits, the
minimum text size shall be based on the standard for the higher speed limit to ensure
maximum legibility.
6. Mode: Dynamic signs shall only be allowed to operate in a static mode. Animation,
motion or video displays is prohibited. Any change from one static display to
another must be instantaneous and shall not include any distracting effects, such as
dissolving, spinning or fading. The images and messages displayed must be complete
in themselves, without continuation in content to the next image or message or to
any other sign.
7. Size and Number of Dynamic Display: The dynamic portion of any sign shall not
exceed 35 percent of the total allowable area of the sign. The remaining 65 percent
of the allowable sign area cannot have dynamic capabilities even if it's not used.
Each site can have only one dynamic sign and that sign can have only one dynamic
display.
8. Minimum Display Time. The minimum display time shall be 5 minutes. One
exception to this standard would be for time, date and temperature signs which the
federal court has acknowledged as a justifiable exception to limitations on variable
message signs. The time, date and temperature information may change no faster
than once every three (3) seconds, provided that the display of this information
remains for at least 5 minutes before changing to another display.
9. Brightness. Dynamic sign shall not exceed a maximum illumination of 5,000 nits
during daylight hours and a maximum illumination of 500 nits between dusk to dawn
as measured from the sign's face at maximum brightness. All dynamic sign
applications shall include certification from the sign's manufacturer that the sign has
been preset to conform to the luminance levels noted above and these setting are
protected from end users manipulation by password protected software.
10. Color: Dynamic signs may use multiple colors within the display but the use of color
shall not create distraction or a hazard to the public health, safety or welfare. No
portion of the display may change in color or color intensity in any manner. Each
line of text in any direction shall be uniform in color.
11. Operation. All dynamic signs shall be equipped with a means to immediately
discontinue the display if it malfunctions. The owner of a dynamic sign must
immediately cease operation of their sign when notified by the city that it fails to
comply with the standards of this ordinance. The dynamic sign shall remain
inoperable until such time that the owner demonstrates to the City that the device is
in satisfactory working condition and conforms to the standards of this ordinance.
Appeals of the City's direction regarding the operation of a dynamic sign shall follow
the appeals process outlined in Chapter 12: Board of Appeals and Adjustments.
12. Application to Existing Signs. The dynamic sign standards shall apply to all existing
and future dynamic signs, unless otherwise determined by the City that an existing
sign qualifies as a non conforming use under state statute or city code. Any existing
dynamic sign that cannot meet the minim text -size as required by the speed limit
must use the largest size possible for one line of copy to fit in the available display
space.
