RECOMMENDED ACTION: 1) Motion to Adopt a Resolution Accepting a Municipal Cooperative Agreement Funding for the Minnesota Department of Transportation for Trunk Highway 3 (143 to145 Street and Signal Improvements, City Project #421; 2) Motion to Adopt a Resolution Authorizing the Preparation of Plans and Specifications for Trunk Highway 3 (143 to 145 Street and Signal Improvements, City Project #421; -and 3) Motion to Approve Option 1 to Coordinate Improvements with MnDOT in the most efficient and least disruptive manner. 4 ROSEMOUNT City Council Special Meeting: March 18, 2009 BACKGROUND: CITY COUNCIL EXECUTIVE SUMMARY On September 2, 2008, Council authorized the request of funding from Mn /DOT through the Municipal Agreement Program for Trunk Highway (TH) 3 at 145 Street and 143r Street. In a letter dated February 17, 2009 (attached), Mn /DOT representatives announced the decision that the project had been selected for funding at the requested amount. The proposed improvements include a southbound right turn lane at 143` Street, as well as signal replacement at 145 Street with a fully actuated signal system, including updated signal phasing to provide a protective /permissive left-turn phase. Mn /DOT presently has a pavement mill and overlay project scheduled on TH 3 in the same area for their fiscal year 2011 (July 2010 June 2011), and on March 5, 2009, City staff met with Mn /DOT representatives to discuss the potential for coordination of the two projects. From that meeting, three coordination options were identified that would be acceptable to Mn /DOT. A brief summary of those options follows: Option 1: The City would include all work in their project from a point approximately 550 feet north of 143r Street to the 145 Street intersection. The project would not only include the elements originally proposed in the Municipal Agreement, but also include the pavement mill and overlay for the full width of the roadway. For this option, all work within project limits is in one project and constructed in the same year and therefore would be the most efficient and least disruptive to motorists. All improvements are constructed in 2010, and will provide the earliest possible benefit to residents and motorists travelling G: \ENGPROJ 421 3- 18- 09MNDOTCoopAgree143rd- 145thCC.doc through Rosemount. Mn /DOT would provide funding for the mill and overlay portion in addition to the 2010 Municipal Agreement Program funds, so there is no additional cost to the City for this option. Option 2: Mn /DOT does all the roadway work in 2011 including right turn lane construction at 143' Street, and the City does the signal replacement at 145t Street in 2010. This option delays the benefit of the right turn lane by a year, and is not as efficient as Option 1 as it requires some of the signal work done in 2010 to be replaced in 2011 due to overlap in project limits. Option 2 also creates more disruption for the public with the work being conducted over two years. Option 3: The City would do work as originally proposed in the Municipal Cooperative Agreement in 2010, and Mn /DOT conducts their mill and overlay project as originally scheduled in 2011. Although the turn lane would be constructed in 2010, it is preferred practice to pave an adjacent through lane at the same time, which would not be the case with Option 3. As with Option 2, project limit overlap causes inefficiencies with some of the signal work, and more construction impacts in the project vicinity. Should Council choose to consider the coordination of the City's Municipal Cooperative Agreement project with Mn /DOT's mill and overlay of Trunk Highway 3, Staff recommends Option 1 as the most efficient, most cost efficient, and least disruptive and inconvenient to the public. SUMMARY: Staff recommends Council adoption of the above resolutions. 2 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2009 A RESOLUTION ACCEPTING MUNICIPAL COOPERATIVE AGREEMENT FUNDING FROM THE MINNESOTA DEPARTMENT OF TRANSPORTATION FOR TRUNK HIGHWAY 3 (143 to 145 STREET AND SIGNAL IMPROVEMENTS CITY PROJECT #421 WHEREAS, the City of Rosemount wishes to improve the operation and safety of the intersections of TH 3 at 145 Street and TH 3 at 143` Street; and WHEREAS, the City of Rosemount had requested financial participation in the project from the Minnesota Department of Transportation (Mn /DOT) through the Municipal Agreement Program; and WHEREAS, the City of Rosemount is committed to providing the local share of the costs if the project is selected as part of the upcoming Municipal Agreement Program; and WHEREAS, the Minnesota Department of Transportation has sent written confirmation awarding funding for the project; and WHEREAS, the Trunk Highway 3 (143` to 145 Street and Signal Improvements Project includes southbound right turn lane at 143 Street, a new traffic signal at 145 Street and a full width mill and overlay from 145 Street to the end of the 143r Street turn lane. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, DAKOTA COUNTY, MINNESOTA: The City of Rosemount hereby accepts funding from Mn /DOT for the Trunk Highway 3 (143` to 145` Street and Signal Improvements. BE IT FURTHER RESOLVED, that the City Clerk is hereby authorized and directed to forward certified copies of this resolution to Mn /DOT. ADOPTED by the City Council this 18 day of March, 2009. After considering 30 candidates submitted for inclusion in the FY 2010 Program, the Selection Committee has decided to offer a maximum contribution by Mn/DOT of $289,900 (this includes $31,800 for Construction Engineering and Inspection). The award is for the construction of the turn lane at 143` Street and signal reconstruction at 145 Street. The proposal was categorized as a Preservation project with Management components and was 5th out of 11 projects selected for funding. Mn/DOT presently has a mill and overlay project scheduled in this area for FY 2011 and there may be opportunities to coordinate the work. I would recommend we meet soon to discuss the options since that may affect the award. The referenced funding amount is the maximum amount of Mn/DOT FY 2010 Municipal Agreement funding available for this project. Municipal Agreement funds can only be used for construction items that can be justified in accordance with the Mn/DOT Cost Participation Policy. If the cost of eligible items falls below this maximum amount, the funds awarded will be reduced to match the cost of the eligible items. A copy of the Mn/DOT Cost Participation Policy can be viewed at http://www.dot.state.mn.us/stateaid/forms/ds12_1.pdf If this funding is accepted by your agency you will be expected to provide project plans and specifications to my office that conform to a Mn/DOT format. They will be reviewed and commented on by Mn/DOT functional groups. Please contact the Metro functional groups directly for specific questions relating to their area and copy the State Aid Project Manager on correspondence. We will provide the Municipal Agreement Program process information upon request. All Right -of -Way costs and acquisition, Utility Relocation as applicable and Preliminary Engineering are the responsibility of the local agency. An agreement will be written by Mn/DOT's Office of Technical Support and must be fully executed prior to award of the project. To receive the funds, this project must be let by June 30, 2010. After that date the money becomes unavailable to our office. Please reply in writing by March 20, 2009 if the City of Rosemount would like to accept this funding. The written confirmation should include acceptance of the conditions of Right -of -Way, Utility Relocation and Design along with the funding level proposed. The funding year and project letting schedule is addressed in bold: Option 1. City would do all work proposed from the north end of the RTL at 143rd to intersection of 145st. Mn /DOT would provide funding for the M &O portion in addition to the FY 2010 Municipal Agreement Program A rough estimate of the additional work is $250K which includes replacing a segment of the SB through lane adjacent to the proposed RTL ($50K). I had offerred $258,100 plus 8% for CE for $289,900 for the turn lane and signal reconstruct. All work within project limits is in one project and most efficient and least disruptive to motorists. Additional $50K Muncipal Agreement funds tentatively available for thru lane replacement. Municipal Agreement Program funds would remain in FY 2010 and Mn /DOT Preservation funds would remain in FY 2011. Letting date would have to be in early FY 2011(July /August 2010) since "debt management/future year payback" to the city is not an option. Option 2. Mn /DOT does all the roadway work in 2011 and City does the Signal work at 145th in FY 2010. This delays the SB RTL construction which may be an issue for the City. Signal Loops may need to be replaced twice unless an alternative is figured out. Funding transfers between the Municipal Agreement Program and Pavement Preservation for the turn lane and thru lane replacment is an internal Mn /DOT issue that could be addressed. Project letting date could be as early as July 2010 but that is Mn /DOT's discretion. Option 3. City does work as they originally proposed in FY 2010 and M &O happens in FY 2011. More project overlap and coordination issues with the TL and Signal work and may require replacing signal loops on north leg of intersection twice unless an alternative is figured out. Preliminary estimate of $50K for the SB through lane replacement adjacent to the proposed SB right turn lane. Municipal Agreement program could tentatively provide additional $50K for the thru lane replacement cost. All of the cost figures are preliminary at this point and subject to change, but do provide a good basis for discussion of the options. The SB through lane replacement could be dropped from all options as well if cost increases significantly or funding is not available. The "tentative" additional funding is based on current program commitments and that can change as time goes on. Further refinement of cost estimates and schedule discussions can take place once a preferred option is determined.
