APPROVED BY: A.1 RECOMMENDED ACTION: Staff recommends the City Council approve a Minor Amendment to the Harmony (Formerly Brockway) Area Planned Unit Development by making the following two motions. 1. Motion to adopt a resolution approving a minor amendment to the Harmony Area Planned Unit Development (PUD) Agreement allowing garage additions to the Hamilton, LaCrosse, Liberty Lodge, Revere Lodge, Woodward Lodge, and Wyatt Lodge homes. 2. Motion to authorize the Mayor and City Clerk to execute a minor amendment to the Harmony Area Planned Unit Development Agreement allowing garage additions to the Hamilton, LaCrosse, Liberty Lodge, Revere Lodge, Woodward Lodge, and Wyatt Lodge homes. 4 ROSEMOUNT City Council Meeting Date: March 18, 2008 SUMMARY Applicant Property Owner(s): Location: Area in Acres: Comp. Approximately 100 Acre UR Urban Residential R -1, Low Density Residential PUD The applicant, Rottlund Company, Inc., requests a minor amendment to the Harmony (formerly Brockway) Area Planned Unit Development (PUD). As proposed, the amendment would allow garage additions to the Hamilton, LaCrosse, Liberty Lodge, Revere Lodge, Woodward Lodge, and Wyatt Lodge homes. Rd. 38 Setback 40' 40' Lot Coverage 30 Percent 30 Percent Max. Garage Size 1,000 sq. ft. 1,000 sq. ft. The two stall garage versions of these homes are currently approved under the Harmony PUD. Rottlund Homes now wishes to market these same homes with either a 1/2 stall or full third stall garage addition. A copy of the amendment detailing the garage additions is attached for your review. ISSUE According to the PUD standards outlined in Section 11 -10 -6, minor amendments may be administratively approved where staff determines that review and approval by the Planning Commission and City Council of a detailed site and building plan is unnecessary to meet the objectives of the PUD ordinance. However, since this is an amendment to the PUD contract the City Council must formally approve the change. When making the determination between major and minor amendments, staff must find that the proposed amendment does not: 1. Substantially alter the location of buildings, parking areas or roads. 2. Increase or decrease the number of residential dwelling units by more than five percent (5 3. Increase the gross floor area of nonresidential buildings by more than five percent (5 or increase the gross floor area of any individual building by more than ten percent (10 4. Increase the number of stories of any building. 5. Decrease the amount of open space by more than five percent (5 or alter it in such a way as to change its original design or intended use. 6. Create noncompliance with any special condition attached to the approval of the master development plan. In this case, staff finds the proposed amendment eligible for a minor amendment because it does not violate any the six standards listed above. In addition, staff finds the proposed home plan consistent with those currently approved under the Harmony PUD. To include the '/z or full third stall garage addition plans in the approved set of homes for Harmony, the applicant must demonstrate that the proposed homes also meet the setback and lot coverage standards for this development. These standards are detailed in the table below. To demonstrate how the proposed homes will meet the standards outlined above, Rottlund submitted Lot /Building Fit plans for Harmony 2n 3` and 5t Additions. While these plans demonstrate some of the proposed homes will fit on many of the existing lots, they also show that at least one of the proposed homes will not fit on some of the lots in each Addition. As a result, it should be noted that nothing in this minor amendment should be interpreted a change to the current lot coverage or setback standards or to permit a home that does not conform to these standards. RECOMMENDATION Staff recommends the City Council approve a minor amendment to the Harmony Area Planned Unit Development (PUD). The proposed amendment would allow either a 1 /2 stall or full third stall garage additions to the Hamilton, LaCrosse, Liberty Lodge, Revere Lodge, Woodward Lodge, or Wyatt Lodge homes currently approved under the PUD. This recommendation is based on a review of the materials submitted by the applicant and the finding that the proposed home plans are consistent with those currently approved under the Harmony PUD. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2009 A RESOLUTION APPROVING A MINOR AMENDMENT TO THE HARMONY (FORMERLY BROCKWAY) AREA PLANNED UNIT DEVELOPMENT FOR ROTTLUND HOMES ALLOWING 1 /2 STALL OR FULL THIRD GARAGE STALL ADDITIONS TO THE HAMILTON, LACROSSE, LIBERTY LODGE, REVERE LODGE, WOODWARD LODGE, AND WYATT LODGE HOMES. WHEREAS, the Community Development Department of the City of Rosemount received an application from Rottlund Homes requesting a minor amendment to the Harmony (formerly Brockway) Area Planned Unit Development concerning property legally described as Harmony 2nd, 3 and 5th Additions, Dakota County, Minnesota; and WHEREAS, the amendment would allow' stall or full third garage stall additions to the Hamilton, LaCrosse, Liberty Lodge, Revere Lodge, Woodward Lodge, and Wyatt Lodge homes currently permitted under the PUD; and WHEREAS, staff finds the proposed amendment is eligible for a minor amendment and administrative approval because it does not violate any of the six criteria listed in Section 11 -10 -6 of the City Code related to determining major and minor PUD amendments, and WHEREAS, staff finds the six home products listed above are consistent with those currently approved under the Harmony PUD, and WHEREAS, on March 18, 2009, the City Council of the City of Rosemount reviewed the application and staff's recommendations. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves a minor amendment to the Harmony (formerly Brockway) Area Planned Unit Development for Rottlund Homes, subject to: 1. Except as modified by paragraph 1 of this Amendment, the Planned Unit Development Agreement shall remain in full force and effect. 3. The obligations and restrictions of this Amendment run with the land of the Subject Property and shall be enforceable against the Declarant, its successors and assigns, by the City of Rosemount acting through its City Council. This Amendment may be amended from time to time by a written amendment executed by the City and the owner or owners of the lot or lots to be affected by said amendment. In marketing the detached product, we have learned that our customers desire larger garages. As such, we have revised our elevations which would allow us to market an additional 1 /2 or full stall garage option for these homes. We feel that we have addressed your concerns of proportionality of the garage extension and roofline related to the overall front elevation. The extended garage portion is pushed back 2 feet from the overall elevation. This creates a break in the roofline as well as adds dimension to the revised elevation. As noted in the application, Rottlund understands and will adhere to the requirements of the PUD and Zoning Ordinance, specifically related to the setbacks and 30 percent lot coverage. Accompanying this submittal, please find the following: 1. Application for Minor PUD Amendment 2. Application fee of $900 3.
