City Council Meeting: January 20, 2009
EXECUTIVE SUMMARY
On December 16, 2008, the Rosemount City Council received the Feasibility Report for the 2009 Street
Improvement; Project. This project has been designated as City Project #426. Staff will provide a brief
presentation overview of the project and respond to questions that Council or the public may have
regarding the proposed improvements or assessments. A written summary of the proposed
improvements, estimated project cost, and proposed funding follows:
1. Proposed Improvements
The 2009 Street Improvement Project includes surface improvements to approximately 3,370 feet (0.64
miles) of 32 -foot wide urban streets identified in the 2007 -2010 Street Improvement Program at the
following locations:
Damask Avenue West (between Dodd Boulevard and Upper 150 Street West)
Upper 150 Street West (from Dallara Avenue to the west end)
Dallara Avenue West (from Dodd Boulevard to Upper 150 Street West)
Damask Court (30 feet wide)
Initially addressed in the 2007 -2010 Street Improvement Program Feasibility Report, City Project 410,
(received by Council February 6, 2007) the proposed surface improvements to the above streets include
full-depth roadway reconstruction including bituminous pavement, curb and gutter removal and
replacement, concrete driveway aprons, and roadway subgrade corrections.
Proposed utility improvements include replacement of both watermain and sanitary sewer. Additionally,
lateral water arLd sewer utility services would be replaced to the right -of -way for each property. The streets
included in the project currently do not contain storm sewer, the lack of which has contributed to the

advanced state of deterioration of the roadway surface as well as localized minor flooding and erosion
problems, and therefore the inclusion of lateral storm sewer is proposed throughout the project. Trunk
storm sewer improvements are also included, providing a proposed outlet for the landlocked Twin
Puddles pond which would provide flood protection to surrounding properties. The Twin Puddles pond
outlet is an identified capital improvement in the Comprehensive Surface Water Management Plan.
Raingardens, to be privately maintained by residents, may be included in the project as alternative
stormwater treatment measures if site conditions and public interest warrant. One such raingarden was
included in the 2007 Street Improvement Project on Biscayne Way.
The final section of the Feasibility Report identifies road segments comprised of approximately 1,060,000
square feet of roadway surface to be scheduled for seal coating in 2009. Regularly- scheduled crack sealing
and seal coating is performed as a part of the Pavement Management Program's goal of extending the life
of roadways. A seal coat of Shannon Parkway from 145t Street West to Connemara Trail is also detailed,
which would allow for the re- striping of that road segment to a 3 -lane section as previously discussed by
City Council.

In accordance with the City's Schedule of Rates and Fees for 2009, the per -unit assessment for total
reconstruction projects on streets with existing curb and gutter is $5,600. If the assessment is not prepaid
by July 31, 2009, the cost will be assessed over a 10 -year period with interest accruing on the assessment at
the rate of 6.5% or 2 points above the City's bond rate at the time the assessments are certified to the
County Auditor, whichever is less.

For the project, staff has again worked with Dakota County Development Agency (CDA) to consider
making Federal Community Development Block Grant Program (CDBG) funds available to qualifying
property owners to pay all or part of the assessments. As the available funds are limited, the CDA has
mailed the attached letter and survey to property owners to determine the anticipated number of qualifying
property owners. The number of qualifying property owners may affect the final individual amounts
available. This program is administered by CDA and all necessary application and CDA contact
information will be provided to property owners once the project gets underway. Staff is proposing not to
levy the assessments until July 31, 2009.
3. Public Informational Meeting
Prior to the public hearing, staff hosted a public informational meeting for property owners on Tuesday,
December 2, 2008 to address questions and comments regarding the project and proposed assessments. A
copy of the attendance sheet is attached. Public comments were recorded on the following topics:
Proposed improvements, construction techniques, and impacts.
Driveway access during construction.
Restoration and sod re- establishment of yard areas following construction.
Street assessment calculation based on Fee Resolution.
Construction scheduling and order of work.
Annual unit assessment increases.
Raingarden for one interested property owner
4. Schedule
It is proposed that construction begin in June 2009 and is anticipated to be completed, including all
restoration items, by the fall of 2009.
SUMMARY:
Staff is requesting that the City Council adopt the attached resolution ordering the project and authorizing
the preparation of plans and specifications for City Project #426, and adopt the attached resolution
adopting the assessments as presented.

WHEREAS, the City Council has received and accepted the Feasibility Report on December 16, 2008 for City
Project #426, and
WHEREAS, the City Council held a Public Hearing on January 20, 2009.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Rosemount hereby orders the
improvements of the 2009 Street Improvements Project, City Project #426.
BE IT FURTHER RESOLVED, that the City Council of the City of Rosemount orders the preparation of
plans and specifications for said improvements of City Project #426.

WHEREAS, pursuant to notice duly given as required by law, the City Council has met, heard and passed upon
all objections to the proposed assessment for 2009 Street Improvements Project, City Project #426, and has
amended such proposed assessment as it deems just.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Rosemount, Minnesota, as
follows:
(1) Such proposed assessment, in the amount of $420,000, a copy of which is in Clerk's File dated 1 -20 -09
is hereby accepted and shall constitute the special assessment against the lands named therein, and each
tract of land therein is hereby found to be benefited by the proposed improvement.
(2) Such assessments shall be as follows:
a. The assessments shall be payable in equal annual installments extending over a period of ten (10)
years, the first of said installments to be payable with general taxes for the year 2009, collectible with
such taxes during the year 2010.
b. To the first installment shall be added interest on the entire principal amount of the assessment from
July 31, 2009 until December 31 of the year in which such installment is payable. The interest rate shall
be set at either 6.5% per annum or 2 points above the City's bond rate at the time the assessments are
certified to the County Auditor, whichever is less. To each subsequent installment, when due there shall
be added interest for one year at said rate on the unpaid principal amount of the assessment.
c. The owner of any property so assessed may at any time prior to the certification of the assessment or
the first installment thereof to the County Auditor, pay the whole of the principal amount of the
assessment on such property with interest accrued to the date of payment to the City Treasurer, except
that no interest shall be charged if the entire assessment is paid by July 31, 2009; and such property
owner may at any time prior to November 15 of any year pay to the County Auditor the entire principal
amount of the assessment remaining due with interest accrued to December 31 of the year in which said
payment is made.
The City Clerk shall forthwith transmit a copy of this assessment roll to the County Auditor to be
extended on the tax list of the County.

Dear Property Owner:
Recently, you were contacted by the City of Rosemount regarding the Street Improvement
Project listed above. As part of that project, property owners will be assessed $5,600.
In the past, there has been financial assistance to help pay for project assessments for
property owners who were below a certain income level. The City is trying to determine
whether it will be possible to provide financial assistance to qualifying owners for the 2009
project. The ability to provide assistance will depend on obtaining future funding for the
program, which is provided through the federal Community Development Block Grant
(CDBG) Program
To help evaluate the number of residents who may qualify for an assistance program, you are
being asked to fill out the brief income survey enclosed with this letter and return the survey
in the postage paid envelope. Please note that this survey is a preliminary screening tool, and
should the program be available, actual eligibility will be determined based upon complete
income documentation as part of a future application process.
Please return the survey no later than Monday, January 26, 2009. If you have any

Information on annual family income is required to determine eligibility for certain programs
funded with federal Community Development Block Grant (CDBG) funds. Each survey
participant must indicate the number of persons residing in their home (household size) and
then CHECK THE BOX that contains the amount of annual household income.
INCOME is defined as the total annual gross income of all family and non family members 18+
years old living within the household. All sources of income must be counted from all persons in
the household based on anticipated income expected within the next 12 months.
Please check the income range based on your household (HH) size.
Example: If there are 5 people in your household and you anticipate gross income of $50,000, then you
will check the middle box of "$43,701- $66,400" within the "HH of 5" row.
