(o. r J ATTACHMENTS: 11 -25 -08 12 -23 -08 PC Minutes, Ordinance Amendment APPROVED BY: a RECOMMENDED ACTION: Motion to Approve An Ordinance Amendment Allowing Staff to Administratively Determine the Necessary Submittal Requirements for Land Use Applications. 4 ROSEMOUNT CITY COUNCIL City Council Meeting: January 20, 2009 EXECUTIVE SUMMARY SUMMARY This amendment was initiated by staff and would allow staff to administratively determine the number of copies required when submitting a land use application. The purpose of this amendment is to allow staff the flexibility to adjust the submittal requirements to the needs of the City Council and advisory boards as well as to help implement the City's greening policies. While this amendment empowers staff to periodically adjust the number of copies required when submitting a land use application, the City will continue to set a clear and consistent requirement for applicants based on the needs of the City Council, advisory boards and staff. PLANNING COMMISSION ACTION This item was reviewed by the Planning Commission during their November 25t and December 23, 2008 meetings. Minutes from those meetings are attached for your reference. During the November 25t meeting, staff presented this item for discussion and was directed by the Commission to proceed with the public hearing process. On December 23, 2008, the Commission formally reviewed the item and held a public hearing. After receiving no public comment, the Commission voted unanimously to recommend the City Council approve the proposed text amendment. ISSUE ANALYSIS The minimum number of copies required when submitting a land use application is specifically cited in the Zoning Ordinance and, as a result, is not changeable by staff. Consequently, there are often a number of copies which are submitted and go unused. Staff recommends removing this specific submittal requirement and allowing staff to administratively determine what materials are necessary. The practical impact of this change should be minimal; however, in reality it will allow staff to adjust the submittal requirements to the changing needs of individuals on the Council and various advisory boards as well as changing technology. Moreover, eliminating the requirement for applicants to submit plans that go unused is aligned with the City's greening goals. CONCLUSION RECOMMENDATION Staff recommends approval of the attached draft ordinance removing the specific submittal requirement for land use applications and allowing staff to administratively determine what materials are necessary. Zoning Ordinance Text Amendment Regarding Submittal Requirements for Land Use Applications (08- 45 -TA). Planner Lindahl reviewed the staff report. Staff recommends approval of the attached draft ordinance removing the specific submittal requirement for land use applications and allowing staff to administratively determine what materials are necessary. The practical impact of this change should be minimal; however, in reality it will allow staff to adjust the submittal requirements to the changing needs of individuals on the Council and various advisory boards as well as changing technology. Moreover, eliminating the requirement for applicants to submit plans that go unused is aligned with the City's greening goals. The public hearing was opened at 7:27p.m. There were no public comments. MOTION by Palda to close the Public Hearing. Second by Howell. Ayes: 5. Nays: None. Motion approved. The public hearing was closed at 7:28p.m. There was no discussion among the Commissioners. MOTION by Schultz to recommend the City Council approve the attached draft ordinance allowing staff to administratively determine the necessary submittal requirements for Land Use Applications. Second by Schwartz. Ayes: 5. Nays: None. Motion approved. As follow -up, Mr. Lindahl stated this item will go before City Council at their regular meeting on January 20, 2009. City of Rosemount Ordinance No. B- 199 AN ORDINANCE AMENDING THE CITY OF ROSEMOUNT ZONING ORDINANCE B RELATING TO SUBMITTAL REQUIREMENT FOR LAND USE APPLICATIONS THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA, ORDAINS that Ordinance B, adopted September 19, 1989, entitled "City of Rosemount Zoning Ordinance," is hereby amended as follows: Section 1. follows: Rosemount Zoning Ordinance B, Section 11- 10 -3.F is hereby amended as F. Submittal Requirements: Site plan applications shall be accompanied by twenty (20) full thzc copic3, one eleven inch by scvcntcc drawn at a common legible scale. The Community Development Director or their designee shall determine the number, size. type and scale of the copies required for submittal with an application. The scale used shall be no smaller than one inch equals fifty feet (1" 50') unless it is impractical to illustrate the entire site on a single sheet in which case a smaller scale may be acceptable. The maximum size of plans shall be thirty inches by forty inches (30" x 40 and the minimum size shall be eleven inches by seventeen inches (11" x 17 All site plan applications shall be based on a certificate of survey prepared by a licensed land surveyor and contain the information listed below, unless specifically waived by the city Community Development Director or their designee: 1. Existing conditions plan. 2. Site plan including information specified in subsection G of this section. 3. Architectural elevations, color drawings or renderings, and sample building materials of all principal and accessory buildings, identifying type and color of materials used on all exterior surfaces. 4. Typical floor plan and room plan drawn to scale with a summary of square footage for each use or activity. 5. Sign plan including, but not limited to, the type, location and size of all proposed signage. 6. Vicinity map showing the property in relation to nearby highways or major street intersections. 7. Any other information deemed necessary by the city to facilitate review. Section 2. EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its passage and publication according to law. ENACTED AND ORDAINED into an Ordinance this 20t day of January 2009.
