Motion to adopt an ordinance relating to the maintenance of the Rosemount Veterans' Memorial Walk and Veterans' Memorial Monument. 4 ROSEMOUNT CITY COUNCIL City Council Regular Meeting: August 18, 2009 EXECUTIVE SUMMARY ISSUE On August 3, 2009 the City Council held the first reading of a proposed ordinance that allowed for the City to erect, equip, maintain, supervise and control the Rosemount Veterans' Memorial Walk and the Veterans' Memorial Monument in Central Park as required by state statute. A copy of the concept plan for the Rosemount Veterans' Memorial Walk and a photo of the existing Veterans' Memorial Monument are attached to this executive summary. It was recommended that staff bring back the ordinance for a second reading and approval for publication. Since the first reading, there has been an addition made to the ordinance. Now included in the ordinance is the ability for the City to erect, equip, maintain, supervise and control the existing Veterans' Memorial Monument that is located in Central Park. The existing monument was built in 1999 at a cost of $21,000. Although the City does not currently maintain the monument, it was erected in a City park and there is a chance we could maintain it in the future; adding this to the ordinance allows us to meet the intent of the state statute. BACKGROUND At the July 15, 2009 City Council work session, a concept plan for a trail project honoring veterans was reviewed. The plan was developed by the Rosemount Veterans Memorial Walk (RVMW) group and includes a statue, signs, flags, engraved pavers, rest and reflection areas and monuments to be placed along the east side of the Flint Hills Trail (Koch Trail) in Central Park. The estimated cost for the project is $962,987. Staff also explained that the Minnesota state statutes require that the City must adopt an ordinance to allow for the construction and maintenance of a memorial project for veterans. Below is the statute regarding memorials for veterans. MINNESOTA STATUTES 2008 416.01 416.01 MEMORIALS FOR VETERANS. The governing body of any city of this state, however organized, may adopt an ordinance providing for the erection, equipment, and maintenance of a building or monument or parks in recognition of the services performed by soldiers, sailors, marines, and war veterans of the United States. The ordinance may also provide for the supervision and control of the building or monument or parks after its erection. The estimated cost, as determined by the governing body, of the monument or parks or building must be stated in the minutes of the meeting in which the ordinance is adopted and no sum shall be expended for the monument, park, or building in an amount more than ten percent in excess of the amount so stated in the minutes. The governing body of the city may acquire a site within the city upon which the monument or parks or building may be erected. History: (1933 -10) 1923 c 325 s 1; 1973 c 123 art 5 s 7; 2008 c 236 s 1 SUMMARY The City Attorney has prepared an ordinance for the City Council to review that would meet the requirement of the state statute relating to memorials for veterans. Staff is recommending that the City Council hold the second reading and adopt the Ordinance Relating to the Maintenance of the Rosemount Veterans' Memorial Walk and Veterans' Memorial Monument. ORDINANCE RELATING TO MAINTENANCE OF ROSEMOUNT VETERANS MEMORIAL WALK AND VETERANS MEMORIAL MONUMENT ADDING NEW SECTION 4 -3 -19 TO THE ROSEMOUNT CODE OF ORDINANCES THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA, ORDAINS as follows: Section 1. Rosemount City Code is amended by adding new Section 4 -3 -19 as follows: ATTEST: Clerk 4 -3 -19: VETERANS MEMORIAL: Pursuant to Minnesota Statutes, Section 416.01, the City Council is authorized to erect, equip, maintain, supervise and control the Veterans Memorial Monument and the Rosemount Veterans Memorial Walk Project in Central Park in recognition of the services performed by soldiers, sailors, marines and war veterans of the United States. Section 2. This ordinance shall be effective the day following its publication.
