Guide Plan Desig: Current Zoning: CITY COUNCIL EXECUTIVE SUMMARY U.S. Home Corporation Outlots A of the Evermore Glendalough 7 Addition Northeast of the Couchtown Avenue and Coachford Avenue Intersection 29.58 Acres TR, Transitional Residential R -1, Low Density Residential and Evermoor Planned Unit Development (PUD) The applicant, U.S. Homes, requests vacation of the drainage and utility easement over Outlot A of the Evermoor Glendalough 7` Addition plat. Vacation of this easement is necessary to complete the final plat approval for Glendalough 2 Addition creating seven new single family lots on two blocks located along an extension of Coachford Avenue. Staff recommends approval of this request. PREVIOUS ACTION The Planning Commission reviewed the Glendalough 2nd final plat during their regular meeting on July 28, 2009. By Ordinance, no public hearing is required for final plats and staff found the plat in compliance with the original preliminary plat. As a result, the Commission approved this item under the consent agenda. The City Council reviewed the Planning Commission's recommendation on August 18, 2009 and approved this final plat. ISSUE ANALYSIS By Statute, easement vacations require a public hearing and approval by the City Council. As a matter of course, the City places drainage and utility easements over all outlots. When these outlots are developed, the easement must be vacated to allow creation of the new final plat. In this case, the drainage and utility easement over Outlot A of the Evermoor Glendalough 7 Addition plat must be vacated to allow creation of the Glendalough 2n Addition final plat. Given the City Council has approved the Glendalough 2nd Addition final plat, staff recommends vacation of the drainage and utility easement over the associated Outlot A of Evemoor Glendalough 7 Addition. RECOMMENDATION Staff recommends conducting a public hearing and then adopting a resolution approving vacation of the drainage and utility easement over Outlot A of Evemoor Glendalough 7 Addition. 2 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2009- A RESOLUTION APPROVINGTHE VACATION OF THE DRAINAGE AND UTILITY EASEMENTS OVER OUTLOT A, EVERMOOR GLENDALOUGH 7TH ADDITION WHEREAS, the Community Development Department of the City of Rosemount received an application from U.S. Home Corporation requesting Final Plat concerning Outlot A, Evermoor Glendalough 7th Addition creating 7 new single family lots known as Glendalough 2nd Addition, legally described as: Lots 1 4, Block 1; and Lots 1 3, Block 2, Glendalough 2nd Addition, Dakota County, Minnesota. WHEREAS, on July 28, 2009, the Planning Commission of the City of Rosemount reviewed the Final Plat for Glendalough 2nd Addition; and WHEREAS, the Planning Commission adopted a motion to recommend that the City Council approve the Final Plat subject to conditions; and WHEREAS, on August 18, 2009, the City Council approved the Final Plat subject to conditions; and WHEREAS, the vacation of the existing drainage and utility easements of Outlot A, Evermoor Glendalough 7th Addition is required before the Final Plat can be recorded for Glendalough 2nd Addition; and WHEREAS, the City Council reviewed this request and conducted a public hearing on September 1, 2009. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Vacation of the Drainage and Utility Easements of Outlot A, Evermoor Glendalough 7th Addition, legally described as: A drainage and utility easement vacation over, under, and across all that part of Outlot A, Evermoor Glendalough 7th Addition, according to the recorded plat thereof, Dakota County, Minnesota; subject to: 1. The Vacation of the Drainage and Utility Easements of Outlot A, Evermoor Glendalough 7th Addition is effective only upon the recording of the Final Plat of Glendalough 2nd Addition. ADOPTED this 1st day of September, 2009, by the City Council of the City of Rosemount. William H.
