APPROVED BY: ow RECOMMENDED ACTION: Motion to allow CF Industries a waiver from the Building Standards for a 6,600 square foot metal vehicle and equipment storage building. 4 ROSEMOUNT CITY COUNCIL City Council Regular Meeting: October 6, 2009 EXECUTIVE SUMMARY BACKGROUND CF Industries (CFI) operates a fertilizer storage and transfer facility along the Mississippi River at 5300 Pine Bend Trail. To operate their facility, CFI has a number of vehicles and self powered equipment that are currently stored outdoors. CFI is proposing to construct a storage building to enclose the vehicles and equipment. DISCUSSION CFI has a number of vehicles and self powered equipment, including trucks, front -end loaders, manlifts, and the like, that are used to operate its fertilizer warehouse and transfer facility. Currently, these vehicles and equipment are stored outdoors and CFI is proposing to construct a cold storage building to store this equipment indoor overnight. This type of a request, to construct a new accessory building on an industrial property, normally does not require City Council review. The request to construct the building out of metal instead of a masonry building dictated by the zoning ordinance prompts City Council review and needs approval. CFI is zoned HI: Heavy Industrial and the HI zoning district requires that 100% of a building facing the public right -of -way must be masonry and 40% of the remaining facades must also be masonry. The HI zoning district allows the City Council to waiver these building material standards if the proposed building is far from the public right -of -way, is screened from view, and is made of similar materials as an existing and neighboring building. CF Industries is requesting a waiver from the building material standards of the HI district to allow the construction of a building with an exterior of entirely metal. The next section of the Executive Summary describes the conditions that need to be met for the City Council to grant the waiver request. Building Standards Waiver The HI: Heavy Industrial zoning district allows the City Council to waive the masonry building material standards provided the following six conditions are met. The conditions are described in italics and the planning staff interpretation in description in standard text. 1. The proposed building will be located in a remote location that does not abut a public right of way or a nonindustrial use or district. The proposed building is located more than 800 feet from Pine Bend Trail and is located behind existing buildings that will block the view of the proposed building from Pine Bend Trail. 2. The proposed building will be made of high quality long lasting material compatible with both adjacent properties and other buildings in the HI district. The proposed building is requested to be constructed of 29 gauge metal siding that has a 45 year manufacturer's warranty. The existing fertilizer storage buildings are constructed of a base of concrete loading walls, metal, fiberglass, or wood siding above the concrete loading walls, and asphalt shingled roofs. The maintenance building located in front of the proposed building is constructed of concrete block. 3. The provision of pedestrian faculties is unnecessary based on the use of the proposed building. The site is private and has security fences to prevent public access. Pedestrian facilities are unnecessary because the immensity of the site requires workers to travel between the buildings with motorized vehicles. 4. Parking, loading, and trash handling facilities are supplied by the surrounding site and do not abut a public right of way or a nonindustrial use or district. The proposed building is designed to house CF Industries' vehicles and equipment, such as front -end loaders, that are used throughout the facility. The building will not be visible from the public right -of- way as described in provision 1. 5. The applicant agrees to provide the required number and species of landscaping along the perimeter of the site. The applicant proposes to install 14 trees as required by the Section 11 -6 -3 B. of the Ordinance. Four trees will be planted in an opening to the north of the building and the remaining ten trees will be planted on Pine Bend Trail near the truck entrance to the facility. 6. The proposed building will not have separate ground or wall signage. No additional signage will be installed by the CF Industries as a result of the proposed building. THIS CONTRACT is made and entered into by and between Independent School District 196, a body corporate and politic existing under the laws of the State of Minnesota (hereinafter referred to as the "District and the City of Rosemount (hereinafter referred to as the "Contractor WHEREAS, the District desires to purchase ice time; and WHEREAS, the Contractor submitted a quote /proposal/bid in response to the District's request for quotes /proposals/bids; and WHEREAS, after careful consideration of the quote /proposal/bid submitted the Contractor, the Board of Education for the District by approval dated authorized the District to enter into a contract with Contractor for the provision and delivery of the said ice rental (the "Contract NOW, THEREFORE, in consideration of the premises and in further consideration of the mutual agreement contained herein, as well as the financial consideration hereinafter referred to, the parties hereto have contracted and agreed as follows: 1. The Contractor will deliver to the District the ice rental as specifically described in Attachment One, which is attached hereto and made a part hereof. 2. The District shall pay the Contractor for services satisfactorily performed or product satisfactorily delivered, if any, in the amount of $72,662.50, which shall be paid in two installments, one in December of 2009 and the second in April of 2010. 3. This Contract is the complete and exclusive statement of the terms agreed upon and shall supersede all prior negotiations, understandings or agreements. Any alterations, variations, modifications or waivers of the contract shall only be valid when they are agreed to in writing and signed by authorized representatives of the District and the Contractor. 4. Minnesota law shall be used to construe and interpret this Contract, without giving effect to the principles of conflict of laws. All proceedings related to this Contract shall be venued in the State of Minnesota. 5. All of the data created, collected, received, stored, used, maintained, or disseminated by the Contractor in the performance of the Contract is subject to the requirements of the Minnesota Government Data Practices Act, Minnesota Statutes, Chapter 13, the Family Educational Rights and Privacy Act (FERPA), 20 USC 1232g and rules and regulations promulgated under these laws. 289749v1 CLL RS215 -7 1
