EXECUTIVE SUMMARY
ISSUE
For the past sev eral months staff from the City and School District 196 have been discussing constructing
two new tennis courts at Charlie's Park. The property where the two courts currently exist is owned by ISD
#196 and is pant of the Rosemount Elementary School and Rosemount Middle School campus. The two
existing courts ire maintained and managed by the City.
The City's Atto rney has developed a long term easement that would last for 30 years and allow for the City
to access the scd.iool district property to build two new tennis courts. The attorney has also drafted a Joint
Operations and Use Agreement that identifies the details relating to the use and maintenance of the courts.
Staff is also continuing to work with the school district on a land swap that would have the district deeding
the land south of 144 Street to the City in exchange for the property that the City owns at the corner of
Hwy. 3 and 143` Street. This property most recently housed a single family home that was operated as a
daycare. Because the land swap is a somewhat complicated process, staff are continuing to work through the
details in hopes of bringing that item back to the City Council soon for review. Should the City and school
district not be able to work out a land swap agreement, the City would still have built two new courts and
have formed a IDng term partnership with the school district.
The funding for the project will come from the Parks Improvement Fund which received funds from park
dedication fees, grants and other donations. The estimated cost for the project is $90,000 and is included in
the 2009 CIP idget. Staff has also written a grant to the United States Tennis Association (USTA) for
assistance with :unding the project. The project, if approved, is expected to be built as soon as possible
allowing for use this fall.
SUMMARY
Staff is recommending that the City Council approve and authorize the execution of the Joint Use and
Operating Agreement and accept the temporary easement for the Charlie's Park tennis court project.
