APPROVED BY: DV) RECOMMENDED ACTION: Motion to approve the Off -Sale Intoxicating Liquor License for Supervalu Inc. d /b /a Cub Liquors for property located at 3792 150 Street West subject to approval from the Minnesota Department of Public Safety and receiving the Certificate of Occupancy from the Chief Building Official. ISSUE Supervalu Inc. "Supervalu d /b /a Cub Liquors has applied for a new off -sale intoxicating liquor license. Cub Liquors will be located in the former Mae's Hallmark location at 3792 150 Street West. Supervalu has submitted the application, fees and supporting documentation to process the request. BACKGROUND Supervalu has held an Off -Sale 3.2% Malt Liquor License since opening Cub Foods in August, 2001. The liquor sales have been located within the Cub Foods building at 3784 150 Street West. With the issuance of the requested off -sale intoxicating liquor license the sales will be moved to the 3972 150 Street West location. Per City Code no license shall be granted to a person who is directly or indirectly interested in any other establishment in the City to which a license has been issued. Therefore, the current off -sale license which expires June 30, 2009 will be relinquished with the opening of Cub Liquors. Supervalu has anticipated opening the new off -sale Memorial Day weekend. A background investigation was completed by the Police Department. Based upon the results of the background investigation, police staff found no reason to deny the liquor license. Since opening in August, 2001 Cub Foods has received one liquor violation for the sale to an underage individual. Supervalu applied for a building permit to complete the build out of the former Mae's Hallmark location. Supervalu will not be allowed to utilize the off -sale intoxicating liquor license or begin operations until they have obtained a Certificate of Occupancy from the Chief Building Official License approval from the Minnesota Department of Public Safety is also required. Current Off -Sale Liquor License holders in Rosemount have met with staff, the Mayor and City Council Members to express concerns about the apportionment of the off -sale intoxicating liquor licenses. Effective July 1, 2006 a limit on the number of off -sale intoxicating liquor licenses was removed. Prior to that date, off -sale intoxicating liquor licenses were issued dependent on the population of the City. One off -sale liquor license could be issued for each 6,500 of City population attained and was determined by the most recent metropolitan council population estimates. RECOMMENDATION Staff recommends approval of the Off -Sale Intoxicating Liquor License for Supervalu Inc. d /b /a Cub Liquors for property located at 3792150' Street West subject to approval from the Minnesota Department of Public Safety and receiving the Certificate of Occupancy from the Chief Building Official.
