Joint Cable Commission Representatives4 ROSEMOUNT CITY COUNCIL City Council Meeting: October 20, 2009 EXECUTIVE SUMMARY AGENDA ITEM: Joint Cable Commission Representatives PREPARED BY: Dwight Johnson, City Administrator ATTACHMENTS: September 7, 1999 Resolution and Proposed Resolution AGENDA SECTION: Consent AGENDA NO. 4, _r APPROVED BY: DID RECOMMENDED ACTION: Motion to Approve a Resolution Approving Representatives to the Joint Cable Advisory Commission ISSUE The Cable Commission is organized as a joint power agency to represent the Cities of Apple Valley, Farmington, and Rosemount. The Cable Commission serves as a cable and telecommunications advisory body for the administration of the cable communications system, the community television operations, and telecommunications activities and issues within the Cities. The issue before the City Council is the approval of a Resolution naming the City Representatives to the Joint Cable Commission. To the best of staff's knowledge, this resolution has not been updated or changed since September 7, 1999 and identifies former city employee names as representatives. Under the JPA Agreement: Section VI. 1. "Each Member shall be entitled to one (1) director which shall be the City Administrator or his /her designee to represent it to the Commission...." Section VI. 2: "The director shall be appointed by resolution of the Council of each Member..." Section VI. 3: "Each Member shall appoint at least one (1) alternate to the Commission..." The current City of Rosemount representatives on the Cable Commission are Emmy Foster as Director, and Alan Cox as Alternate Director. RECOMMENDATION Staff recommends that Assistant City Administrator Emmy Foster be appointed to the position of Director and that Communications Coordinator Alan Cox be appointed as Alternate Director to represent the City of Rosemount. hh CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 1999 -101 A RESOLUTION APPROVING A JOINT AND COOPERATIVE AGREEMENT ESTABLISHING A COMMISSION TO SERVE AS A CABLE AND TELECOMMUNICATIONS ADVISORY BODY FOR THE ADMINISTRATION OF THE CABLE COMMUNICATIONS SYSTEM, THE COMMUNITY TELEVISION OPERATIONS, AND TELECOMMUNICATIONS ACTIVITIES AND ISSUES WHEREAS, the Cities of Apple Valley, Farmington, and Rosemount (hereinafter "Cities have studied the possibility of jointly and cooperatively coordinating the administration of their individual cable communications franchises; and WHEREAS, the Cities desire to enter into a Joint and Cooperative Agreement creating a Commission to serve as a cable and telecommunications advisory body for the administration of the cable communications system, the community television operations, and telecommunications activities and issues within the Cities; and WHEREAS, the City of Rosemount (hereinafter "City") has determined it to be in the best interest of the City to enter into such a joint and cooperative agreement; NOW THEREFORE BE IT RESOLVED, by the City council of the City of Rosemount: 1. The City hereby adopts and enters into the attached Joint and Cooperative Agreement Establishing a Commission (hereinafter "Commission to serve as a cable and telecommunications advisory body for the administration of the cable communications system, the community television operations, and telecommunications activities and issues; 2. FURTHER, the City appoints as its director to the Commission City Administrator Thomas D. Burt; 3. FURTHER, the City appoints as its alternate director to the Commission Assistant to City Administrator /City Clerk Susan M. Walsh; 4. FURTHER, authorizes all necessary signatures to be affixed to such Joint and Cooperative Agreement on behalf of the City. ADOPTED this 7th day of September, 1999. ATTEST: Sus M. Edwards Voted against: None Member Not Present: 2 RESOLUTION APPROVING REPRESENTATIVES TO THE JOINT CABLE ADVISORY COMMISSION WHEREAS, the Cities of Apple Valley, Farmington, and Rosemount (hereinafter "Cities have established a Joint and Cooperative Cable and Telecommunications Advisory Commission; WHEREAS, each City appoints a Director and Alternate Director as Representatives on the Commission; WHEREAS, the City of Rosemount (hereinafter "City appointments have not been updated to reflect the current representation; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Rosemount, Dakota County, Minnesota, that: ATTEST: Amy Domeier, City Clerk CITY OF ROSEMOUNT RESOLUTION NO. 1. The City hereby appoints as its Director to the Commission Assistant City Administrator Emmy Foster; 3.
