ROSEMOUNT PROJECT IMPROVEMENTS CITY COUNCIL City Council Meeting: October 21, 2008 EXECUTIVE SUMMARY BACKGROUND: At the September 2, 2008 meeting the City Council declared costs and called for the Public Hearing to consider the assessments for the 2008 Street Improvements Project, City Project #418. The 2008 Street Improvements Project, City Project #418 included the rehabilitation of the following streets: Cornell Trail West 156 Street between Claret Avenue and Chippendale Avenue Cornell Trail between Claret Avenue and 156 Street Claret Avenue between 155 Street West and Cornell Trail Cicerone Path between Cornell Trail and 150 feet north of 158 Street West In addition to the street improvements, the project included the construction of new concrete sidewalk along the following streets: South side of 156 Street South side of Cornell Trail West and north side of Cicerone Path The sidewalk improvements were included with the street improvements project in accordance with the Trail and Sidewalk Plan adopted by the City Council November 15, 2005. All costs associated with the sidewalk improvements (concrete sidewalk, boulevard restoration, driveway replacement, landscaping restoration) were funded by the City's Pedestrian Facility Improvement fund and are not included in the assessment calculations. G: \ENGPROJ\ 418 \AdoptAssessmentCC10- 21- 08.doc Project Funding Street CIP Fund $444,870.00 Pedestrian Facility Improvement Fund $220,800.00 Assessments $240,530.00 Total $906,200.00 PROJECT COST Surface Improvements 685,400.00 Sidewalk Improvements 220,800.00 Total 906,200.00 PROJECT COST AND FUNDING The project costs and funding are summarized as follows: In accordance with the City's Fees and Rate Schedule for 2008, 35% of the project costs for surface improvements are proposed to be assessed to the adjacent benefiting properties. Based on this, the proposed per unit rates for multi- family and single family properties are $1,050 and $1,990 respectively. The attached Cost Distribution Calculations Worksheet summarizes the basis for the per unit assessment rates. The final proposed assessment rates are 36% lower than the original estimated assessment rates of $1,640 per multi- family unit and $3,140 per single family unit. The project funding is shown below: The project cost is proposed to be assessed over a 10 -year period at an interest rate of 5.70% (project bond rate plus 2 points). Attached for Council information are copies of all project communication and notices provided to property owners. In addition, regular weekly updates for the project were posted on the City's web page. Prior to the public hearing, staff hosted a public informational meeting for property owners on Tuesday, October 14, 2008 to address questions and comments regarding the project and proposed assessments. A copy of the sign -in sheet is attached. For the project, staff has worked with Dakota County Development Agency (CDA) to make Federal Community Development Block Grant Program (CDBG) funds available to qualifying property owners to pay all or part of the assessments. This program is administered by CDA and all necessary application and CDA contact information has been provided to property owners. Staff will provide an overview of the project and respond to questions that Council or the public may have regarding the proposed assessments. The proposed improvements are as follows: removal and replacement of bituminous pavement with subgrade corrections, installation of sidewalk along Cornell Trail and Cicerone Path, and spot curb repair as needed throughout the project. You are invited to attend an Informational Open House regarding the project on Tuesday, December 11, 2007 from 6:00 p.m. 7:00 p.m. in the Banquet Room at Rosemount Community Center, 13885 S. Robert Trail. City Staff and representatives from the City's consultant will be available to answer any questions or concerns you may have regarding the proposed improvements. At this time, anticipated property impacts, such as tree removal and driveway modification due to the proposed sidewalk construction have been determined. The amount of federal assistance for each eligible household will be dependent on the assessment amount, the household's income, and the amount of available federal funding. Median Income $80,900 (effective 2/13/08 for Dakota County) For the CDBG Program, the 80% limit (Low /Mod) is capped at the US area median income level. Re: 2008 Street Improvement Program Project Revised Project Schedule City Project #418 PUBLIC WORKS DEPARTMENT Sidewalk installation on the 2008 Street Improvement Project has been delayed due to unforeseen utility conflicts with both Charter Communications and Frontier Communications. These utility conflicts will require the private utility companies to relocate their lines outside or below the grading limits of the sidewalk and may require excavation in your yard within the City utility easement. Utility relocation on a reconstruction project is a common occurrence, but due to the high number of conflicts the contractor will wait until after the utility relocation has been completed to begin the sidewalk installation. The utility relocation is estimated to be completed by the beginning of September which will adjust the project completion date to the beginning of October. Utility relocations for this project are the financial responsibility of Charter Communications and Frontier Communications and will not impact the project cost or assessment amounts. The Dakota County Community Development Agency (CDA) administers the CDBG program and will determine your eligibility for abatement of your 2008 construction assessment. Interested homeowners can apply for the low and moderate income assessment abatement using the enclosed application forms. However, the City has elected not to establish any deferment procedure pursuant to those Sections. SPECIFIC AMOUNT TO BE ASSESSED: The amount to be specifically assessed against your particular lot, piece of parcel of land is shown on Exhibit A, which is on file with the City Clerk. PREPAYMENT: You may prepay the entire assessment to the Treasurer of the City until the assessment roll is certified to the County Auditor; after certification to the County Auditor, prepayments of the entire amount remaining due may be made to the County Auditor at any time. NO PARTIAL: The City Council has not authorized the partial prepayment of assessments prior to certification of the assessment or the first installment thereof to the County Auditor. PREPAYMENT WITHOUT INTEREST, OR WITH INTEREST TO END OF YEAR: No interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment roll. If the property owner pays the entire amount at any time after 30 days, but before any certification to the County Auditor, he or she needs to pay only the amount of interest accrued as of the date of payment. At any time after the certification, the property owner may still pay the entire amount remaining unpaid to the County Treasurer. In this case, however, prior to November 15 of any year the property owner must pay all interest, which would have accrued to December 31 of the year in which the person makes the payment. INTEREST RATE: If the assessment is not prepaid within 30 days from the adoption of the assessment roll, interest will accrue on the assessment at the rate of 5.70 Interest accrues from the date to be specified in the resolution levying the assessment, but not earlier than the date of such resolution. Assessments shall be payable in equal annual installments extending over a period of up to 10 years, the first of the installments to be payable with general taxes for the year 2008, collectible with such taxes during the year 2009. The applicant completes and returns the Assessment Abatement application to Mark Hanson at the Dakota County Community Development Agency (CDA). Applications must be received by the date specified in the letter from the City of Rosemount. 2. The application is then reviewed by the CDA. A letter is sent to the applicant requesting specific documentation for their income and assets. The letter informs the applicant of a deadline by which this information must be received. 3. When the CDA receives the requested documentation, the applicant's eligibility is determined. If the applicant qualifies as a Low Income household, the full payment of their assessment is guaranteed. If the applicant qualifies as a Moderate Income household, they may receive no assistance, partial assistance, or a full abatement of their assessment depending upon the amount of total funds available. If the applicant is over both the Iow and moderate income caps for their respective household size, they would not qualify for any assistance. The gross annual income caps are listed below. 4. The CDA sends a letter to the applicant informing them of their status. If the applicant has been approved, they are told that the results will be forwarded to the City of Rosemount. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Rosemount, Minnesota, as follows: (1) Such proposed assessment, in the amount of $240,530, a copy of which is in Clerk's File dated 10 -21 -08 is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein is hereby found to be benefited by the proposed improvement. (2) Such assessments shall be as follows: (3) a. The assessments shall be payable in equal annual installments extending over a period of ten (10) years, the first of said installments to be payable with general taxes for the year 2008, collectible with such taxes during the year 2009. b. To the first installment shall be added interest at the rate of 5.70% per annum on the entire principal amount of the assessment from the date of this resolution until December 31 of the year in which such installment is payable. To each subsequent installment, when due there shall be added interest for one year at said rate on the unpaid principal amount of the assessment. c. The owner of any property so assessed may at any time prior to the certification of the assessment or the first installment thereof to the County Auditor, pay the whole of the principal amount of the assessment on such property with interest accrued to the date of payment to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the date hereof; and such property owner may at any time prior to November 15 of any year pay to the County Auditor the entire principal amount of the assessment remaining due with interest accrued to December 31 of the year in which said payment is made.
