RECOMMENDED ACTION: Staff recommends the City Council approve a Minor
Amendment to the Rosewood Village Townhomes Planned Unit Development
agreement (also known as Rosewood Village 2nd Addition) allowing two (2) new home
products by making the following two motions:
1. Motion to adopt a resolution approving a Minor Amendment to the Rosewood
Village Townhomes Planned Unit Development agreement (also known as
Rosewood Village 2 Addition) allowing two (2) new housing products.
2. Motion to authorize the Mayor and City Clerk to execute a Minor Amendment to
the Rosewood Village Townhomes Planned Unit Development agreement (also
known as Rosewood Village 2 Addition) allowing two (2) new housing products.

The applicant, Keyland Homes, requests a minor amendment to the Rosewood Village Townhome
Planned Unit Development agreement (also know as Rosewood Village Second Addition). The
proposed amendment would allow two (2) new housing products to the list of permitted homes for
this neighborhood. The subject property is located south of 145` Street, north of Blueberry Court,
east of the railroad and Greif Brother Packaging, and west of Biscayne Avenue.
BACKGROUND
Rosewood Village Second Addition represents the detached townhome portion of the Rosewood
neighborhood. Of the 56 total detached townhome sites, 23 remain undeveloped. According to the
applicant, the request is necessary to respond to the shifting housing market, to offer more housing
choices to their costumers and to diversify the housing stock of this neighborhood.
In this case, the applicant proposed to add two new housing products to the list of approved homes
for this neighborhood. Those products include Plan 3911 and 3915, drawing for each are attached
for your reference.
According to the applicant, the 3911 unit is a 1,889 square foot two story home with a front porch
that opens to a large foyer and family room. The large peninsula kitchen has walk -in corner pantry
and opens to dining room family room. This home also has main floor laundry and mud room
off of the kitchen. A "U" shaped staircase leads to the upper level with 3 bedrooms 2 baths,
including the owners' suite with walk -in closet and private bath. The unfinished lower level provides
room for future expansion.
By comparison, the 3915 unit is a 2,044 square foot two story home with a large foyer and vaulted
family room. The kitchen has a large center island, walk -in pantry and opens to the dining room and
great room. The owner's suite has a walk -in closet and two optional super baths. Two more
bedrooms and laundry complete the upper level. Three car tandem garage and front porch are added
benefits to this model. The unfinished lower level provides room for future expansion.
ISSUE
According to the PUD standards outlined in Section 11 -10 -6, minor PUD amendments are
administratively approved by staff. However, given this is an amendment to a contract, the City
Council must formally approve the change.
Minor amendments may be administratively approved where staff determines that review and
approval by the Planning Commission and City Council of a detailed site and building plan is
unnecessary to meet the objectives of the PUD ordinance. When making this determination, staff
must find that the proposed amendment does not:
1. Substantially alter the location of buildings, parking areas or roads.
2. Increase or decrease the number of residential dwelling units by more than five percent (5
3. Increase the gross floor area of nonresidential buildings by more than five percent (5 or
increase the gross floor area of any individual building by more than ten percent (10

5. Decrease the amount of open space by more than five percent (5 or alter it in such a way as to
change its original design or intended use.
6. Create noncompliance with any special condition attached to the approval of the master
development plan.

In this case, staff finds the proposed amendment to add two (2) new housing products to the list of
permitted housing plans in the Rosewood Village Townhome PUD does not violate any of the criteria
listed above and therefore administratively approves this request.
RECOMMENDATION
Staff recommends the City Council execute a minor amendment to the Rosewood Village
Townhomes Planned Unit Development allowing two (2) new housing products, subject to
conditions. This recommendation is based on the finding that the proposed new housing products are
consistent with the terms and conditions of the original PUD and will serve to further diversify the
housing stock of this neighborhood.

A RESOLUTION APPROVING A MINOR AMENDMENT TO THE ROSEWOOD
VILLAGE TOWNHOMES PLANNED UNIT DEVELOPMENT AGREEMENT (ALSO
KNOWN AS ROSEWOOD VILLAGE 2 ADDITION) ALLOWING TWO (2) NEW
HOME PRODUCTS FOR KEYLAND HOMES
WHEREAS, the Community Development Department of the City of Rosemount received an
application from Keyland Homes requesting a Minor Amendment to Planned Unit Development
agreement for Rosewood Village Townhomes (also known as Rosewood Village 2nd Addition)
concerning the Subject Property, legally described on Exhibit A; and
WHEREAS, the amendment would allow two new home products to the Rosewood Village
Townhomes neighborhood; and
WHEREAS, the two new housing products are found acceptable under the original terms and
characteristic for homes in the Rosewood Village neighborhood as detailed in the Planned Unit
Development Agreement and
WHEREAS, minor amendments to a planned unit development may be administratively approved
by staff after review and approval by the City Council without a public hearing before the Planning
Commission; and
WHEREAS, on October 21, 2008, the City Council of the City of Rosemount reviewed the
application and staffs recommendations.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves a Minor Amendment to the Planned Unit Development agreement for Rosewood Village
Townhomes (also know as Rosewood Village 2nd Addition, subject to execution of the Minor
Amendment to the Planned Unit Development agreement.
ADOPTED this 21st day of October, 2008, by the City Council of the City of Rosemount.

PLANNED UNIT DEVELOPMENT AGREEMENT (ALSO KNOWN AS ROSEWOOD
VILLAGE 2ND ADDITION) ALLOWING TWO (2) NEW HOME PRODUCTS FOR
KEYLAND HOMES
THIS DECLARATION made this 21 day of October, 2008, by and between
KEYLAND HOMES, a (hereinafter referred to as
the "Declarant and the CITY OF ROSEMOUNT, a Minnesota municipal corporation
(hereinafter referred to as the "City
WHEREAS, Declarant is the owner of the real property described on Exhibit A, attached
hereto and made a part hereof (hereinafter referred to as the "Subject Properties and
WHEREAS, the Subject Property is subject to a Planned Unit Development Agreement,
Rosewood Village Townhomes, also known as Rosewood Village Second Addition, Progress
Land Company, dated December 6, 2004, and recorded with the Dakota County Recorder as
document number 228591 on January 18, 2005 (hereinafter referred to as the "Planned Unit
Development Agreement and
WHEREAS, Declarant wishes to amend the Planned Unit Development Agreement as
hereinafter provided, which amendment has been approved and consented to by the City of
Rosemount, acting through its City Council, as evidenced by the duly authorized signatures of its
officers affixed hereto.
NOW, THEREFORE, the Declarant declares that the Subject Property is, and shall be,
held, transferred, sold, conveyed and occupied subject to the covenants, conditions, and
restrictions, hereinafter set forth.
1. The use and development of the Subject Property shall conform to the Planned Unit
Development Agreement except as modified herein.
a. The list of permitted housing plans in paragraph 1 of the Planned Unit
Development Agreement is amended by adding the following:
1) Plan Number 3911, Elevation A, dated January 1, 2009, Exhibit B.

2) Plan Number 3915, Elevation A, dated January 1, 2008, Exhibit C
2. Except as modified by paragraph 1 of this Amendment, the Planned Unit Development
Agreement shall remain in full force and effect.
3. The obligations and restrictions of this Amendment run with the land of the Subject
Property and shall be enforceable against the Declarant, its successors and assigns, by the
City of Rosemount acting through its City Council. This Amendment may be amended
from time to time by a written amendment executed by the City and the owner or owners
of the lot or lots to be affected by said amendment.
