APPROVED BY: TAJ RECOMMENDED ACTION: Motion to approve the Resolution Authorizing the Dakota County Treasurer Auditor to Convey Tax Forfeited Parcel 34- 67429 020 -00 to the City for Public Use. -AND Motion to Authorize the Mayor to Sign Form 962: Application by a Governmental Subdivision for Conveyance of Tax Forfeited Lands for an Authorized Public Use. 4 ROSEMOUNT CITY COUNCIL City Council Regular Meeting: October 21, 2007 EXECUTIVE SUMMARY ISSUE The Dakota County Treasurer Auditor has informed the City of Rosemount that the Parcel with PID# 34- 67429- 020 -00 within the City of Rosemount has been forfeited to the State of Minnesota for non- payment of property taxes. As provided in Minnesota Statute 282.01, the City has the authority to approve the conveyance of tax forfeited property by one of three means: the auction of this property to the public, the auction of the property to the adjoining owner(s), or the conveyance to the City for public use. BACKGROUND The City has been notified that the State of Minnesota has acquired a parcel on the east side of Clover Lane and directly north and adjoining 14010 Clover Lane. The parcel information regarding this property is as follows: PID 34- 67429- 020 -00 Property Owner: State of Minnesota Location: East of the Clover Lane; Directly North of 14010 Clover Lane Legal Description: Shannon Hills 5t Addition Outlot B Area: 0.07 Acres Lot Width: 24 Feet Lot Depth: 135 Feet Comp. Guide Plan Designation: Urban Residential Current Zoning: R -1; Low Density Residential This tax forfeited parcel was created with the Shannon Hills 5t Addition subdivision in 1993. According to the Engineer's Memorandum from the time, Outlot B was created to provide access to Carroll's Woods park, but that the parcel has steep grades and was heavily wooded. It is unknown why this parcel was not transferred to the City by the developer at that tune, but it was recommended that the creation of the access to Carroll's Woods was delayed until the property to the north (which became a part of Evermoor) was developed to allow for easier grading to the park. Currently Outlot B is adjacent to public lands on three sides: Carroll's Woods to the east, a City trail to the north, and the public right -of -way for Clover Lane to the west. For this reason, staff recommends that the City acquire this tax forfeit property to expand the park land in the area and fulfill the original intent of Outlot B. SUMMARY Staff recommends approval of the resolution and authorizing the Mayor to sign Form 962 to convey the property to the City for park and recreation purposes. 2 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2008 A RESOLUTION TO AUTHORIZE THE DAKOTA COUNTY TREASURER AUDITOR TO CONVEY TAX FORFEITED PARCEL 34- 67429 020 -00 TO THE CITY FOR PUBLIC USE WHEREAS, the State of Minnesota has acquired the parcel with PID 34- 67429- 020 -00 through tax- forfeiture; and WHEREAS, the Dakota County Treasurer- Auditor has requested the City to determine the means of transfer in a letter dated October 3, 2008; and WHEREAS, Minnesota Statute 282.01 states that the City may request that the County Auditor to convey the property to the City for a public use; and WHEREAS, the parcel is located directly west of Carroll's Woods park and directly south of a City trail; and WHEREAS, the City has determined that best use of the property would be by the City for park and recreation purposes. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby authorizes the Dakota County Treasurer Auditor to convey tax forfeited parcel 34- 67429- 020 -00 to the City for public use. The parcels described in the listing forfeited to the State of Minnesota for non payment of property taxes during 2007. The one -year repurchase period has expired; and the DNR has approved the non- conservation classification. As required under M.S. 282.01, the County requests that you approve the parcel(s) for public auction or auction to adjacent owners or request a conveyance to your city for public use. We require a certified copy of the City Council Resolution authorizing any action taken. If you request that a parcel be conveyed to your city, you must also complete a Form 962, Application by a Governmental Subdivision for Conveyance of Tax Forfeited Land and mail the form to this office. Special assessments that were levied before the forfeiture do not need to be certified to this office. They were canceled at forfeiture and will be paid from the sale price. Special assessments that are levied after the forfeiture should be certified to this office. They will be added to the appraised value and paid from the sale price. Please be advised that if the City Council fails to respond within sixty (60) days of the date of this letter, the classification and sale will be deemed to be approved.
