ATTACHMENTS: Resolution APPROVED BY: W RECOMMENDED ACTION: Motion to approve a Resolution approving a special assessment for $5,747.12 that will be considered paid in full for the property at 34- 03000- 013 -75. 4 ROSEMOUNT CITY COUNCIL City Council Special Meeting: August 4, 2008 EXECUTIVE SUMMARY BACKGROUND In 1988, the property at 34- 03000- 013 -75 was specially assessed with the assessment deferred for 10 years. In late 2007, the property was sold and the title company contacted the City to determine if the assessment was paid. Based upon the Dakota County assessment records there was no assessment levied or deferred. However, the City did not have any record of the assessment being paid. DISCUSSION After much searching of City and County records, there is no indication that the assessment has been paid. Unfortunately, the County is unable to explain why the assessment "dropped off" their records. This is one of those instances when the County has indicated that the City should also be checking the special assessments to make sure the County records are correct. The City and the attorney for the initial property owner have discussed the special assessment and have come to a compromise on its payment. Staff has suggested payment of the principal while waiving the interest, consistent with the intent of the initial deferral. The situation is complex because of the lack of good records and staff believes this is a good compromise. The former property owner is agreeable to the recommendation which would result in payment of $5,747.12. The tide company is requesting that the City recognize the payment as paid in full for the assessment which leads to the request before the Council. The attached Resolution recognizes that payment of $5,747.12, the principal payment, would result in full payment of the assessment due for this particular property. RECOMMENDATION Motion to approve a Resolution approving receipt of a special assessment for 34- 03000 013 -75 in the amount of $5,747.12 to be considered paid in full. RESOLUTION APPROVING RECEIPT OF A SPECIAL ASSESSMENT FOR PROPERTY AT 34- 03000 013 -75 IN THE AMOUNT OF $5,747.12 WHEREAS, in 1988, the property located at 34- 03000- 013 -75 was specially assessed for an amount of $5,747.12 which assessment was deferred for ten years; and WHEREAS, Dakota County assessment records do not show any assessment being levied or deferred for said property and the City has no record of any such assessment being paid; and WHEREAS, the City and the initial property owner have come to an agreement that payment of only the principal of the assessment in the amount of $5,747.12 shall be paid, while the interest will be waived, consistent with the intent of the initial deferral. NOW THEREFORE, BE IT RESOLVED, the City Council hereby approves that payment of the principal only in the amount of $5,747.12 of the assessment on property at 34- 03000 013 -75 will constitute a payment in full of said assessment.
