ISSUE
There are Minnesota state statutes and rules that regulate the trapping of protected wildlife. However,
these statutes and rules do not prohibit trapping in developed areas; regulation is at the discretion of local
communities.
BACKGROUND INFORMATION
Earlier this year, a letter was received from a concerned citizen requesting that the City consider adopting
regulations on trapping. As the City has continued to develop, issues have regularly resulted from the
advancement of residential properties into the undeveloped agricultural or rural residential areas. In this
particular case, the issue is trapping which is primarily for fur bearing animals. However, trapping may
also be conducted to eradicate coyotes or other wildlife that may not be welcome by residents of urban
residential areas.
This issue is similar to the regulations of hunting and the use of bows and firearms within the City. As
development advanced, revisions were made to the City Code. Revisions were made that balanced the
desire of those persons interested in participating in hunting as a recreational sport and to control the
wildlife population through hunting seasons regulated by state laws with the safety of all residents.
RECOMMENDATION
The attached ordinance amendment incorporates trapping regulations into the existing City Code 7 5
Bows and Firearms. It is recommended that trapping be permitted in rural residential with lots of 2.5
acres or more and agricultural zoned areas. In order to protect persons who may live near the areas where
trapping is permitted, traps must be set off the property lines of the property unless there is a privacy
fence in place.

AN ORDINANCE RELATING TO BOWS AND FIREARMS;
AMENDING ROSEMOUNT CODE 7 -5
THE CITY COUNCIL OF THE CITY OF ROSEMOUNT MINNESOTA ORDAINS
AS FOLLOWS:
Section 1. City Code 7 -5, Title is a amended to:
BOWS, FIREARMS AND TRAPPING
Section 2. City Code 7 -5 -1, Definitions, is amended to include the following
additional definitions:
TRAPPING:
The act of setting or laying a trap used to catch, snare or kill an animal or
bird.
Section 3. City Code 7 -5 -6 is amended as follows:
TRAPPING PERMITTED IN DESIGNATED AREAS AND PROHIBITIONS:
A. Trapping is permitted on platted parcels of a minimum of 2.5 acres that are
zoned rural residential or agriculture. All trapping shall be conducted in
accordance with all applicable state laws and regulations. Trapping may
be conducted by owners, members of the owner's family or by written
consent of the owner of the platted parcel. Written consent shall be
carried on the person while trapping is being conducted on the property.
In addition, trapping on properties zoned as rural residential shall not be
done within 25 feet from any property line unless the property line is
bordered by a privacy fence and 50 feet of any city, county or state park
land; organized recreational area; or other public property.
B. Trapping is prohibited in all areas not listed in section 7 -5 -6 A above.
C. Exceptions: This section does not apply to:
Quick -kill trapping if the traps are designed and intended to kill rats,
mice, gophers or moles.
Live trapping of wild animals.
Any person duly appointed and designated through City Council
action for the purpose of wildlife management and control.
ADOPTED this day of 2008 by the City Council of the City of
Rosemount.
