Rosemount American Legion's On -Sale Club Liquor License and Special Sunda Liquor

ISSUE
An On -Sale Club Liquor License and Special Sunday Liquor License amendment request has been made
by the Rosemount American Legion (the "Legion to include an outdoor patio area located at 14590
Burma Avenue. It is possible under Minnesota law but the license holder must apply for an amendment to
their on -sale liquor license and the new area must describe exactly where alcohol will be consumed and /or
served. If the City approves an amended liquor license, it must be filed with the Minnesota Department of
Public Safety's Alcohol and Gambling division.
BACKGROUND
Due to the Freedom to Breath Act the Legion decided to accommodate customers by providing a
comfortable place to be allowed to smoke and enjoy an adult beverage. The Legion plans to add a partial
patio cover for protection from weather. The patio fence will match the existing area with shatter resistant
plexi -glass or Lexon® attached to the fence for wind protection. Another door will be added that to
allow direct access to the patio from inside the building. The entrance on the north side will be converted
into an enter only /exit only access with a vertical separation into the common areas. Patrons will only be
able to access the patio from the inside of the building.
SUMMARY
The Legion will be required to meet all the standards of Ordinance XVI.57 related to outdoor patios and
decks that was adopted on December 18, 2007. However, existing and ongoing construction will comply
with approved building permits. That means the fencing will not be consistent with the ordinance but it
was initiated prior to ordinance adoption. In addition, the Legion will need to obtain a Certificate of
Occupancy for the building permits required to build the patio roof structure, vestibule modifications and
the railing /fence.
Staff recommends approval of the amendment On -Sale Club Liquor License and Special Sunday Liquor
License for the Rosemount American Legion at 14590 Burma Avenue, Rosemount subject to conditions
as outlined in the draft resolution.

A RESOLUTION APPROVING AN AMENDMENT TO
THE ROSEMOUNT AMERICAN LEGION'S ON -SALE CLUB LIQUOR LICENSE AND
SPECIAL SUNDAY LIQUOR LICENSE
WHEREAS, the Rosemount American Legion submitted a request to have their On -Sale Club
Liquor License and Special Sunday Liquor License applications for the Rosemount American
Legion, 14590 Burma Avenue, Rosemount, amended to include the outdoor patio located on the
north side of the premises.
THEREFORE, BE IT RESOLVED, that the city Council hereby approves the amendment to
the license applications for On -Sale Club and Special Sunday Liquor Licenses subject to the
following conditions:
1) The applicant will be required to follow all regulations set forth in the City Code under
Title 3, Chapter 1 for the outdoor patio with the exception of fencing material because
the permit was applied for prior to the adoption of Ordinance XVI.57
2) The applicant must obtain a Certificate of Occupancy from the Chief Building Official
for the construction of the outdoor patio cover, fence installment and vestibule changes.
