RECOMMENDED ACTION: Motion to approve an agreement with the Dakota
Communications Center relating to the Criminal Justice Data Network and authorize the
Mayor of the City of Rosemount to execute the agreement.

ISSUE
Use of the National Crime Information Center Telecommunications system for access to the Criminal
Justice Data Network (CJDN) is important for the performance of police services. The CJDN has
regulations and rules in place to maintain the integrity of the system and agencies utilizing the system must
comply with the regulations and rules.

EXECUTIVE SUMMARY
BACKGROUND
CJDN access for many purposes utilized by the police department requires the Dakota Communications
Center (DCC) to perform some functions for 24 hour access for officers. An agreement is necessary to
formalize the responsibilities of both the DCC and the Rosemount Police Department related to CJDN.
The agreement presented for Council approval will allow the two entities to access CJDN in compliance
with the regulations and rules in place.
Prior to the opening of the DCC, an agreement was in place with the City of Eagan for this same purpose.
City Attorney LeFevere has reviewed the agreement.
AGREEMENT

Dakota Communications Center
and
Rosemount, Minnesota Police Departm ent
relating to
NATIONAL CRIME INFORMATION CENTER TELECOMMUNICATIONS
WHEREAS, the Dakota Communications Center has access to certain Criminal Justice
Data Network (CJDN) data bases including Wanted Persons, Missing Persons and Stolen
Property records, and;
WHEREAS, it is in the public interest for the Dakota Communications Center to perform
certain categories of CJDN telecommunication messages for the Rosemount Police
Department, and;
WHEREAS, it is required by National Crime Information Center (NCIC) rules and
regulations to enter into the following Agreement setting forth the responsibilities and rights
assumed by the parties to this agreement relating to the telecom munication of CJDN data.
NOW, THEREFORE, in consideration of the mutual covenants contained herein, the
parties herein agree as follows:
1. All CJDN communications on behalf of the Rosemount Police Department
utilizing the Dakota Communications Center ORI shall be relayed through the Dakota
Communications Center terminals within a reasonable time after requests therefore are
received from the Rosemount Police Department.
2. All NCIC communications entered into the CJDN by the Dakota Communications
Center on behalf of the Rosemount Police Department shall utilize the ORI for the Rosemount
Police Department and shall note the Dakota Communications Center's phone number in the
miscellaneous field of the entry for 24 hour contact information.
3. The Rosemount Police Department remains responsible for the accuracy of the
law enforcement data provided to the Dakota Communications Center and remains responsible
for modification and cancellation in a timely manner of all law enforcement messages which it
has introduced into the CJ DN through the Dakota Communications Center.
4. The Rosemount Police Department agrees to maintain all original law
enforcement records as required by NCIC regulations, and applicable data practices statutes,
rules, and regulations and rem ains responsible for completing all CJDN validation reports.
5. The Dakota Communications Center agrees to modify or cancel the messages
described in this agreement pursuant to the authority of the Rosemount Police Department
within a reasonable time after receipt of requests therefore from the Rosemount Police
Department.
6. The Dakota Communications Center's liability will be limited to the timely and
accurate transmission of the Rosemount Police Department's messages, records and data
described in this Agreement.
7. The Dakota Communications Center agrees to respond within 10 minutes to all
the requests for HIT Confirmation on records the Dakota Communications Center enters in the
CJDN for the Rosemount Police Department. The Dakota Communications Center's response
shall indicate a positive or negative confirmation, or a notice of the estimated amount of time
necessary to confirm or reject the record confirmation.
8. The entire Agreement of the parties is contained herein and this Agreement
supersedes all oral Agreements and negotiations had between the parties relating to the subject
matter hereof.
9. Any alterations, amendments, deletions, or waivers of the provisions of this
Agreement shall be valid only when reduced to writing and duly signed by the parties herein.
10. The term of the Agreement is from the date of the last signature hereto and shall
continue until terminated as provided herein.
11. This Agreement may be terminated by either party at any time with or without
cause, upon sixty (60) days written notice delivered to the address of the parties specified
above.
