RECOMMENDED ACTION: Motion to adopt a Resolution approving a one (1) yea
extension of the Preliminary Plat of Rosemount Hills 5 Addition.
ISSUE
On January 16, 2007, the City Council approved a two lot subdivision for Rosemount Hills 5 Addition.
The Subdivision Ordinance states that approved preliminary plats will expire after one (1) year unless the
applicant requests an extension from the City Council. John Tapper, the applicant, is requesting a six (6)
month extension of the preliminary plat approval.
BACKGROUND
Applicant and property owner: John Tapper
Location: Southern terminus of the Chinchilla Avenue Right -of -Way
(About a quarter mile south of McAndrews Rd W)
Area in Acres: 11.00 acres
Comp Plan Designation: Rural Residential
Zoning District: RR Rural Residential
Maximum Density: 1 Lot per 5 Gross Acres
Proposed Density: 1 Lot per 5.5 Gross Acres
Minimum Lot Size: 2.5 Acres
Proposed Lots Sizes: 5.05 and 5.95 Acres
The City Council approved this preliminary plat on January 16, 2007. The Subdivision Ordinance has a
provision that preliminary plat approvals lapse if a final plat is not requested within a one (1) year period
unless an extension request is granted. The purpose of this ordinance provision is to prevent long periods
of time before the final plat is recorded. One reason is because any ordinance revisions that have been
approved since the preliminary plat approval do not apply to the subdivision.
The only ordinance change that we have approved since January 2007 that would affect this plat is the tree
preservation ordinance revisions. The current Rosemount Hills 5 Addition approval requires the
replacement of 144 trees. It is likely that the new tree preservation ordinance would require a similar
number of replacement trees.
Mr. Tapper has requested a six (6) month extension to the preliminary plat approval for further
negotiations with his neighboring property owner for a 60 foot wide piece of land needed for access and
grading. Staff is recommending a one (1) year extension to accomplish these negotiations so that Mr.
Tapper would not need to request an extension again in six (6) months if the negotiations have not been
completed.
SUMMARY
Staff recommends approval of the one (1) year extension request for Rosemount Hills 5th Addition.

A RESOLUTION APPROVING A ONE (1) YEAR EXTENSION OF THE
PRELIMINARY PLAT OF ROSEMOUNT HILLS 5 ADDITION
WHEREAS, the Community Development Department of the City of Rosemount received a
request from John Tapper for an extension to the Rosemount Hills 5th Addition Preliminary Plat
approval; and
WHEREAS, on January 16, 2007, the City Council of the City of Rosemount approved the
Preliminary Plat; and
WHEREAS, Ordinance B, the Subdivision Regulations states that a Preliminary Plat approval
expires in one (1) year if a Final Plat is not applied for; and
WHEREAS, Ordinance B, the Subdivision Regulations allows the City Council to extend the
Preliminary Plat approval beyond the initial one (1) year period; and
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves a one (1) year extension Preliminary Plat of Rosemount Hills 5th Addition.
ADOPTED this 6th day of February, 2008 by the City Council of the City of Rosemount.
