RECOMMENDED ACTION: Motion to adopt a Resolution approving a four (4) year
extension of the Preliminary Plat of Rosemount Business Park 3rd Addition.
ISSUE
On July 17, 2007, the City Council approved a five lot subdivision for Rosemount Business Park 3`
Addition. The Subdivision Ordinance states that approved preliminary plats will expire after one (1) year
unless the applicant requests an extension from the City Council. Ryan Companies, the applicant, is
requesting a one (1) year extension of the preliminary plat approval.
BACKGROUND
Applicant: Ryan Companies US, Inc.
Property Owner: Pahl Family Limited Partnership
Property Location: Approximately '/a mile west of Biscayne Avenue, south of Boulder
Trail and east of Boulder Avenue
Size of Property: Approximately 55 Acres; 42 Acres owned by the Pahl family and 13
Acres owned by the City of Rosemount
Comprehensive Plan Designation: BP Business Park
Zoning: BP Business Park
Current Neighboring Land Uses: North Business Park
South Agriculture
East Pipeline Easement and Agriculture
West Undeveloped Business Park
Planned Neighboring Land Uses: North, South, East and West Business Park
Southwest Commercial
Southeast Water Treatment Plant
The City Council approved this preliminary plat on July 17, 2007. The Subdivision Ordinance has a
provision that preliminary plat approvals lapse if a final plat is not requested within a one (1) year period
unless an extension request is granted. The purpose of this ordinance provision is to prevent long periods
of time before the final plat is recorded. This works well for residential subdivisions in which builders
normally construct a model home or homes on speculation before a buyer is available, but commercial and
industrial projects do not normally operate in that same manner.
Every potential business has different needs for lot sizes, loading areas, street access, employee parking,
and customer parking that requires commercial developers to wait to develop to the specific needs of each
business. This can lead to long periods of time before construction activity occurs. Ryan Companies,
along with the City's community development staff, has been marketing Rosemount Business Park 3rd
Addition for the last year, but no companies have committed to construction yet. City staff believes it is
appropriate to grant an extension to Ryan Companies because of the continual marketing of the property
and the nature of commercial development.
Ryan Companies has requested a one (1) year extension to the preliminary plat approval. Staff is
recommending a four (4) year extension to allow Ryan sufficient time to market the property. One of the
lots that Ryan has platted has the capacity to accommodate an approximate 200,000 square foot building.
Lots of that size and users of building that size are rare and take time to find. Staff does not want the plat
approval to lapse in the short term to ensure we are ready to accommodate a user in a short amount of
time. Having to go through the preliminary plat approval process again would only add additional time to
the approval process which staff does not feel is necessary at this point.
SUMMARY
Staff recommends approval of the four (4) year extension request for Rosemount Business Park 3r
Addition.

The Rosemount City Council approved the preliminary plat application for the Rosemount Business Park
Third Addition on July 17, 2007 with Resolution No. 2007 -60. it is our understanding that this approval
is effective for one year unless an extension is granted. Based on current market conditions, Ryan
Companies US Inc. and the Pahl Family Limited Partnership have not proceeded with the fmal plat and
are requesting an extension of the July 17, 2007 approval until July 17, 2009.

RESOLUTION 2008
A RESOLUTION APPROVING A FOUR (4) YEAR EXTENSION OF THE
PRELIMINARY PLAT OF ROSEMOUNT BUSINESS PARK 3 ADDITION
WHEREAS, the Community Development Department of the City of Rosemount received a
request from Ryan Companies for an extension to the Rosemount Business Park 3rd Addition
Preliminary Plat approval; and
WHEREAS, on July 17, 2007, the City Council of the City of Rosemount approved the Preliminary
Plat; and
WHEREAS, Ordinance B, the Subdivision Regulations states that a Preliminary Plat approval
expires in one (1) year if a Final Plat is not applied for; and
WHEREAS, Ordinance B, the Subdivision Regulations allows the City Council to extend the
Preliminary Plat approval beyond the initial one (1) year period; and
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves a four (4) year extension Preliminary Plat of Rosemount Business Park 3 Addition.
ADOPTED this 1St day of July, 2008 by the City Council of the City of Rosemount.
