Contract for the 2008 Street Improvements Project, City Project #418
ISSUE:
Receive bids and award a contract for the 2008 Street Improvement Project.
BACKGROUND:
On Wednesday, May 28, 2008, bids were received for the 2008 Street Improvement Project and read aloud
publicly.
The project includes surface improvements to approximately 1.2 miles of 32 -foot wide urban streets
including Claret Avenue (between 155 Street West and Cornell Trail West, Cornell Trail (between Claret
Avenue and east end), 156 Street West (between Claret Avenue and Chippendale Avenue), and Cicerone
Path (from Cornell Trail West southwest approximately 720 feet).
After verification of bids received, the low bidder is McNamara Contracting, Inc. in the amount of
$802,503.23. Costs associated with the surface improvements excluding sidewalk improvements will be
funded by special assessments and street C.I.P. funds while sidewalk improvement costs will be funded by
the General Fund.
Bids received on Wednesday, May 28, 2008 were reviewed with Council at the June 3, 2008 City Council
Work Session to discuss potential solutions with the receipt of an unbalanced bid. Since that meeting,
Staff has drafted language to add to the contract regarding use of bid items at the Engineer's discretion.
The language has been reviewed by the City's legal counsel and agreed upon by the low bidder, McNamara
Contracting.
In anticipation of the award of contract, Staff has sent out project contact and schedule information to
affected residents and has also scheduled a preconstruction meeting with the contractor, tentatively
scheduled for May 20, 2008.
SUMMARY:
Staff recommends that Council adopt the attached resolution receiving the bids and awarding the contract
for the 2008 Street Improvement Project, City Project #418.

RESOLUTION 2008
A RESOLUTION RECEIVING BIDS AND AWARDING CONTRACT
FOR THE 2008 STREET IMPROVEMENT PROJECT
CITY PROJECT #418
BE IT RESOLVED, by the City Council of the City of Rosemount, Minnesota, as follows:
1. All bids on construction of the 2008 Street Improvement Project are hereby received and
tabulated.
2. The bid of McNamara Contracting in the amount of $802,503.23 for the construction of
said improvements is in accordance with the plans and specifications and advertisement for
bids, and is the lowest responsible bid and shall be and hereby is accepted.
3. The Mayor and Clerk are hereby authorized and directed to enter into a contract with said
bidder for the construction of said improvements for and on behalf of the City of
Rosemount.
4. The City Clerk is hereby authorized and directed to return forthwith to all bidders the
deposits made with their bids, except that the deposit of all successful bidder and the next
two lowest bidders shall be retained until a contract has been executed.

Bids were received for the above referenced project on Wednesday, May 28, 2008, and were
opened and read aloud. A total of four bids were received. The bids were checked for
mathematical accuracy and tabulated. The Engineer's Estimate was $936,479.50. Please find
enclosed the bid tabulation indicating the low bidder as McNamara Contracting, Inc.,
Rosemount, Minnesota, in the amount of $802,503.23.
We recommend that the City Council consider these bids and award a contract to McNamara
Contracting, Inc., based on the results of the bids received.
