CITY COUNCIL
City Council Meeting: June 17, 2008
AGENDA ITEM: Authorize Payment of Crop Impact
Compensation Akron Avenue Trunk AGENDA SECTION:
Utility Railroad Improvements, City Consent
Project #417
PREPARED BY: Andrew J. Brotzler, PE, City Engineer AGENDA NO. t In
I•
ATTACHMENTS: Easement Exhibits, Tables APPROVED BY:
RECOMMENDED ACTION: Motion to Authorize Payment for Impacts to Crop Areas along
Akron Avenue as Recommended within the Executive Summary.
BACKGROUND:
As part of the acquisition of easements for the Akron Trunk Utility and Railroad Improvements, City
Project #417, specific areas currently being farmed on the adjacent properties along Akron Avenue and
identified as both permanent and temporary construction easements will be impacted by construction
activities. To compensate for the temporary loss of farmable areas encompassed by the easement areas,
payment to the property owners leasing the farmable land is proposed consistent with past practices for
similar city projects in agricultural areas.
Attached are exhibits showing the location of the impacted crops along Akron Avenue on properties
identified as Parcel 1, 2 and Parcel 6. Staff has negotiated with Arcon Development, the property owner
for the Parcels 1 and 6, a total crop impact compensation in the amount of 6,369.01. Staff has
negotiated with Wayne Groth and Minnova Land, the property owners for the Parcel 2, a total crop
impact compensation in the amount of $24,720.66 plus reimbursement for professional fees incurred in
the amount of $1,886.00 for a total of $26,606.66. A breakdown of the compensation calculation for each
parcel is included on the attached table.
SUMMARY:
Staff is recommending that Council authorize the payment for crop impact compensation as proposed in
the attached table pending receipt of appropriate documentation.
