ATTACHMENTS: Planned Unit Development Agreement APPROVED BY: 4J RECOMMENDED ACTION: Motion to execute a Planned Unit Development Agreement with 146 Street Partners, LLC for the development of Town Centre. ISSUE Stonebridge Companies, through the limited liability corporation 146t Street Partners, LLC, has proposed a three story building on three- quarters of Core Block East that will contain 106 residential rental units and approximately 13,000 square feet of commercial space called Town Centre. On March 18, 2008, the City Council approved the preliminary plat, final plat, rezoning, and planned unit development for Town Centre. Before the City Council tonight is the planned unit development agreement to document and record the conditions of approval upon the property. RECOMMENDATION Staff recommends that the City Council execute the planned unit development agreement with 146 Street Partners, LLC for the development of Town Centre. DECLARATION OF COVENANTS AND RESTRICTIONS TOWN CENTRE PLANNED UNIT DEVELOPMENT AGREEMENT THIS DECLARATION made this day of April, 2008, by the 146th Street Partners, LLC, (hereinafter referred to as the "Declarant WHEREAS, Declarant is the owner of the real property as described as Lot 1, Block 1 and Lot 1, Block 2 of Town Centre, Dakota County, Minnesota (hereinafter referred to as the "Subject Property and WHEREAS, the Subject Property is subject to certain zoning and land use restrictions imposed by the City of Rosemount, Minnesota "City in connection with the approval of an application for a planned unit development for a three story building with 106 residential rental units and approximately 13,000 square feet of commercial space on the Subject Property; and WHEREAS, the City has approved such development on the basis of the determination by the City Council of the City that such development is acceptable only by reason of the details of the development proposed and the unique land use characteristics of the proposed use of the Subject Property; and that but for the details of the development proposed and the unique land use characteristics of such proposed use, the planned unit development would not have been approved; and 1 WHEREAS, as a condition of approval of the planned unit development, the City has required the execution and filing of this Declaration of Covenants, Conditions and Restrictions (hereinafter the "Declaration and WHEREAS, to secure the benefits and advantages of approval of such planned unit development, the Declarant desires to subject the Subject Property to the terms hereof. NOW, THEREFORE, the Declarant declares that the Subject Property is, and shall be, held, transferred, sold, conveyed and occupied subject to the covenants, conditions, and restrictions, hereinafter set forth. 1. The use and development of the Subject Property shall conform to the following documents, plans and drawings: a. City Resolution No. 2008 -29, Attachment One b. Final Plat, Attachment Two c. Cover Sheet/Site Plan Revised 03/11/2008, Attachment Three d. Preliminary Plat Revised 03/11/2008, Attachment Four e. Utility Plan Revised 03/11/2008, Attachment Five f. Grading Plan Revised 03/11/2008, Attachment Six g. Landscape Plan Revised 03/11/2008, Attachment Seven h. Architectural Site PIan Revised 03/11/2008, Attachment Eight i. Garage Floor Plan Revised 03/11/2008, Attachment Nine j. Exterior Elevations Revised 03/11/2008 (Sheets A500, A501, and A502), Attachment Ten k. Site Photometric Plan Revised 03/11/2008, Attachment Eleven 2 all of which attachments are copies of original documents on file with the City and are made a part hereof. 2. Development and maintenance of structures and uses on the Subject Property shall conform to the following standards and requirements: a. Maintenance and replacement of trees within the City right -of -way shall be the responsibility of the property owner. It is expected that the lifespan of the trees will be reduced due to the limited root zone caused by the tree's proximity to the building or placement within the sidewalk tree grates. The periodic replacement of the trees along an entire facade should be considered to maintain a cohesive and planned landscape appearance. b. Maintenance of the rain gardens and infiltration basins and associated stormwater infrastructure necessary for the long term operation and function will be performed by the property owner. c. The property owner shall be responsible for the additional cost of City maintenance for this development including, but not limited to, trucking snow from the site. These costs are for maintenance activities that are not preformed in other areas within the City. The breakdown of the expected costs from the additional maintenance will be description in the Subdivision Agreement for this project. 3. The Subject Property may only be developed and used in accordance with Paragraphs 1 and 2 of this Declaration unless the owner first secures approval by the City Council of an amendment to the planned unit development plan or a rezoning to a zoning classification that permits such other development and use. 3 4. In connection with the approval of development of the Subject Property, the following deviations from City Zoning or Subdivision Code provisions were approved: a. Section 11 -4 -11 G. 1. Building Design Standards: The amount of brick and stone used for the exterior material shall be at least equal to the amount shown in the Exterior Elevations (Attachment Eleven). b. Section 11 -4 -11 G. 3. b. and c. Exterior Lighting Standards: The exterior lighting fixtures within the Burma Avenue parking lot shall be similar to the green "acorn" style street lighting along South Robert Trail in downtown Rosemount. The light level at the property line of the Lower 147 Street parking lot will be in excess of 1.0 Lumens because the parking lots is intended for the redeveloped use of the three property to the west. c. Section 11 4 12 E. Multiple Family Dwelling Conditions: The street level residential dwelling shall be a minimum of 60 feet from the South Robert Trail right -of -way. There shall be a minimum of one (1) underground heated parking stall per residential unit and a minimum of one half (0.5) off street surface parking stall per residential unit. d. Section 12 B. Park Dedication: The fee -in -lieu of park dedication shall be in the amount of $120,000. In all other respects the use and development of the Subject Property shall conform to the requirements of the Paragraphs 1 and 2 of this Declaration and the City Code of Ordinances. 6. The obligations and restrictions of this Declaration run with the land of the Subject Property and shall be enforceable against the Declarant, its successors and assigns, by the City of Rosemount acting through its City Council. This Declaration may be amended from time to time by a written amendment executed by the City and the owner or owners of the lot or lots to be affected by said amendment. 4 IN WITNESS WHEREOF, the undersigned as duly authorized agents, officers or representatives of Declarant have hereunto set their hands and seals as of the day and year first above written. Notary Public THIS INSTRUMENT WAS DRAFTED BY: CITY OF ROSEMOUNT 2875 145 STREET WEST ROSEMOUNT, MN 55068 651- 423 -4411 5 A1TPG -1 M IT ONE- CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 2008- 29 A RESOLUTION APPROVING THE PLANNED UNIT DEVELOPMENT MASTER DEVELOPMENT PLAN WITH REZONING AND PLANNED UNIT DEVELOPMENT FINAL DEVELOPMENT PLAN FOR TOWN CENTRE WHEREAS, the Community Development Department of the City of Rosemount received an application from 146 Street Partners, LLC requesting a planned unit development master development plan with rezoning and planned unit development final development plan concerning property legally described as: Lots 4 -14, Block 3, ROSEMOUNT, and the north 33 feet of Maple Street adjoining said Lot 14; Lots 4 7, Block 4, ROSEMOUNT, and the west half of Vacated Hayes Avenue adjoining said Lots. WHEREAS, on February 26, 2008, the Planning Commission of the City of Rosemount held a public hearing and reviewed the requested application; and WHEREAS, on February 26, 2008, the Planning Commission recommended approval of the requested applications, subject to conditions; and WHEREAS, on March 18, 2008, the City Council of the City of Rosemount reviewed the Planning Commission's recommendations. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the planned unit development master development plan and planned unit development final development plan of Town Centre and the rezoning of the property from C2 Downtown Commercial and C3 Highway Commercial to C2 PUD Downtown Commercial Planned Unit Development, subject to: 1. Compliance with the City Engineer's Memorandum dated February 19, 2008. 2. Revise the design of the third story brick on the four columns on the Burma Facade to include the capital and corbel course of the brick on the other parts of the building. 3. The height of the existing sanitary sewer manhole shall be adjusted to correspond with the proposed grading plan. 4. The landscaping plan shall be revised to replace the four (4) white birch trees on the east side of Burma Avenue with a more appropriate boulevard tree species and to mix the shrubs and perennials together to add more diversity. 5. The property owner is responsible for maintaining the landscaping installed within the boulevard and right -of -way. Particular attention will need to be given to the trees within the sidewalks and close proximity of the buildings, which normally have shorter life spans than trees that roots systems can expand the full width of their crowns. Director ATTACHMENTS: Metropolitan Livable Communities Act APPROVED BY: Grant Agreement RECOMMENDED ACTION: Motion to approve Grant Agreement and authorize the Mayor and City Administrator to enter into the Agreement ISSUE Staff has received the grant agreement from the Metropolitan Council regarding the LCDA grant awarded in 2007. The City Attorney has reviewed the document and is comfortable with the verbiage. Exhibit A lists the funded items and the timeline initially given by the City for completion of the tasks. The Exhibit does reflect the staff requested change in dollar allocation from the on -site ponding system to the regional ponding system. Staff has asked the Metropolitan Council to shift $250,000 to the regional ponding expansion line item. CONCLUSION Approve the grant agreement and authorize the Mayor and City Administrator to enter into the agreement.
