RECOMMENDED ACTION: Staff recommends the City Council approve a Minor
Amendment to the Harmony (Formerly Brockway) Area Planned Unit Development by
making the following two motions.
1. Motion to adopt a resolution approving a Minor Amendment to the Harmony
Area Planned Unit Development (PUD) Agreement allowing substitution of the
Vantage Townhome for the Vista Townhome.
2. Motion to authorize the Mayor and City Clerk to execute an amendment to the
Harmony Area Planned Unit Development Agreement.

The applicant, Rottlund Company, Inc., requests a Minor Amendment to the Harmony (formerly
Brockway) Area Planned Unit Development (PUD). As proposed, the amendment would allow the
substitution of the new Vantage townhouse product for the originally approved Vista townhouse
product. This substitution would take place on the three remaining lots eligible for the Vista unit as
long as all three contain the same unit (i.e. 3 Vista or 3 Vantage units). A copy of the amendment
detailing the proposed substitution is attached for your review.
This amendment is eligible for a minor amendment because the new Vantage townhouse product is
considered consistent with the original Vista product and the intent of the Harmony Area PUD. The
applicant makes this request in response to the shifting housing market and to diversify the exterior
appearance of the neighborhood.
BACKGROUND
The Vista product is currently allowed in the Harmony Addition portion of the Harmony
neighborhood. The Harmony Addition is located south of 135`'' Street, north and west of Brass
Parkway and east of Brockway Avenue. This is the townhome section of the Harmony neighborhood.
While most of the units in this area are Vistas, the area also includes single loaded rowhouses.
The existing PUD allows the Vista product on Lots 3, 4 and 5 Block 1, Lots 1, 2, 3 and 4, Block 2 and
Lots 1, 2 and 3 Block 3. Of these lots, only Lots 1, 2 and 3, Block 3 are vacant and may contain the
new Vantage townhouse product. The remaining lots already are developed with the Vista product.
ISSUE
According to the PUD standards outlined in Section 11 -10 -6, minor amendments may be
administratively approved where staff determines that review and approval by the Planning
Commission and City Council of a detailed site and building plan is unnecessary to meet the objectives
of the PUD ordinance. Nevertheless, it should be noted that since this is an amendment to a contract
the City Council must formally approve the change. When making the determination between major
and minor amendments, staff must find that the proposed amendment does not:
1. Substantially alter the location of buildings, parking areas or roads.
2. Increase or decrease the number of residential dwelling units by more than five percent (5
3. Increase the gross floor area of nonresidential buildings by more than five percent (5 or
increase the gross floor area of any individual building by more than ten percent (10
4. Increase the number of stories of any building.
5. Decrease the amount of open space by more than five percent (5 or alter it in such a way as to
change its original design or intended use.
6. Create noncompliance with any special condition attached to the approval of the master
development plan.
In this case, staff finds the proposed amendment eligible for a minor amendment because it does not
violate any the six standards listed above. A more detailed comparison of the Vista and the Vantage
townhome products is provided in the table below.

The table above demonstrates the Vantage unit meets or exceeds the characteristics of the Vista unit.
The Vantage unit has the same number of units as well as the same minimum required setbacks. Staff
also finds the Vantage's footprint, height, unit size and outdoor recreational space are consistent with
those of the Vista unit. Most notably, the Vantage unit has longer driveways for off street parking and
enhanced exterior materials including increased use of both shakes and stone to diversify and improve
the building's appearance.
The Vantage unit will also have similar foundation landscaping to the Vista units. A copy of the
Vantage Foundation Planting Plan is attached for your reference. This plan illustrates the landscaping
to be installed around the perimeter of each building. Staff finds the number and type of landscape
materials both acceptable for the Vantage unit and similar to the plan for the Vista unit.
RECOMMENDATION
Staff recommends the City Council approve a minor amendment to the Harmony Area Planned Unit
Development (PUD). The proposed amendment would allow substitution of the new Vantage
townhome product for the Vista townhome product on any of the three remaining lots eligible for the
Vista unit as long as all three contain the same type of unit (i.e. 3 Vista or 3 Vantage units). This
recommendation is based on a review of the materials submitted by the applicant and the finding that
the Vantage unit meets or exceeds the characteristics of the Vista unit. Because the PUD agreement is
a contract between the developer and City, the Council must formally approve the PUD amendment.

A RESOLUTION APPROVING A MINOR AMENDMENT TO THE HARMONY
(FORMERLY BROCKWAY) AREA PLANNED UNIT DEVELOPMENT
FOR ROTTLUND HOMES
WHEREAS, the Community Development Department of the City of Rosemount received an
application from Rottlund Homes requesting a minor amendment to the Harmony (formerly
Brockway) Area Planned Unit Development concerning property legally described as Harmony
Addition, Dakota County, Minnesota; and
WHEREAS, the amendment would allow substitution of the Vantage Townhome product for the Vista
Townhome product currently permitted under the PUD; and
WHEREAS, staff finds the proposed amendment is eligible for a minor amendment and administrative
approval because it does not violate any of the six criteria listed in Section 11 -10 -6 of the City Code related
to determining major and minor PUD amendments, and
WHEREAS, staff finds the Vantage townhome product meets or exceeds the characteristics of the
Vista townhome product contained in the original PUD, and
WHEREAS, on February 19, 2008, the City Council of the City of Rosemount reviewed the
application and staff's recommendations.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves a minor amendment to the Harmony (formerly Brockway) Area Planned Unit
Development for Rottlund Homes, subject to conditions:
1. Execution of a PUD amendment agreement.

AMENDMENT TO THE HARMONY (FORMERLY BROCKWAY)
AREA PLANNED UNIT DEVELOPMENT
THIS DECLARATION made this 19 day of February, 2008, by and between
ROTTLUND COMPANY, INC., (hereinafter referred to as the "Declarant and the CITY OF
ROSEMOUNT, a Minnesota municipal corporation (hereinafter referred to as the "City
WHEREAS, Declarant is the owner of the real property described as Lots 1, 2, and 3,
Block 3, Harmony Addition, Dakota County, Minnesota, (hereinafter referred to as the "Subject
Properties and
WHEREAS, the Subject Property is subject to a Planned Unit Development Agreement,
"Brockway Area Planned Unit Development Agreement" dated September 2, 2004, and
recorded with the Dakota County Recorder as document number on
(hereinafter referred to as the "Planned Unit Development Agreement and
WHEREAS, Declarant wishes to amend the Planned Unit Development Agreement as
hereinafter provided, which amendment has been approved and consented to by the City of
Rosemount, acting through its City Council, as evidenced by the duly authorized signatures of its
officers affixed hereto.
NOW, THEREFORE, the Declarant declares that the Subject Property is, and shall be,
held, transferred, sold, conveyed and occupied subject to the covenants, conditions, and
restrictions, hereinafter set forth.
1. The use and development of the Subject Property shall conform to the Planned Unit
Development Agreement except as modified herein.
A. The permitted housing plans listed in paragraph 1.c of the Planned Unit
Development Agreement is amended as follows:
Add the Vantage Townhomes 10 Unit Building Attachment Two.

2. Except as modified by paragraph 1 of this Amendment, the Planned Unit Development
Agreement shall remain in full force and effect.
3. The obligations and restrictions of this Amendment run with the land of the Subject
Property and shall be enforceable against the Declarant, its successors and assigns, by the
City of Rosemount acting through its City Council. This Amendment may be amended
from time to time by a written amendment executed by the City and the owner or owners
of the lot or lots to be affected by said amendment.

Re: Harmony Minor PUD Amendment
Dear Jason:
Rottlund Homes is please to submit the attached application and supporting materials for a minor
PUD amendment for 3 lots in Harmony Addition. We are excited about introducing a new product
called the Vantage Home on Lots 1 through 3, Block 3, Harmony Addition. These are a variation of
the approved Vista unit.
In response to the current market conditions, the Vantage increases variety within Harmony, thus
increasing the buyer pool with the goal to increase the pace of sales. We are proposing 30
Vantage Units on the 3 lots that were approved for 30 Vista Units. The Vantages are geared
toward first time homebuyers that are singles or couples typically without children. The Vantage
Home is a 2 -level product with a tuck under 2-car garage. Each unit offers an open main level
containing the kitchen, living and dining rooms with the upper level containing 2 bedrooms and a
loft area. The finished square footage of the end unit is approximately 1456 and 1442 for the
interior unit.
In working with staff over the past month, we feel that we have addressed concems related to
architecture. The combination of varied roof lines, building elements, materials and colors work
together to create a visually interesting building. Additionally, each unit has an approximately
10'x10' outdoor patio area. The exteriors will include siding, shakes and stone wrapped around the
base of the building. The color pallet will include contrasting colors within the different elements,
which down play the building size. We are proposing to use color packages similar to those
accompanying this application.
These buildings will be part of the current Harmony East condominium association, which is
responsible for building exteriors and grounds maintenance.
The proposed revisions comply with the required setbacks as set forth in the PUD Amendment.
