ISSUE
For the past few years, the City of Rosemount has allowed Rosemount High School (RHS) to use 44
dedicated parking stalls in the Rosemount Community Center /Arena parking lot. A Memorandum of
Understanding has been agreed to in past years that identifies the responsibilities of both parties. It is
staffs opinion that the representatives from Rosemount High School responsible for the monitoring of
the lot have done a good job and the City has not had any issues with the students parking in the lot.
Because the area being looked at for use by MVTA is the same area that Rosemount High School students
have used for parking, staff is proposing to have the high school students now park in the Schwarz Pond
Park parking lot.
Attached is an updated Memorandum of Understanding that allows for RHS to use 40 stalls in the
Schwarz Pond Park parking lot. The reason for the decrease in stalls from 44 to 40 is because of the how
the lot is proposed to be striped. In the RCC lot, the first two rows equaled 44 stalls and in the Schwarz
Pond Park lot the first two rows would be 40 stalls.
SUMMARY
Staff is recommending the City Council approve the attached Memorandum of Understanding with
Rosemount High School regarding the use of a portion of the parking lot at Schwarz Pond Park and to
authorize the City Administrator to execute the MOU.
MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF ROSEMOUNT and ROSEMOUNT HIGH SCHOOL
This Memorandum of Understanding (MOU) between the City of Rosemount (the City) and Rosemount
Senior High School (the School) outlines the details involved with the City allowing the School to use a
portion of the Schwarz Pond Park parking lot as overflow parking for students from the School.
The City grants a revocable permit to the School to use 40 parking spaces in the Schwarz Pond Park parking
lot subject to the terms outlined in this MOU. The City will have priority use of the parking stalls and will
provide no less than two (2) business days notice to RHS when scheduled events at Schwarz Pond Park are
anticipated to require sufficient parking that parking stalls will not be available for School use. RHS will
include language in the permit for these spaces that specifically states permit- holders may from time -to -time,
be required to make alternative arrangements for parking. The City will have no obligation for alternative
parking accommodations in these circumstances.
Persistent and /or unresolved issues related but not limited to parking, traffic, student behavior, trash /debris,
negative impact on Schwarz Pond Park operations, or other public nuisances will be cause for termination of
the parking privileges by the City with no financial recourse by RHS or obligation by the City to provide
alternative accommodations. The City will attempt to resolve such issues before termination. However, the City
reserves the right to revoke the permit granted by this MOU at any time and for any reason.
Rosemount High School Shall:
1. Sell Schwarz Pond Park spaces only after the RHS main lot has been sold out.
2. Sell parking at the rate of $10.00 per trimester; fees will be deposited in district general funds.
3. Issue Schwarz Pond Park distinguishable parking permits to be attached to the rearview mirror.
4. Require students to complete a parking form which includes make /model /color /plate number of vehicle,
name and address, as well as a signature acknowledging a thorough understanding of all parking policies
including the policy of vehicular searches by school administrators.
5. Place, as conveniently as possible, suitably sized trash receptacles.
6. On a daily basis, make a minimum of two inspections of the Schwarz Pond Park lot. The inspections will
be conducted by RHS staff and will identify compliance with parking regulations, vandalism, trash, and so
forth.
7. Administer appropriate disciplinary consequences for students who violate school policy or law, contact
local law enforcement, as necessary, for violations of law, dispatch the ground maintenance staff to
remove trash.
8. Work with City officials to hold accountable students who park beyond the designated parking area with
or without official permits.
9. Include the Schwarz Pond Park student designated parking area when the RHS student parking lot is
inspected by controlled detection canines.
City of Rosemount Shall:
1. Provide 40 parking spaces in the south portion of the Schwarz Pond Park parking lot.
2. Paint the designated parking area in a color which is immediately identifiable by students and significantly
different from the non student designated area (blue painted area).
3. Be responsible for any signage, snow removal, general maintenance, and so forth.
4. Contact Rosemount High School with any concerns regarding student behavior.
