EXECUTIVE SUMMARY
ISSUE
On August 19 and September 2, 2008, the City Council conducted a public hearing vacating the north half
of Maple Street adjoining Lot 14, Block 3. During those meetings, Lot 14, Block 3 was identified as being
a part of Auditor's Subdivision No. 1 and a copy of the plat was shown displaying Lot 14, Block 3. Upon
review of the resolution by the County Surveyor, they identified that Lot 14, Block 3 was not a part of
Auditor's Subdivision No. 1, but a previously recorded Town of Rosemount plat recorded in 1867.
The County Surveyor noticed the error because auditor's subdivisions do not have block numbers, only lot
numbers. Since the original resolution was simply a clerical error and does not describe any actual
property, a new public hearing is not needed. Passing this resolution will replace the previous resolution
with this corrected legal description.
RECOMMENDATION
Staff recommends the adoption of the resolution to vacate the north 33 feet of Maple Street.

RESOLUTION 2008-
A RESOLUTION APPROVING THE VACATION OF THE
NORTH 33 FEET OF MAPLE STREET ADJOINING
LOT 14, BLOCK 3 OF THE TOWN OF ROSEMOUNT
WHEREAS, the City of Rosemount received a request for Preliminary Plat and Final Plat approval
from 146th Street Partners, LLC concerning property legally described as:
Lots 4 14, Block 3, Town of Rosemount, and the north 33 feet of Maple Street adjoining
said Lot 14; Lots 4 7, Block 4, Town of Rosemount, and the west half of Vacated Hayes
Avenue adjoining said Lots.
WHEREAS, on February 26, 2008, the Planning Commission of the City of Rosemount held a
public hearing and reviewed the Preliminary Plat and Final Plat for Town Centre; and
WHEREAS, on February 26, 2008, the Planning Commission recommended approval of the
Preliminary Plat and Final Plat; and
WHEREAS, on March 18, 2008, the City Council of the City of Rosemount approved of the
Preliminary Plat and Final Plat; and
WHEREAS, the north 33 feet of Maple Street as shown on the Town of Rosemount has no use to
the City of Rosemount as public right -of -way; and
WHEREAS, on August 19 and September 2, 2008, the City Council held a public hearing and
reviewed the vacation request; and
WHEREAS, on September 2, 2008, the City Council adopted Resolution 2008 -71 which contains a
clerical error in its legal description; and
WHEREAS, this Resolution corrects the legal description and supersedes Resolution 2008 -71.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby
approves the vacation of a portion of Maple Street legally described as:
The north 33 feet of Maple Street adjoining Lot 14, Block 3 of the Town of Rosemount.
ADOPTED this 16th day of September, 2008, by the City Council of the City of Rosemount.
