Urban Land Institute and Regional Council of Mayors Housing Initiative AgreementAGENDA ITEM: Urban Land Institute and Regional Council of Mayors Housing Initiative Agreement AGENDA SECTION: Consent PREPARED BY: Eric Zweber; Senior Planner AGENDA NO. b e ATTACHMENTS: Housing Initiative Agreement; Process Timeline APPROVED BY: 0 RECOMMENDED ACTION: Motion to authorize the Mayor to sign the Urban Land Institute and Regional Council of Mayors Housing Initiative Agreement. 4 ROSEMOUNT CITY COUNCIL City Council Regular Meeting: September 16, 2008 EXECUTIVE SUMMARY ISSUE The Urban Land Institute Minnesota (ULI) and the Regional Council of Mayors (RCM) have cooperatively created the Housing Initiative Opportunity City Pilot Program to provide assistance to communities in identifying and implementing best management practices that support a full range of housing choices. Earlier this year, the City had applied and was accepted to be one of the five pilot cities for this program. The other four cities selected are: Brooklyn Park, Minnetonka, Richfield, and Shoreview. The housing initiative will include professional assistance from Bennett Community Consulting, Excensus, LLC, and ULI staff to conduct an audit of the City's existing housing stock and produce demographic trends showing the changing housing needs. To help pay the costs of this professional assistance, the housing initiative agreement includes a local match of $5,000. Staff attended the first housing initiative meeting on Thursday, September 4 in which the five communities discussed the housing programs in which they each participate. In December, City staff will meet with the ULI staff and consultants to review their analysis and discuss recommendations for Rosemount. In February 2009, all five communities will meet to review the draft ULI report and discuss common recommendations. The final ULI report is expected in May 2009. RECOMMENDATION Staff recommends that the City Council authorize the Mayor to sign the ULI -RCM Housing Initiative Agreement. ULI Minnesota HOUSING INITIATIVE OPPORTUNITY CITY PILOT PROGRAM AGREEMENT THIS AGREEMENT is made and entered into this day of September, 2008, by and between THE URBAN LAND INSTITUTE OF MINNESOTA "ULI MN and THE CITY OF ROSEMOUNT "CITY RECITALS Regional o nrilofMayors A. The Urban Land Institute's mission is to provide leadership in the responsible use of land and in creating and sustaining thriving communities worldwide. B. The Regional Council of Mayors (RCM), supported by ULI Minnesota, provides a non partisan platform that strategically engages mayors and land use professionals to support a more connected, more sustainable and more prosperous region. C. The RCM Housing Initiative Opportunity City Pilot Program builds on the collaborative relationships among RCM and ULI professionals to identify and implement best practices that support a full range of housing choices for economic stability and regional prosperity with funding support provided by the Family Housing Fund. D. A team of ULI MN professionals, with a representative from the Family Housing Fund, selected THE CITY OF ROSEMOUNT to participate in the Opportunity City Pilot Program and in working together will identify and implement tools and strategies to support a full range of housing choices. The approach will serve as a model for other cities and be brought to scale at the regional level. AGREEMENT NOW, THEREFORE, in consideration of the mutual terms hereof, the ULI MN and the CITY agree that the Opportunity City Pilot Program Agreement shall be as follows: ULI MN will provide the following to the CITY based upon the attached letter of need for assistance, work plan and timeline. Bennett Community Consulting will complete housing audits that evaluate current housing goals, strategies and demographic trends, identify gaps, review sites for future housing growth and redevelopment activities, and recommend modifications, additions and strategies for creating housing choices. Excensus, LLC will produce a community change report for the CITY that will include demographic trends, household relocation patterns, housing accessibility and utilization, access to jobs and access to transit. A team of ULI professionals to provide one site specific analysis through the Technical Assistance Panel. The CITY will provide the following to ULI MN in support of the Opportunity City Pilot Program and in exchange for the services provided above. Funding match in the amount of $5,000 provided to ULI MN with the signature of the agreement. CITY staff support to assist the ULI MN staff and contractors in collecting information available to the CITY, coordinating City meetings and providing guidance for the completion of services outlined above. Consideration by policy leaders to work towards establishing the recommended tools and strategies (ie: changes and modifications to official controls) in support a full range of housing choices provided to the CITY as a result of the Opportunity City Pilot Program. Except as amended, the Agreement is and shall remain in full force and effect in accordance with its terms. Minnesota Statute section 473.864 also allows the Metropolitan (Met) Council to grant extensions to the deadline. Realizing that many communities will not complete their Comprehensive Plan deadlines by December 31, the Met Council has allowed administrative extensions of the submittal deadline to May 29, 2009 provided that the local governmental unit provide a resolution and completed extension request form. Attached to this executive summary is the resolution and request form. The City Council has authorized the release of the Comprehensive Plan for the required six month public review period on April 19, 2008. The anticipated remaining review and approval process for the Comprehensive Plan is: February 19, 2009 March 24, 2009 April 21, 2009 RECOMMENDATION Staff recommends the adoption of the resolution requesting the extension of the Comprehensive Plan deadline until May 29, 2009. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2008- A RESOLUTION REQUESTING ADDITIONAL TIME WITHIN WHICH TO COMPLETE COMPREHENSIVE PLAN "DECENNIAL" REVIEW OBLIGATIONS WHEREAS, Minnesota Statutes section 473.864 requires local governmental units to review and, if necessary, amend their entire comprehensive plans and their fiscal devices and official controls at least once every ten years to ensure comprehensive plans conform with metropolitan system plans and ensure fiscal devices and official controls do not conflict with comprehensive plans or permit activities that conflict with metropolitan system plans; and WHEREAS, Minnesota Statutes sections 473.858 and 473.864 require local governmental units to complete their "decennial" reviews by December 31, 2008; and WHEREAS, Minnesota Statutes section 473.864 authorizes the Metropolitan Council to grant extensions to local governmental units to allow local governmental units additional time within which to complete the "decennial" review and amendments; and WHEREAS, any extensions granted by the Metropolitan Council must include a timetable and plan for completing the review and amendment; and WHEREAS, the City will not be able to complete its "decennial" review by December 31, 2008, for the following reasons: the UMore planning process, extensive public participation, and revisions to the Transportation Plan; and WHEREAS, the City Council finds it is appropriate to request from the Metropolitan Council an extension so the City can have additional time to complete and submit to the Metropolitan Council for review an updated comprehensive plan and amend its fiscal devices and official controls. NOW, THERFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ROSEMOUNT, MINNESOTA, AS FOLLOWS: 1. The City Administrator is directed to submit to the Metropolitan Council no later than November 1, 2008, an application requesting an extension to May 29, 2009. 2. The City Administrator must include with the request a reasonably detailed timetable and plan for completing: (a) the review and amendment by May 29, 2009; and (b) the review and amendment of the City's fiscal devices and official controls. A number of issues have resulted in the City of Rosemount needing to delay the submittal of the approved Comprehensive Plan beyond the December 31, 2008 deadline. Initially, the City delayed the initiation of the Comprehensive Plan process to allow the University of Minnesota to master plan their UMore Park property within Rosemount and Empire Township. When it became apparent that the University was not going to be able to complete their process in time to meet the December 31, 2008 deadline, the City began its Comprehensive Plan process in April 2007. The process included six public open houses and numerous Planning Commission, Utility Commission, Parks and Recreation Committee, and City Council Meetings. City staff met with Metropolitan Council staff Patrick Boylan and Victoria Dupre on May 15, 2007 to discuss the UMore planning process and potential delays to the submittal of the Comprehensive Plan. City staff stated during that meeting that it was expected that the City would release the Comprehensive Plan for the six month review before the end of 2008, but that the City would not be able to submit the completed and approved Comprehensive Plan by December 31,2008. During the review of the draft Comprehensive Plan in April 2008, the City Council had concerns about the transit component of the Transportation Plan. Staff revisions of the Transportation Plan were presented to the City Council in July 2008. The City has maintained the timeline discussed with Metropolitan Council staff and the Comprehensive Plan has been released to the neighborhood communities for their review on August 19, 2008. With the six month review being completed in February 2009, it is anticipated that the Planning Commission will review the Comprehensive Plan and conduct a public hearing at their March 24, 2009 meeting and that the City Council will review and approve the Comprehensive Plan on April 23, 2009. This anticipated timeline will result in the submittal of the Comprehensive Plan before the extension of review deadline of May 29, 2009.
