ISSUE
The City Code requires that each property owner of an Individual Sewage Treatment. System
(ISTS) must receive a maintenance permit from the city every 3 years. In order to receive a
permit, a property owner must have a Licensed pumper or inspector submit a sewage system
maintenance log sheet to the City. If the owner has not renewed the ISTS maintenance
permit within 30 days of expiration of the permit, a late renewal fee of $25 shall be paid
before a permit can be issued. Further, failure to renew the permit can be charged as a
misdemeanor.
DISCUSSION
The City's ISTS code has been in effect since 1997. Local regulations are consistent with
Dakota County requirements and the PCA requirements for ISTS systems. Previous
enforcement has involved sending letters to property owners who have not had a pumper
forward appropriate documentation. In most cases property owners have been compliant with
the ordinance reporting criteria. There are 73 properties that have not had any pumping
activity reported to the city in quite some time, certainly beyond the 3 year renewal time
period.
Staff has sent out a letter to 12 property owners where no recent pumping information is
available. The letter is attached for the Council's information. We have given them 30 days to
comply with the ordinance requirements. The letters have been sent both by regular and
certified mail. These letters were sent after repeated attempts to gain compliance, involving at
least three previous letters from the City. As stated in the letter, and called out in the City
Code, failure to provide the pertinent pumping information will lead to legal action.
Staff wanted the Council to be aware that we are taking a firmer stance on code enforcement
of ISTS systems. The vast majority of property owners are complying with the ordinance
criteria. However, several have never verified their system is compliant with prescribed

Rosemount City Ordinance Section 9.6 requires a maintenance program for Individual Sewage
Treatment Systems within the City of Rosemount. The program is intended to extend the useful
life of your septic system, protect the quality of groundwater aquifers and limit the expansion of
city sewer.
City Ordinance Section 9.6 requires that a maintenance inspection be completed on each
individual sewage treatment system in Rosemount every three years. As of this <<PumpDue»
date, our office has not received notification of a maintenance inspection on your property.
Rosemount City Ordinance 9 -6 -9c states:
ISTS Maintenance: Upon successful completion of ISTS maintenance per MPCA 7080, the
licensed pumper /inspector shall submit a sewage system maintenance log record to the city of
Rosemount within thirty (30) days. The log record must be completed in its entirety and all
information recorded must be verified in writing by the signature and date of the licensed
pumper /inspector completing the maintenance. The log record must also state the condition of
and work done on the following:
1. The sewage or septic tank(s) has been thoroughly pumped by a licensed pumper
to remove all solids and scum in accordance with the requirements of Minnesota
Rules chapter 7080.
Exception: Pumping is not required if a licensed pumper or licensed private inspector
determines that accumulated sludge and scum levels do not exceed the levels required for
pumping per Minnesota Rules chapter 7080.
2. An ISTS evaluation is completed by the licensed pumper /inspector verifying that
the baffles and tank(s) are in working order and in substantial compliance with
Minnesota Rues chapter 7080 and if there is any evidence of ISTS surface
discharge or failure.
Please contact a licensed contractor to schedule the required maintenance inspection/pumping
and have the maintenance log recorded at the City of Rosemount, Building Inspections Division
within 30 days or by November 24, 2004. Failure to respond will prompt legal action.
Upon completion and verification of the required maintenance, you will receive a letter
confirming the status of your septic system. That letter will serve as your permit acknowledging
compliance with the ordinance.
