Minutes of May 10, 2004 Work Session46 ROSEMOUNT CITY PROCEEDINGS CITY COUNCIL WORK SESSION MAY 10, 2004 Pursuant to due call and notice I thereof the City Council Work Session was held on Monday, May 10, 2004 at 6:30 p.m. in the Council Chambers at City Hall. Mayor Droste and Council Members DeBettignies, and Riley were present. Council Members Shoe- Corrigan and Strayton were absent. Also in attendance were City Administrator Verbrugge, Assistant Administrator Weitzel, Community Development Director Lindquist, City Engineer Brotzler, and Communications Coordinator Cox. DISCUSSIONS Railroad Crossings City Engineer Brotzler started the discussion regarding the new Federal legislation which allows for the establishment of Quiet Zones but indicated it would be expensive to develop. Quiet Zones prohibit trains from blowing their horns. Staff requested direction from Council regarding the development of these zones. Chuck Rickart, from WSB, was present to recap the process and costs involved in establishing Quiet Zones. Mr. - Rickart stated the Federal regulation for the development of Quiet Zones will go into -effect December 19, 2004. If Cities want to establish Quiet Zones they are required to meet certain requirements. The criteria include:' the Quiet Zone would be one -half mile in length at a minimum, lights and gates are required at crossing, and supplemental safety measures to meet the Risk Index. The projected costs to meet the minimum requirements would exceed 1.2 million dollars. It was the consensus of the Council not to spend the money on a study but to stay informed regarding future development of Quiet Zones. New crossings may be required to meet the new standards. 42/52 Comprehensive Planning Study Community Director Lindquist requested direction from the Council regarding the preferred method to conduct a 42/52 corridor land use study. The urgency for the study is based on the numerous inquiries regarding business park land. It was the consensus of the group to form a committee composed of Commission members, property owners, and a representative from Flint Hills. The committee size was limited to six or seven members. Council Member DeBettiginies volunteered to head the committee. Annexation Overview Community Development Director Lindquist stated that the consultants representing property owners near the southern boundary of Rosemount have approached staff about the possibility for annexation into Rosemount. Director Lindquist reviewed the process for annexation. The land must adjoin the corporate limits of the annexing city. The annexation must be in the best interest of the city and the territory being annexed. The land may not already be part of another city. Annexation would prompt an upgrade to the sanitary sewer capacity. ROSEMOUNT CITY PROCEEDINGS CITY COUNCIL WORK SESSION MAY 10, 2004 Discussion continued regarding the potential for development on the site and concluded that development would not be immediate because of mining on the property. Further discussion revealed concern for the responsibility to provide sewer services to this area. City Engineer Brotzler indicated that the Met Council is currently conducting a study to see if an interceptor pipe can be installed to carry local waste to the Empire treatment plant. This study should be completed by June, 2004. It was the consensus of the Council to wait until this study is complete before taking any further steps regarding the annexation of any land. Staff was directed to gather preliminary background information and bring this item back for discussion in July, after the Met Council sewer study is completed. UPDATES Council Member DeBettignies informed the members that KSTP'is conducting speed studies on residential streets. Information regarding the speed studies was available on the station's web site. Director Lindquist updated the Council Members regarding dumpster enclosures for businesses. -There are approximately -five businesses that - - have not complied with the requirements -for dumpster` enclosures. In order to not lose ground for the enforcement work that has ` been " previously completed, City Council directed staff to start to notify non- downtown businesses regarding the requirements for dumpster` enclosures and to wait a couple of months until the downtown redevelopment plan is in place to continue enforcement in the downtown area. Director Lindquist informed the Council that a permit for the sign currently installed at the Rosemount Mall has never been obtained. Staff has expressed concern because the new sign used the footings from the old sign, which could potentially create liability issues for the City. In order to obtain a permit, engineered drawings are required to be submitted with the permit application. Staff has had numerous conversations- with the property owner and the sign company but has not been able to obtain cooperation in fulfilling the requirements for permitting. A letter demanding action was sent to the property owner. If a response to resolve this issue is not received, it was the intent of staff to require them to remove the sign. Mayor Droste would like members to inform City Clerk Jentink which civic events they will be attending to ensure we have adequate representation. Ms. Jentink will maintain a listing of events and attendees. City Administrator indicated the new goals for the City will be presented for adoption at the first Regular Council Meeting scheduled in June, 2004.
