SUMMARY
This item was pulled from the Dec. 16 Council Agenda because of questions regarding Agricultural lot
standards and density. All lots will be required to conform to AG lot dimension standards (min. lot size is 2.5
acres). Presently lot 3 is slightly under the ordinance area requirement.
The ordinance also requires a 1 unit per 40 -acre density in the agricultural district. Density standards can be
maintained if Flint Hills is willing to record a deed restriction on other property they own prohibiting additional
residential units. Staff recommends that the deed restriction be recorded against adjacent property (the former
Sell farm which has enough acreage). Putting a deed restriction on property not contiguous to the subject parcel
but owned by Flint Hills is inconsistent with the spirit and intent of the zoning ordinance density requirement.
The restriction is for the present agricultural zoning, if the property is rezoned, then the density requirement is
moot and the deed restriction would no longer be necessary. Staff has discussed the above recommendations
with Flint Hills. Flint Hills would prefer to record the deed restriction on other property, but understands the
basis for the recommendation.
What makes this application different from previous Agricultural District subdivisions is that the property being
subdivided is not a farm. The original 13 acre site had 8 homes constructed in the 1950's as employee housing.
Therefore, any deed restriction would have to be applied to adjacent property that was not originally part of the
subdivision. Since Flint Hills owns the adjoining land, it is reasonable to request conformity with ordinance
criteria. Mr. Kern also suggested that if Flint Hills does not accept the condition, more houses might be removed -
to satisfy the requirement. However, it should be recognized that the proposed action does bring the property
more into conformance than the current condition by reducing the number of homes on the site and providing
separate legal lots for each of the structures.
One final issue that came up during the Council discussion related to the present septic systems for the
individual lots and the ability to provide a secondary system should the need arise. The draft resolution of
approval requires that the plat conform to the Dakota County ISTS standards, which would necessitate the need
for designating a secondary system site. This information is typically required prior to release of the plat for
recording so that staff can confirm compliance.
PLANNING COMMISSION ACTION
The Commissioners had no concerns relative to the Blaine Court Plat. One commissioner shared some
experiences regarding wells in the area. Subsequently, a motion to recommend approval was adopted.
DAKOTA COUNTY PLAT COMMISSION
This plat is subject to review by the Dakota County Plat Commission because of its frontage on County Road
71. Upon initial review, the Plat Commission had concerns about access locations along the County Road. Staff
discussed alternatives with the applicant and the Plat Commission. The resulting plat revision consolidates
access between lots 3 & 4 with an easement that aligns with the Church driveway (on the west side of Blaine
Ave.). The easement goes across the plat for future access potential to the vacant land to the east. This revision
prompted the Plat Commission to approve the plat, granting a variance to County street spacing standards. No
variances to City standards were created by the revision.
RECOMMENDATION
The attached resolution has been expanded to include a condition requiring the deed restriction for Agricultural
District density.
RECOMMENDED ACTION:
Motion to adopt a resolution approving the Flint Hills Estates plat subject to conditions.

A RESOLUTION APPROVING THE
FLINT HILLS ESTATES SIMPLE PLAT
WITH CONDITIONS
WHEREAS, on August 25, 2003, the Planning Department of the City of Rosemount received a
plat application from Flint Hills Resources called Flint Hills Estates legally described as follows:
The West 330.00 feet of the Southwest / of the Northwest t /4 AND the West 330.00 feet of the
South 455.00 feet of the North % of the Northwest' /4 of Section 25 Township 115 Range 19,
Dakota County, Minnesota.
WHEREAS, on September 23, 2003, the Planning Commission of the City of Rosemount
reviewed the plat and received a recommended conditions of approval in accordance with the
City of Rosemount Subdivision Ordinance and the Agricultural lot standards of the City of
Rosemount Zoning Ordinance, and,
WHEREAS, the Planning Commission adopted a motion to recommend that the City Council
approve the Flint Hills Estates plat with conditions.
NOW, THEREFORE, BE IT RESOLVED, that the Council of the City of Rosemount hereby
approves the Flint Hills Estates plat subject to:
1. Approval of the shared access between lots 3 and 4 with a street easement by the
Dakota County Plat Commission.
2. Approval of the Dakota County Plat Commission in accordance with the Contiguous
Plat Ordinance.
3. Removal of the existing driveways to existing buildings A,,C, D, F, and G and from
the northern edge of Lot 3 to the existing cul -de -sac on Lot 4.
4. Submission of information to ensure conformance with the Individual Sewer
Treatment System Standards ordinance per Dakota County and Pollution Control
Agency (MPCA) Standards prior to release of the plat for recording.
5. Dedication of all necessary easements required by the City Engineer including, but
limited to, a shared access and driveway easement for Lots 1 and 2.
6. Payment of all applicable development fees as specified in the current fee schedule
including three units of Park Dedication.
7. Remove buildings A, C, D, F and G prior to recording this plat with Dakota County.
8. Recording of a restrictive covenant (in a form approved by the City Attorney) on
vacant lots within Flint Hills Estates and adjacent property within the Agriculture
District prohibiting additional residential building permit requests and maintaining
agricultural residential density of one dwelling per forty acres until such time as the
property is rezoned.
9. Shifting the lot line between lots 2 and 3 to ensure that both meet the Agricultural
district minimum lot size of 2.5 acres.
10. Conformance with all other recommendations of City Staff.

Flint Hills Resources Simple Plat Request for 14380 Blaine Avenue
Council Member Shoe- Corrigan asked about the standards for residential lots below five acres.
She noted that normally the density is averaged out with other lots for a rural residential density
of two units for 10 acres. Community Development Director Lindquist noted that this property
has eight homes on it now and that number would be reduced to three homes and one open lot.
Although this is still not compliant with standards, it is closer to compliance. The property is
owned by Flint Hills but is not contiguous to their larger parcel. Lindquist said this would be a
trade -off to accomplish other goals and it is up to the City Council's discretion. Shoe - Corrigan
requested that additional negotiations be conducted and this item be tabled for their response.
MOTION by Shoe - Corrigan to table the consideration of a resolution for approval for the Flint
Hills Estates plat. Second by Droste. Ayes: Strayton, DeBettignies, Shoe - Corrigan, Droste,
Riley. Nays: None. Motion carried.

Public Hearing: Flint Hills Resources Administrative /Simple Plat
This plat concerns one parcel containing eight houses located at 14380 Blaine Avenue. Flint
Hills would like to subdivide the land into four individual lots with three of the lots containing a
single family dwelling. Lot 4 adjacent to CSAH 42 will remain undeveloped. The remaining
five homes on the site will be removed. These four lots will meet the standards. A new access to
Lot 3 will need approval by Dakota County. Lots 1 and 2 will share their existing access, and
Lot 4 will use its' existing access. Each lot has a septic system and drain field with a location for
a future drain field that are inspected every two years. There is a well on each site.
Chairperson Weisensel opened the public hearing. There were no comments.
MOTION by Weisensel to close the public hearing. Second by Napper. Ayes: Zurn,
Anderson, Napper, Weisensel. Nays: 0. Motion carried.
MOTION by Napper to recommend that the City Council approve the Administrative /Simple
Plat for the property located at 14380 Blaine Avenue subject to:
1. Approval of the new access to Lot 3 from Blaine Avenue by Dakota County prior to the
recording of this subdivision.
2. Remove the existing driveway accessing buildings A, C, D, F, and G and from the
northern edge of Lot 3 to the existing cul -de -sac on Lot 4.
3. Submission of a revised plat in conformance with the right -of -way requirements for
Blaine Avenue and CSAH 42 as set forth by Dakota County.
4. Review and approval of the subdivision by the Dakota County Plat Commission in
conformance with the Contiguous Platting Ordinance.
5. Demonstrate that each lot has a well, septic system, drain field, and backup drain field in
conformance with all Pollution Control Agency (PCA) standards.
6. Dedicate all necessary easements required by the City Engineer including, but not limited
to, a shared access and driveway easement for Lots 1 and 2.
7. Payment of all applicable development fees as specified in the current fee schedule
including three units of Park Dedication.
8. Remove buildings A, C, D, F, and G prior to recording this subdivision with Dakota

BACKGROUND
The applicant, Flint Hills Resources, requests a simple plat for the property located at 14380
Blaine Avenue. Currently, the subject property is one parcel containing eight single family
homes. The applicant proposes to subdivide this property into four individual lots. Lots 1, 2,
and 3 will each contain one single family home while lot 4 will remain undeveloped. The
five other single family dwellings on site will be removed by Flint Hills.
This subdivision is necessary to create four lots which meet the minimum lot dimensional
standards for properties in the AG, Agriculture District and to allow Flint Hills to sell these
properties. Staff reviewed this application against the performance standards for properties
in the AG, Agriculture District and Subdivision Ordinance. Our findings are detailed below.
ISSUE ANALSIS
Land Use & Zoning. The subject property is guided and zoned AG, Agriculture.
Similarity, the existing land use is 8 single family dwelling units on one property. The
houses that will remain on each lot meet the minimum performance standards for these
zoning and land use designations.
Lots. The applicant plans to subdivide the existing 13.2 acre property into four individual
lots. As proposed, Lots 1, 2, and 3 will each contain one single family home (buildings A, E,
and H) while lot 4 will remain undeveloped. These lots and buildings meet the minimum
performance standards for properties in the AG, Agriculture zoning and land use categories.
Detailed information regarding these proposed lots is illustrated in the table below.

Access. As proposed, Lots 1 and 2 will share an existing access onto Blaine Avenue. Lot
3 is requesting a new access. This request must be approved by Dakota County prior to
recording of the subdivision. Lot 4 will also utilize an existing access to Blaine Avenue.
In addition to these accesses, the applicant plans to remove much of the existing
north/south driveway connecting the site. The applicant's plan illustrate that the existing
driveway will be remove from the northern edge of Lot 3 to the existing cul -de sac on Lot
4.
Right -of -Way. According to the City Engineer, Dakota County will most likely require
the applicant to dedicate an additional 50 feet of land for future right -of -way along
County Road 71 (Blaine Avenue). The applicant shall revise their plat to conform with
the right -of -way requirements set forth by Dakota County.
Utilities. The applicant's plans illustrate the existence of on -site utilities including cess
pools and wells. Each lot will be required to have a well, septic system, drain field and
backup drain field in conformance with all Pollution Control Agency (PCA) standards.
The applicant will be required to demonstrate that each property can meet this standard.
Easements. All four lots shall include the necessary easements as required by the City
Engineer. In addition, Lots 1 and 2 shall have a shared access and driveway easement to
allow access from both properties to Blaine Avenue. These easements must be recorded
with the proposed subdivision.
Park Dedication. This subdivision will create 3 new residential lots. As a result, the
applicant will be required to pay $5,400 (3 X $1,800) in park dedication fees. These fees
shall be paid to the City prior to recording of the proposed subdivision.
Home Removal. The zoning ordinance allows only one principal building per lot.
Therefore, the applicant will be required to remove buildings A, C, D, F, and G prior to
recording this subdivision with Dakota County. The Rosemount Fire Department has
expressed interested in using some of the houses for practice burns. Fire Marshall George
Lundy will contact Don Kern of Flint Hill to discuss this possibility.

CONCLUSION AND RECOMMENDATION
Staff recommends approval of simple plat for the property located at 14380 Blaine Avenue.
This plat subdivides the existing 13.2 acre parcel into 3 lot containing existing single family
homes and one undeveloped lot. The five remaining single family dwellings on site shall be
removed by Flint Hills Resource. Staff reviewed this application against the performance
standards for properties in the AG, Agriculture District and Subdivision Ordinance. Our
review found this proposal to be in compliance with the minimum lot dimensional and use
standards for properties in this district. This recommendation is based on the material
submitted by the applicant and the findings contained in this report. It is also subject to the
conditions outlined below.

After reviewing the Administrative /Simple Plat for 14380 Blaine Avenue the Engineering
Department offers the following comments:
• The proposed additional access on Blaine Avenue is subject to Dakota County review and
approval.
• A minimum of 50 -feet should be dedicated for right -of -way along Blaine Avenue.
• The right -of -way needs along CSAH 42 will need to be reviewed.
• The US52 /TH55 /CSAH42 study proposed frontage roads in the area of the proposed plat.
This should be verified and dedicate the appropriate access areas.
• The buildings remaining on site shall have verification that the septic tanks are up to the
applicable code and for buildings being removed the well. and septic shall be
removed /abandoned to applicable code.
• It should be noted that park dedication fees would be collected for the platting of this parcel.

subject to the Dakota County Contiguous Plat Ordinance.
Representatives from the City of Rosemount and Flint Hills Resources provided the Plat
Commission with very helpful information regarding this plat and the vision for
development in the area. The access spacing guideline on CSAH 71 from the intersection of
CSAH 71 and CSAH 42 is an eighth mile. The plat indicates less than the eighth mile
spacing guideline and the City of Rosemount recommended a variance for an access opening
on CSAH 71 along Lots 3 and 4. The Plat Commission approved the variance for access
spacing of less than an eighth mile.
The Plat Commission has approved the final plat and will recommend approval to the Board
of Commissioners when the plat is submitted in signed Mylar form.
No work shall commence in the County right of way until a permit is obtained from the
County Transportation Department and no permit will be issued until the plat has been filed
with the County recorder's Office. The Plat Commission does not review or approve the
actual engineering design of proposed accesses or other improvements to be made in the
right of way. The Plat Commission highly recommends early contact with the
Transportation Department to discuss design features of any construction in public right of
way. The County Transportation Department permit process reviews the design and may
require construction of highway improvements, including, but not limited to, turn lanes,
drainage features, limitations on intersecting street widths, allowance and size of medians,
etc.

Please accept this letter and attachment in response to your correspondence of October 8 and 23,
2003. Don Kern of Flint Hills Resources has provided an alternative strategy for access to
County Road 71with the objective of resolving the issue with the Dakota County Plat
Commission.
The position of the City Planning Department is that the plat represents a reduction of housing
density and substantial resolution of agricultural residential non - conformity. The proposal to
change the current situation of eight existing houses on one parcel to three remaining houses,
each on an individual parcel consistent with Agricultural district lot standards is supported by
staff. Agricultural residential density standards apply to the plat and adjacent properties, which
will prohibit additional housing units under current zoning. Rosemount has adopted a one -
dwelling unit per forty-acre density standard for its Agriculture District.
In an effort to consolidate residential access and provide access flexibility for potential future
development, the plat has been revised. Individual driveway access to County Road 71 has been
eliminated from Lots 3 and 4. In return, a sixty -foot wide easement for a potential future street
will align with the church access to the west. The access for lots 3 and 4 will utilize the
easement. The easement also provides the potential for future access to the undeveloped land east
of the plat as an alternative to its current frontage along CSAH 42. As before, access to lots 1
and 2 will be shared along their common property boundaries.
The plat will be placed on a future City Council agenda pending the outcome of the County Plat

preliminary plat of FLINT HILL ESTATES. Said plat is adjacent to CSAH 71 and CSAH

CSAH 71. Restricted access must be shown along CSAH 42 and CSAH 71 except for two
access openings (joint driveways serving lots 1 and 2 and 3 and 4). The County's Right of
Way Guideline for a 4 -lane divided highway is 75 feet of half right of way and for a 2 -lane
rural highway is 55 feet of half right of way. Therefore, adequate right of way must be
dedicated to Dakota County along both CSAH 42 and CSAH 71.
The Plat Commission does not approve this plat as submitted.
Traffic volumes on CSAH 71 are 1,500 and are anticipated to be 3,000 ADT by the year
2025. Traffic volumes on CSAH 42 are 16,800 and are anticipated to be 24,640 ADT by
the year 2025. These traffic volumes indicate that current Minnesota noise standards for
residential units could be exceeded for the proposed plat. Residential developments along
County highways commonly result in noise complaints. In order for noise levels from the
highway to meet acceptable levels for adjacent residential units, substantial building
setbacks, buffer areas, and other noise mitigation elements should be incorporated into this
development.

9 The Dakota County Plat Commission met on October 6, 2003, to consider the preliminary plat
of FLINT HILLS ESTATES. Said plat is adjacent to CSAH 71, and is therefore, subject to the
Dakota County Contiguous Plat Ordinance.
The Plat Commission did not approve this preliminary plat as submitted
The Dakota County Planning Department's zoning information from the City of Rosemount
indicates this area to be zoned as agricultural (1 lot on 40 acres). The Plat Commission has no
information indicating the City of Rosemount has changed this. If zoning has been changed,
the Plat Commission has concerns regarding the potential for additional development to the
east, and where that access would come from. The proposed access from Lot 4 does not meet
the County's guidelines with respect to its proximity to CSAH 42, and would not be allowed.
There would potentially be one access point allowed from CSAH 71 to Lots 3 and 4. Said
access point would need to be directly across from the church access to the west.
