RECOMMENDED ACTION:
Motion to adopt a resolution approving the lot split and recombination
between the
properties at 3150 and 3160 145 Street West requested by Amy & Robert Golla.
ACTION:
ISSUE
Robert and Amy Golla (3150 145 Street West) are acquiring a parcel of land from their
neighbors, Chad and Greta Hinderaker of 3160 145 Street West. The Hinderaker property
consists of two parcels, one of which extends behind the Golla property. The parcel that
extends partly behind the Golla property will be split, extending the property line between the
Golla and Hinderaker properties across the parcel.
PLANNING COMMISSION PUBLIC HEARING
On September 28, 2004, the Planning Commission conducted the required public hearing.
No one from the audience provided comments. The Commissioners had no concerns, and
moved the recommended action.
BACKGROUND
The Golla and Hinderaker properties that front 145 Street were platted in 1906. The
Hinderaker parcel subject to the requested split was platted in 1928.
Applicant: Robert & Amy Golla, 3150 145 Street West.
Property Owner(s): Chad & Greta Hinderaker 3160 145 Street West.
Location: 3150 and 3160 145t Street West
Area to be split and recombined: 950 sq. ft.
Comp. Guide Plan Desig: Urban Residential
Current Zoning: R -1A, Low Density Residential
Parcel Data: Golla 3150 145 Street
Before combination: 7,500 sq. ft., 50 ft. x 150 ft.;
After recombination: 8,450 sq. ft. (0.19 acres).
The property is non - conforming in lot width and area.
Hinderaker 3160 145 Street
Before split: 16,930 sq. ft., (85 ft. x 150 ft.) +(110 ft. x 38 ft.);
After split: 15,980 sq. ft. (0.36 acres).
Nature of request: 950 sq. ft. will be split from 3160 145 Street West and
recombined with the property at 3150 145t Street West.
SUMMARY
The two properties are in the R -1A district, which has a large number of unusually shaped
and sized lots that pre -date typical Rosemount single- family lot sizes. The Golla property
consists of two 25 -foot wide by 150 ft. deep lots. The Hinderaker properties consist of an 85
ft. x 150 ft. parcel that fronts 145 Street West, and another parcel to the south measuring
110 ft. x 38 feet. The easterly 25 feet of this second parcel abuts the Golla property, the
subject parcel to be split and recombined.
The Golla property is long and narrow. Even after the requested split / combination, the
property will be approximately 1,650 sq. ft., below current lot area standards, and 30 fleet less
than ordinance lot width standards. The requested split and recombination increases the
depth and area of the Golla property, giving them some additional back yard space. The
split/combination does not solve the lot width issue, it will still be considered non - conforming.
Of note, the Hinderaker garage and the Golla house both appear to be about 3 -4 feet setback
from the common property line, resulting in about 6 -8 feet between the buildings. The
proposed action does not change the existing setbacks, which would continue to remain non-
conforming.
RECOMMENDATION
Staff supports the request It does not solve the non - conforming setback situation between
the properties, but it does provide the Golla property"with additional area to improve upon the
existing condition.

A RESOLUTION APPROVING THE LOT SPLIT AND RECOMBINATION REQUEST
FROM ROBERT AND AMY GOLLA OF 3150 145 STREET WEST AND CHAD AND
GRETA HINDERAKER OF 3160145 STREET WEST TO TRANSER A PARCEL OF
LAND THAT EXTENDS BEHIND THE GOLLA PROPERTY.
WHEREAS, the Community Development Department of the City of Rosemount received an
application from Robert and Amy Golla on August 24, 2004 requesting a Lot Split for the
property located at 3150 145 Street West, legally described as:
Present Golla Description:
The west 25 feet of Lot 43 and the east 25 feet of Lot 44, all in AUDITOR'S SUBDIVISION NO. .
1 ROSEMOUNT, according to the recorded map thereof, Dakota County, Minnesota.
Present Hinderaker Description:
Lot 7, AUDITOR'S SUBDIVION NO. 27, according to the recorded map thereof, Dakota County,
Minnesota:
Tract to Be Split Off of Hinderaker Property:
The east 25 feet of Lot 7, AUDITOR'S SUBDIVISION NO. 27, according to the recorded map
thereof, Dakota County, Minnesota:
WHEREAS, on September 28, 2004, the Planning Commission of the City of Rosemount held a
public hearing to review the Lot Split and Combination at 3150 145' Street West and 3160 145
Street West; and
WHEREAS, the Planning Commission adopted a motion to recommend that the City Council
approve the Lot Split and Combination requested by Robert and Amy Golla for the properties
located at 3150 145' Street West and 3160 145 Street West, subject to conditions; and
WHEREAS, on October 19, 2004, the City Council of the City of Rosemount reviewed the
Planning Commission's recommendation and the Lot Split and Combination application and
agreed with the Planning Commission's findings;
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves the Lot Split request and Combination request from Roberta. and Amy Golla of 3150
145 Street West and Chad and Greta Hinderaker of 3160 145 Street West to split a parcel of
land approximately 950 square feet, legally described as follows:

Public Hearing:
5B. CASE 04 -62 -LS Golla (3150145t St. W.) Lot Split.
City Planner Pearson reviewed the Staff Report. Robert and Amy Golla submitted an
application requesting to acquire a parcel of land from their neighbors, Chad and Greta
Hinderaker of 3160 145 Street West. The Hinderaker property consists of two parcels,
one of which extends behind the Golla property. The parcel that extends partly behind
the Golla property will be split, extending the property line between the Golla and
Hinderaker properties across the parcel. Mr. Pearson indicated that staff does support the
request even though it does not solve the non- conforming setback issues between the
properties but does provide the Golla property with additional area to improve upon the
existing condition.
Chairperson Messner asked for questions for Mr. Pearson. The Commissioners had no
questions.
Chairperson Messner asked for comments from the Applicants. The Applicants had no
comment.

MOTION by Zurn to close the Public Hearing. Second by Powell. Ayes:
Schultz, Zurn, Messner and Powell. Nays: None. Motion carried.
Chairperson Messner asked for any follow -up questions. Commissioner Powell
_ questioned if any existing drainage easements need to be vacated. Mr. Pearson
responded that there are no plans for structures to be built and therefore the easement can
remain in place.

recombination between the properties at 3150 and 3160 145 Street West
requested by Amy and Robert Golla subject to:
1. Recombination of the eastern 25 feet of Lot 7, Auditor's Subdivision No.
27 with the Golla Property.
2. Dedication of standard drainage and utility easements, excepting areas
where the existing structures are non - conforming.
3. Payment of G.1. S. fees.
Second by Powell. Ayes: Schultz, Zurn, Messner and Powell. Nays: None.
