APPROVED BY: RECOMMENDED ACTION: Motion to adopt a resolution approving the lot split requested by Cynthia Smith for 14875 Dodd Blvd. ACTION: ISSUE Cynthia and Duane Smith of 14875 Dodd Blvd. are requesting lot split approval to sell the western 40 feet of their property to westerly neighbors, Jeffery & Jackie Doehling of 14885 Dodd Blvd. PLANNING COMMISSION PUBLIC HEARING On September 28, 2004, the Planning Commission conducted the required public hearing. No one from the audience commented. The Commissioners indicated no concerns, and moved the recommended action. Subject to Dodd Road. Doehling Description: The East 75 feet of the lands described as follows to -wit Beginning at a point which is the intersection of the centerline of Dakota County State Aid Road No. 42 and the East line of the West Half of the Southwest Quarter of Section 30, Township 115, Range 19; thence North along said East line a distance of 240.04 feet; thence Westerly at right angles to the last said course a distance of 225 feet; thence South along a line parallel with said East line a distance of 358.75 feet to the centerline of said County State Aid Road No. 42; thence Northeasterly along said centerline of said County State Aid Road a distance 254.39 feet to the point of beginning, according to the Government Survey thereof. WHEREAS, on September 28, 2004; the Planning Commission of the City of Rosemount held a public hearing to review the Lot Split at 14875 Dodd Boulevard and 14885 Dodd Boulevard; and WHEREAS, the Planning Commission adopted a motion to recommend that the City Council approve the Lot Split requested by Duane and Cynthia Smith for the properties located at 14875 Dodd Boulevard and 14885 Dodd Boulevard, to convey 10,494 sq. ft., legally described as follows: Smith Description: Parcel B: All that part of the East Half of the Southwest Quarter of Section 30, Township 115, Range 19 described as follows: Commencing at a point in the centerline of County State Aid, Highway #42 (Dodd Road) as now laid out and traveled, said point lying 1317.7 feet East of the west line of said Section 30, as measured at right angles to said west line; thence deflecting to the left in a Northerly direction at an angle 62 degrees 48 minutes a distance of 246 feet; thence West 80.83 feet to the west line of the East Half of the Southwest Quarter of said Section 30 and the actual point of beginning; thence East 200.83 feet; thence South to the centerline of said Dodd Road; thence Southwesterly on said centerline to its intersection with the west line of said East Half of the Southwest Quarter; thence North along said west line to the point of beginning. Doehling Description: Parcel A: The East 75 feet of the lands described as follows, to -wit: Beginning at a point which is the intersection of the centerline of Dakota County State Aid Road No. 42 and the East line of the West Half of the Southwest Quarter of Section 30, Township 115, Range 19; thence North along said East line a distance of 240.04 feet; thence Westerly at right angles to the last said course a distance of 225 feet; thence South along a line parallel with said East line a distance of 358.75 feet to the centerline of said County State Aid Road No. 42; thence Northeasterly along said centerline of said County State Aid Road a distance of 254.39 feet to the point of beginning, according to the Government Survey thereof. WHEREAS, on October 19, 2004, the City Council of the City of Rosemount reviewed the Planning Commission's recommendation and the Lot Split requested by Duane and Cynthia Smith for 14875 Dodd Boulevard and 14885 Dodd Boulevard. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the Lot Split request from Duane and Cynthia Smith of 14875 Dodd Boulevard and Jeffrey and Jackie Doehling of 14885 Dodd Boulevard, legally described as follows: NOW, THEREFORE, FURTHER BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Lot Split requested by Cynthia Smith for 14875 Dodd Boulevard, subject to: 1. Recombination of forty-foot wide western portion of the slit parcel with the property at 14885 Dodd Blvd. 2. Dedication of standard drainage and utility easements except where structures are currently nonconforming. 3. Payment of G.I.S. fees.
