Brotzler, P.E., City Enginee AGEfIM # 6 F ATTACHMENTS: Resolution, Exhibit, Letter APPROVED BY: RECOMMENDED ACTION: MOTION TO ADOPT A RESOLUTION AUTHORIZING THE PREPARATION OF A FEASIBILITY REPORT FOR COUNTY ROAD 38 IMPROVEMENTS (TH 3 - RR TRACKS), CITY PROJECT #393 ACTION: ISSUE: Consider authorizing the preparation of a feasibility, report for improvements to County Road 38 from TH 3 to the railroad tracks. BACKGROUND: As part of the Brockway development review and approval process, it was identified that improvements to County Road 38 were necessary. These proposed improvements include the widening of CR 38 at TH 3 to accommodate turn lanes and storm sewer improvements associated with the Brockway development and-to address drainage issues along the north side of CR 38. The feasibility report will also analyze the potential extension of sanitary sewer and water to the west side of TH3 along 132 " Street. This is in response to the attached letter from a property owner located on the west side of TH 3 requesting sanitary sewer service. As there will be special assessments proposed for existing properties adjacent to the proposed project, staff is recommending that the proposed project be completed as a separate project from the Brockway development. The feasibility report will address proposed funding sources that will include funding from the Brockway development as required by the preliminary plat approval. Brotzler, P.E., City Engineer DATE: November 3, 2004 RE: Agenda Item #6 F, Authorize Feasibility Report, County Road 38 Improvements (TH 3 — RR Tracks), City Project #393 Included with the above noted agenda item is a letter from the property owner of the Rose Terrace Apartments located at 2951 132 Street West. As noted in the letter, the property owner is requesting City consideration for the extension of sanitary sewer and water service to the property. Upon further Staff review about this request, Staff would like to highlight some points for Council consideration and discussion. Specifically, the property that has requested City services is currently zoned rural residential and is guided to remain rural residential. . The City's Comprehensive Guide Plan indicates that rural residential properties are not anticipated to be provided with City services. The issue of expanding city services into rural areas was briefly discussed when the Council reviewed the North Central Sanitary Sewer Study. This property is not located in the Transitional Residential area which makes justification of the sewer extension more difficult. In addition, the property owner of the Rose Terrace Apartments has verbally indicated to Staff a desire to develop additional property north of this property between Dodd Road and TH 3. Council consideration for a proposed extension of sanitary sewer and water service should also include consideration of the policy implications of extending City services to rural residential properties. Of course completing the feasibility study does not ensure that the Council will approve extension of services. It may make sense to have this information available given that there is a 6 unit apartment on a .76 acre site. Typically staff would not support having an apartment building on septic when city utilities are available. Review of the City's records indicates that there aren't any septic service issues currently at the site. Records indicate that the property was pumped in August 2004. This issue, whether to permit connection of rural residential properties to city utilities that H:\1 103 04. c cmemo. do c immediately adjoin rural parcels, will also occur when the upgrades to County Road 38 occur east of Highway 3. The proposed improvements to County Road 38 will include the extension of sanitary sewer and water. There are rural residential properties north of County Road 38 that are designated as transitional residential, while some are currently rural but are proposed to be brought into the MUSA. The decision about assessments, project costs, and who can access the public utilities will need to be discussed by the Council. At this time staff is requesting approval of the Country Road 38 feasibility study that will also include extension of sanitary sewer and water. Pending the Council direction, the feasibility and cost of extending sanitary sewer and water service across TH 3 to serve the Wenzel apartment property can readily be addressed as part of this larger report. If the Council does not wish to look at the facility of extending utilities on the west side of County Road 38, staff continues to request approval of the County Road 38 feasibility study east of Highway 3.
