The Commissioners identified no concerns, other than to express support for flexibility that would reduce variances. SUMMARY This item is Staff initiated. It concerns a subdivision issue that has been discussed previously with the Planning Commission and Council, but had not been a priority. The review of Biscayne Pointe North illustrates the current problem with the lot depth definition and, therefore, the issue is now before the Council. Currently, lot depth is computed by the shortest distance from the front to rear lot lines as measured along the side yard setback line of the shortest side of a lot. This makes sense in the case of a typical rectangular lot with street frontage on a straight street. Cul -de -sac lots set a different pattern, and often have a concave shape as a result of the dedicated turn- around right -of -way. The turn- around area is double the width of a straight street right -of -way. To put it another way, creation of a cul -de -sac often squeezes lots along the turn- around due to the extra right -of -way needed for the cul -de -sac bubble, expanding the right -of -way from 60' to 120'. The result is often a lot that has the required depth within the building pad but does not along the shortest side. Therefore variances would be needed or replatting of properties to meet the current lot depth definition. Staff believes the main issue associated with lot depth is to ensure that a lot has ample building pad area so that future variances are not needed for principal structure construction. The proposed definition allows the city some flexibility in measuring so that the depth of the lot is not solely tied to the shortest side of property. The suggested solution would be a definition that averages the side lot lines or measures within the primary building zone of the property. Other cities' standards have been examined, and coincidently, many (including Apple Valley and Eagan) don't have a minimum lot depth requirement. Apparently they believe that through lot area and lot frontage requirements, they can achieve reasonable lot depths. Staff is not recommending elimination of the definition, but rather is recommending changes that provide greater flexibility to the city in determining property compliance. 41 Current Definition LOT DEPTH: The shortest distance between the front and rear lot lines, measured at the side yard setback line of the shortest side lot line. Proposed Definition LOT DEPTH: The mean distance between the front and rear lot lines. In order to allow flexibility in determining lot depth for parcels of unusual configuration, lot depth can be measured by averaging side property lines or by measuring a straight perpendicular line extending from the front line to the rear lot line and passing through the building zone, subject to determination by the Community Development Director or the Director's designee. In no case would the perpendicular line passing through the building zone be less than the minimum lot depth standard. RECOMMENDATION Adopt the draft ordinance. CITY OF ROSEMOUNT ORDINANCE NO. AN ORDINANCE RELATING TO THE DEFINITION OF LOT DEPTH, AMENDING ROSEMOUNT ORDINANCE B SECTION 3.2 THE CITY COUNCIL OF THE CITY OF ROSEMOUNT, MINNESOTA ORDAINS AS FOLLOWS: Section 1 . Ordinance B, Section 3.2, the definition of Lot, Depth is amended to read as follows: LOT, DEPTH: The mean distance between the front and rear lot lines. In order to allow flexibility in determining lot depth for parcels of unusual configuration, lot depth can be measured by averaging side property lines or by measuring a straight perpendicular line extending from the front line to the rear lot line and passing through the building zone, subject to determination by the Community Development Director or the Director's designee. In no case would the perpendicular line passing through the building zone be oless than the minimum lot depth standard. Section 2 . Public Hearing: Zoning Ordinance Text Amendment: Lot Depth Definition This item is Staff initiated. City Planner Rick Pearson explained the need for a new lot depth definition. Lot Depth is measured along the Side Lot line, actually along the setback. This makes sense in the case of a typically rectangular lot with street frontage on a straight street. Cul -de -sac lots set a different pattern and often have a concave shape as a result of contributing land to the turn- around. The turn- around area doubles the width of the straight street right -of -way. The result is often a lot that has the required depth along the side lot lines, but not in the middle where it counts for the house/building envelope. The suggested solution would be a definition that averages the lot depth.
